Bankruptcy Law (PLA2460 – 520F): Spring 2017 - Online Syllabus
Course Description: Bankruptcy Law is designed to introduce students to the historical, political and legal
principles of bankruptcy law. This course will include the changes in the bankruptcy law after enactment of the
Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). Prerequisite: Appropriate
placement scores or successful completion of college prep courses. SP
Student Learning Outcomes: Upon completion of this course the successful student should be able to do the
following:
1. Define and discuss bankruptcy terminology used in bankruptcy. (Chapter quizzes and Exams 2- 4)
2. Identify the important issues in representing debtors and creditors. (Discussions 1 & 2)
3. Analyze alternatives to bankruptcy and evaluate best options for debtors. (Exam 1)
4. Prepare Schedules and Statements for a Chapter 7 Bankruptcy. (Project)
Minimum Technical Requirements
Students enrolled in this course must be able to:
 Use all required features of Falcon Online such as discussion boards and the ‘Assignments’ drop box
 Send and receive attachments by e-mail
 Create and submit files using Microsoft Word processing programs
Computer skills required are a general knowledge of word processing and ability to attach and upload
documents. Daytona State College provides distance education technology that allows students to participate in
educational programs that would traditionally be unavailable to non-traditional students. However, due to the
nature of distance education, each student must accept a higher level of responsibility for his/her participation
and behavior in order for the program to be successful.
College E-Mail and Resources: Microsoft Office 365, with 1TB of OneDrive storage, is available to enrolled
Daytona State College students. Students are provided a college email address that serves as the student’s
official source for college communication. In addition to email, Office 365 provides students with shared
calendars, the ability to create and edit documents online, team sites, and other collaboration tools. Whether
you work on a PC, Mac, tablet or phone, you will have a consistent experience across all of your devices. The
service includes online versions of Word, PowerPoint, Excel, OneNote, and OneNote Class Notebook. For more

Class Format: This class will be completely online. Please approach this course with an open mind. I hope you
enjoy taking a class online. The class is not any easier than taking Bankruptcy Law in a traditional classroom, but
in addition to saving gas, you can do this class at any time you want, even at 3:00 AM when you can’t sleep.

2) You need computer virus protection. A virus can spell disaster. Use of a reputable anti-virus program is a
requirement for participation in this course. Also, back up your files. Please practice safe computing by having
a virus detection program loaded on your computer that checks for viruses on e-mail, attachments, documents,
etc.
3) You need a reliable high-speed Internet connection, and a reliable Web browsing program.
• If you are using Internet Explorer: Go to the 'Tools' menu at the top of the browser and select
'Compatibility View'. When working in ‘Compatibility View,’ you will be able to see the ‘Announcements’
(the front page - also known as the 'Course Home' page). I post lots of information on the Course Home
page in the ‘Announcements’. If you are not in ‘Compatibility View, you may be missing a lot!
• If you are using Google Chrome: If you are using Google Chrome, or have set your page size large, you may
not see the “Submit’ and ‘Post” buttons at the bottom of the page on the ‘Discussions’ and the ‘Exams’.
Sometimes these buttons get covered by the taskbar at the bottom of your computer. Just a reminder, if
you are having technical issues, please call the Helpdesk - (386) 506-3849.
• If you are using AOL: Once you are connected to the Internet, minimize your AOL browser screen and click
on your Internet Explorer open a new browser. You can also use keyword "smile4u" which will prevent AOL
from logging you off due to inactivity. If you do not do one of the above, you may be logged off when
reading a long document or taking a quiz.
Are You Ready to Take an Online Class: Are you Ready? (See also: Is an online course right for you?) You
need to feel very comfortable working online (not just gaming or surfing the WEB.) Since you will complete
all work online, you have to know how to email and how to use ‘Word’ before you even start the course.

Classroom Policies
Disclaimer: Teaching policies and regulations for this course are not open for discussion or negotiation. This
syllabus has been constructed to be as complete as possible but is by no means a binding document. I reserve
the right to alter policies, procedures, and the syllabus as needed. Please utilize the website regularly as any
changes to the syllabus will be posted there.
How to proceed through the course: Students should plan to have three hours of study time per week for each
credit hour of class time. Example: when taking a typical 3 credit hour course, students should plan to spend at
least 9 hours per week doing coursework and studying for that course regardless of the mode of delivery
(online, hybrid, face-to-face).
TO BE SUCCESSFUL IN BANKRUPTCY LAW:
1. Print and Read the Syllabus and put it in a three ring binder close to your computer. The syllabus has ALL of
the important deadlines for discussions, quizzes exams and the project.
2. Read the Textbook and any other assigned materials before the required date in the syllabus. Use a
highlighter and highlight important material in the book.
3. Keep a Portfolio. Get a three ring binder (portfolio) for this class and take your own notes on each chapter,
print the notes and then put them in the binder by chapter. This will make it easier to study for the exams later
on.
4. View the PowerPoint Slides for the Chapter. There are PowerPoint slides for each chapter and they are a very
good summary of the important points of the chapter. You may also want to print off the PowerPoint slides and
insert them into your portfolio. If you get an ERROR message when trying to open the PowerPoint slides,
remember to SAVE them first, and then after you save them you will able to OPEN them. If you still have trouble
opening the PowerPoint slides, please see the “FAQ’s” in under the “Content” tab on the NavBar or call the
Online Helpdesk at (386) 506-3950.
It is very important however that you do not rely only on the PowerPoint slides to get information from the
chapter. YOU MUST READ THE BOOK!

