SANITARIUM WEET-BIX KIDS TRYATHLON ENTRY WAIVER TERMS AND CONDITIONS
1. I acknowledge and agree that the terms and conditions set out herein shall apply to each child/ward of mine that I allow to participate. I consent to my child/ward entering (registering) in one
of the events in the Weet-Bix Kids TRYathlon 2017 Series.
2. I acknowledge and agree that my child/ward is between the ages of 7-15 (as at the date of the relevant event).
3. I acknowledge that this event involves the real risk of serious injury or even death from various causes including over exertion, equipment failure, dehydration, accidents with other
participants, spectators or road users, course or weather conditions and other causes.
4. I understand that my child/ward should not participate in this event unless they have prepared appropriately.
5. I give consent to my child/ward to participate and accept all risks necessarily flowing from their participation, which could result in their death, physical or mental injury, or the contraction or
aggravation of a disease, including during the event or any training undertaken in preparation for the event. Accordingly, to the extent permitted by law, I release and will not hold liable all
persons or corporations associated directly or indirectly with the conduct of the event, or training program offered in connection with the event, from all claims, demands and proceedings
arising out of their participation and I hereby indemnify them against all liability (including liability for their negligence and the negligence of others) for all injury, loss or damage arising out of or
connected with their participation in this event. This release and indemnity shall extend to and include the event organisers, X-Tri Australia, as well as, Sanitarium Health & Wellbeing Company
and their respective directors, partners, managers, officers, agents, contractors, employees and volunteers, including medical and paramedical personnel appointed for the event, the owners,
licensees and occupiers of land upon which the event or any part of it is conducted, or any other person or organisation, which is involved directly or indirectly with the conduct of the event in
any manner whatsoever, including promoters, and sponsors. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.
6. I consent to my child/ward receiving any medical treatment that the event organisers think reasonable during or after the event. I understand that medical and paramedical personnel are
appointed for this event.
7. I understand that compulsory insurance cover affected for participants by way of one day membership of Triathlon Australia in this event may not cover my child/ward for all injury, loss or
damage sustained by my child/ward.
8. Safety precautions undertaken by the organisers (such as course supervision, participation safety briefings, and bicycle safety checks) are a service to my child/ward and other participants
but are not a guarantee of safety. I acknowledge and accept that while the organisers take reasonable precautions to supervise my child/ward during their attendance at the event, I am
ultimately responsible for their supervision and agree to attend the event to ensure appropriate supervision.
9. I acknowledge and accept that my child/ward will be fully responsible for the security of their personal possessions at the event.
10. My child’s/ward’s registration is not transferable to any other person. I accept that if my child’s/ward’s entry form and payment is not received by Sanitarium Health & Wellbeing Company by
the relevant and stated online registration closing date for the event entered into, my child/ward may not be able to participate in any of the Weet-Bix Kids TRYathlon events. If Sanitarium Health
& Wellbeing Company chooses to accept late entries for any reason, a $10 late fee will occur per individual or family entry.
11. I understand that my child’s/ward’s entry fee may be refunded if the event is cancelled due to war, state of emergency, disaster, flood, torrential rain or other like ‘ACT OF GOD’, or for any
other health and safety reason, as determined by Sanitarium Health & Wellbeing Company.
12. If the event is cancelled by Sanitarium Health & Wellbeing Company, for any reason other than listed in Condition 11, I understand that my child’s/ward’s entry fee is fully refundable. The
amount refunded is in accordance with what was actually paid by you. I will abide by the decision of Sanitarium Health & Wellbeing Company to cancel the event if they feel it is necessary.
13. I acknowledge and agree that if I or my child/ward wishes to cancel their already completed registration for the 2017 Sanitarium Weet-Bix Kids TRYathlon event, after the relevant stated
online registration closing date, for any reason whatsoever, then I and my child/ward will not receive any refund. I understand that there will be a cancellation fee payable if I or my child/ward
cancels their registration before the relevant stated registration closing date.
14. While the event organisers will use all reasonable efforts to ensure that event is conduct as advertised, I acknowledge that by reason of circumstances beyond the control of the event
organisers, it may become necessary or desirable to change the form of the event and if that occurs, I consent to the changes and I agree that each and every one of the conditions set out
herein shall apply to that changed event.
15. I acknowledge and agree that as part of the registration process to provide my telephone number and information about my child/ward’s medical, physical, dietary conditions and/or
allergies, from which my child/ward suffers, that might affect their performance, or be relevant if medical treatment is needed, or if drinks or food are provided. I acknowledge and agree that
this information and my child/ward’s address details can appear on my child/ward’s registration number, which they will be required to wear during the event.
