Scope of these General Terms and Conditions

1.1
These General Terms and Conditions apply to services of the
restaurants of Allresto Flughafen München GmbH (hereinafter also referred
to as “allresto” or “we”) Airbräu & Tenne, Airbräu Next To Heaven Terminal 2,
Il Mondo, Käfer Bistros Terminal 1 and 2, Tante Ju’s Speisenwerkstatt, the
Municon Conference Centre and our external catering.
1.2 Differing general terms and conditions of the customer (hereinafter also
referred to as “you”) shall not apply, even if we are aware of such general
general terms and conditions and do not expressly object to them.
2.
Ordering of services
2.1
Catering events with pre-ordered food and drink will not be effective
unless confirmed by us at least in text form (e-mail). We can ask you for your
written declaration of acceptance or counter-confirmation.
2.2
The same applies to bookings of places for our buffet events and to
table reservations of 15 and more persons. Please get in touch with our
respective contact person for reservations.
Failure to use ordered services
3.1 If you are not able to make use of ordered services, please contact our
reservation team. Cancellation of them shall require confirmation by us at
least in text form.
3.2
If you cancel an ordered service or do not make use of it, we can
demand the agreed payment or a reasonable portion of it, unless it only
relates to a table reservation of up to
14 persons without pre-ordered food (also: buffet) and drinks. You can cancel
bookings of places for our buffets or pre-ordered catering for up to 14
persons at the latest on the 7th day before the day of the event and larger
catering events on the 21st day before it without incurring any costs. After
that we can demand 70% of the anticipated payment as a reasonable charge
and, if no prices have been agreed, estimate €30 net consumption per
person, unless you prove that we have incurred a lower loss.
3.3
If we had offered services we obtain from a third party (e.g. DJ
entertainment, musical performances), we shall charge the full payment
agreed for them if the services are not used.
2.3
After receiving an offer for or confirmation of catering, please check
right away whether all the details are correct and inform us of any incorrect
information.
3.4 If fewer persons than ordered take part in the catering event, we ask
you to cancel that part of the service for the persons who will no longer be
attending; if you fail to observe the above cancellation deadlines, we reserve
the right to charge an appropriate part payment.
2.4
In the case of large catering events, we can ask for a reasonable
down-payment or credit card data for authorisation in advance.
3.5
In the case of hospitality outside our catering premises, water and
electricity must be provided by the customer.
2.5 The specified event times shall be deemed as having been agreed. If
no times are specified, we can end our catering service after a reasonable
time and, in the case of evening events, at 24:00 hours if in doubt. We keep
tables reserved for 30 minutes at most if there are other quests wishing to be
seated.
4.
Miscellaneous
2.6 In cases of doubt and unless explicitly stated, the prices for customers
who are discernibly entrepreneurs shall be net with value-added tax payable
on them and, for private customers, end prices including value-added tax.
2.7 Food and drink can be brought along only if this has been agreed with
us in advance and confirmed by us.
4.1
We cannot assume any liability for lost or stolen property of guests
outside the cloakroom or safekeeping service provided by us as part of
catering.
4.2 The sole place of performance of the obligations of both parties from
the catering agreement shall be Munich Airport campus. The place of
jurisdiction for both parties shall be determined solely by said place of
performance if the customer is entered in the Commercial Register, is a
public law body or is a person without a place of general jurisdiction in
Germany.
4.3 If a catering agreement or one of these General Terms and Conditions
is ineffective, the other provisions shall be unaffected thereby.
