Having spoken to the EA, I understand that all applications for new development adjacent to a river course need to consult the EA for their advice. This is not necessary for household extensions. The EA’s opinion is given for the Local Planning Authority to implement as they see fit and can use their own discretion on this and adapt to the particular site and the prevailing conditions. 2. We have already discussed the site in the adjoining road (Gladstone Road), planning number 15/10116, which has been given permission for a new detached house to be built within the buffer zone. This shows that development, landscaping and fencing are permitted within the buffer zone. 3. The Surbiton Stream is not spring fed but collects local street surface water drainage. This section of the stream flows from under the A3 bypass in a culvert and flows for approximately 450 metres adjacent mostly to open fields and a school sports field before entering another culvert. This area provides natural bio diversity and ecology. 4. We have done a quick search of the local area to find other schemes which have been permitted with fencing adjacent to the outer bank. 61 Gladstone Road, Surbiton – 15/10116 1 Penrhyn Road, Kingston upon Thames – 13/12453 81 Couchmore Avenue, Esher – 2011/6877 5. The EA’s letter of the 28th June 2013 stated that they would prefer “that the fence should be located as far from the outer bank as reasonably possible” As a compromise I would suggest providing a buffer zone of 4 metres at the southern end and 2 metres at the northern end. This is an improvement on the present position and will provide a natural wildlife corridor on this side of this section of the stream. It should also be noted that the opposite bank adjoins open fields so that in this location the ecology is protected as it is greenbelt land. 6. We have consent for the side pathway (EA’s letter 16 May 2013), which is approximately 500mm higher than the existing ground level. The pathway width is 1200mm, this leaves a space of 1800mm for access which is level to the remaining side garden area. I would ask that the Council approve this revised scheme as shown on drawing numbers 1578 L01 D 1578 02 U L02 C