16. I acknowledge that images and photographs of my child/ward will be taken by official Sanitarium photographers including Supersport Images and I agree that such images can be used for
promotional purposes for an indefinite period, without any further remuneration. I also consent to Sanitarium Health & Wellbeing Company providing my child’s details to Supersport Images for
the purpose of promoting photographs taken at the event, for an indefinite period, without any further remuneration. I acknowledge that I also have the option to purchase images of my
child/ward and agree to the following terms and conditions, which will apply if I select and pay for the digital photo pack during registering my child/ward for the 2017 Weet-Bix Kids TRYathlon
event: (a) I understand that the digital images will not be provided as printed photographs, and will be provided as downloadable digital images; (b) I understand that all images are full
resolution electronic downloadable images only; (c) I understand that photographers are positioned at the swim, ride, run and medal location, however images at each location cannot be
guaranteed. Accordingly, I understand that I may not receive an image of my child/ward at all locations; (d) I understand that my child/ward must wear their identification number in a clear and
prominent fashion during and after the event to enable the best chance of photographing my child/ward; (e) I understand that after the event I will be sent an email from Supersport Images
containing my user name and password, and in order to receive my child/ward’s digital images I must follow the directions and redeem the images online by 30/06/2017; (f) I understand that
Sanitarium and Supersport Images is not responsible for late, lost or misdirected correspondence and that I must contact Supersport Images within 2 weeks of the applicable event if I have not
received the email containing your user name and password to access the images; (g) I acknowledge that the images of my child/ward may contain other participants; (h) I acknowledge that
the pre-order fee for the digital photo pack is $16.69 (including GST).
17. I acknowledge and agree that I have given permission to pay for the fee via my credit card (if paying via credit card) and take full responsibility for such payment.
18. I acknowledge and understand that when using an applicable discount code, it must be entered in the ‘Discount Code’ field when completing an online registration or in the space provided
on any hard copy registration form. I acknowledge and understand that discount codes are limited to the use of one code per transaction. I acknowledge and understand that using a discount
code does not guarantee entry into any event and registration details that include a discount code must be submitted prior to the online registration closing date or before the event sells out. I
acknowledge and understand that all discount codes expire on Sunday 28 May at 8.15am.
19. I acknowledge and agree that before my child/ward is entered as part of a Group, a Group must be registered (at no cost) by a parent/guardian, school representative or club representative with the express intent of establishing a Group with a minimum of 5 participants. I acknowledge and agree that if I act as the parent/guardian, school representative or club representative
registering a Group I am solely responsible for ensuring that there is a minimum of 5 Group Members participating in the event and that I may be liable to pay the difference between the
individual price and the Group discounted price should a minimum of 5 Group Members not be reached by the relevant and stated online registration closing date for the event entered into.
20. I acknowledge and agree that if I enter my child/ward as part of a team of two (a), then my child/ward will compete in the event with another child, undertaking one of the stages; (b) I must
pay the fee for my own child or ward; (c) and Sanitarium Health & Wellbeing Company is not responsible should a parent or guardian of a team member fail to pay or agree to these conditions,
and therefore their child or ward is unable to participate in the event. I acknowledge that if my child’s or ward’s stage of the event is cancelled, then my child or ward may need to undertake
another stage on the day of the event.
21. I acknowledge the following statement applies to the collection of my and my child’s/ward’s personal information:
Your information and your child’s/ward’s personal information is used for the purpose of conducting the event, and such other purposes as set out in our privacy policy, and this information may
be shared with third parties who are involved in conducting the event, including those located in the New Zealand, and you consent for this to occur. While overseas parties are subject to
privacy obligations, you accept that such obligations may differ from and be less stringent than the requirements of the privacy laws of Australia. If the personal information is not provided then
your child/ward may not participate. I understand that my child’s/ward’s name and postcode will appear on the Weet-Bix TRYathlon 2017 website once they are registered. I consent, unless I
otherwise advise: (a) to Sanitarium Health & Wellbeing Company using my child’s/ward’s personal details including name, and also image and photograph before, during or after the event, for
promotional, marketing, broadcasting, reporting or surveying purposes in any media worldwide, including but not limited to, for the purpose of promoting Weet-Bix TRYathlon current and future
events held in Australia and New Zealand; (b) allowing Super Sports Images to include my child’s/ward’s photograph and details on their website. To opt out of direct marketing from
Sanitarium, make a complaint about the treatment of personal information, or to access, update or correct any information contact Sanitarium Health & Wellbeing Company on 1800 989 999.

22. I acknowledge and agree that my child/ward must abide by, and my child/ward agrees to abide by all participation rules and directions issued by Sanitarium Health & Wellbeing Company
and the event organisers. I acknowledge and agree that I, being the parent/legal guardian of the child/ward participating in the 2017 Weet-Bix Kids TRYathlon event, have read this document
and I understand and accept the conditions it contains.