6. Keep a List of the Vocabulary with the Definitions. When reading the book you will notice that this course is
heavy on new vocabulary. You will see words in the margins of the text. You need to know these terms to be
successful in bankruptcy practice and to be successful on the exams.
7. Take the Required Quizzes. There will be eighteen (18) quizzes – one for each chapter. Each 30 minute quiz
has 10 multiple choice or true/false questions. You will have UNLIMITED ATTEMPTS at the quizzes. Only your
highest quiz score will be counted into your grade. Each quiz is worth 10 points for a total of 180 points. Please
take these ‘Randomized’ quizzes over and over for practice. The more you take the quizzes the more familiar
you will become with the material and the better you will do on the exam. The quizzes can be accessed through
the ‘Chapter Content’ or from the ‘Quizzes’ tab.
8. Make Use of the US Government’s Bankruptcy Basics Website at:
http://www.uscourts.gov/FederalCourts/Bankruptcy/BankruptcyBasics.aspx You will find videos and information
on all of the Bankruptcy Chapters that we will be covering this semester.
9. Participate in the “Discussions”: For more information on how I grade the discussions in this class, please see
“How I Grade the Discussions in Bankruptcy Law,” (below). I grade discussions for each course differently. If you
have had me before, PLEASE read “How I Grade the Discussions for Bankruptcy Law.” It may be different than
past courses that you have had with me. Discussions will only be open for two (2) weeks, and must be posted by
11:59 PM on or before the due date to receive any credit.
Communication:
Interaction: Because this is a completely online course, the interaction in this class takes place online. When you
sign into the online classroom, check the class ‘Announcements’ on the Course Home Page (the front page.) I
will post important announcements in the ‘Announcements.’ Also, check your e-mail for messages from me.
Read all discussion posts and check your e-mail every time you sign in. You should sign in at least three (3) days a
week.
Respect your classmates’ opinion. And I also expect your classmates to respect your opinion. Please be
considerate and polite in your discussions.
Phone: Students may contact me by phone at (386) 506-3511. If you call during my office hours and I do not
answer, please leave a message and I will get back to you as soon as possible. I may be with a student, in the
law library or at a meeting.
e-mail: You may also contact me by clicking on the “Classlist” and then clicking on the email button. Please put
your course and a subject in the “Subject” line of the email. I will get back to you as soon as possible, but no
later than 48 business hours (business hours are Monday through Friday).
(Netiquette) Be courteous and considerate. Being honest and expressing your position thoroughly is very
important, but being considerate of others online is just as important as in the classroom.
Make every effort to be clear. Online communication lacks the nonverbal cues that fill in much of the
meaning in face-to-face communication.
Do not use ALL CAPS. This is considered “shouting” and the message is very hard to read.

Check spelling, grammar, and punctuation (you may want to compose in word processing software then cut
and paste the message into the discussion or e-mail). Use language that is correct and appropriate in
anything you write. You are always expected to check spelling, use correct punctuation, and properly cite
your sources. Please leave the text message abbreviations on your phone.
Break up large blocks of text into paragraphs and use a blank line between paragraphs.
If you have a question regarding the course material, post the question in the Discussion Forum ‘Course
Questions.’ Other students will appreciate seeing the question and your instructor’s answer. Students are
encouraged to respond to other students’ questions. Learning by teaching is a powerful tool. Remember that
the Discussion Forums are our “classroom.”
Never assume that your e-mail cannot be read by anyone but you; others may be able to read or access your email. Never send or keep anything that you would not mind seeing on the evening news.
Please keep all postings professional. Correct grammar and spelling are an important part of the business
environment. Review your comments before you post them. Write as though you were sending the
correspondence to the Senior Partner of the law firm.
Handling Of Assignments:
Your Bankruptcy Schedules Project will be uploaded in separate named files to the Falcon Online
“‘Assignments’” by the date and time it is due. If you are sending an email, email me through the class and
please put in the subject line PLA2460.
Completion dates for the ‘Discussions,’ and the Bankruptcy Project are found in this syllabus in the Course
Schedule.
The Graded Group Discussions will have an opening date and a closing date for each part. You will be
unable to post before or after these dates. Please read the grading criteria and procedures for the Graded
Group Discussions carefully.
Please complete the quizzes and exams by the ‘Highly Suggested’ due date.
Attendance Policy: Under the college’s new attendance policy, students who stop attending this class will be
withdrawn from the class and receive a final grade of W1 (Withdrawn). Attendance includes participating in
online or face-to-face environments as required. In this online class if you do not log in for two weeks, you will
receive the W1 grade.
Late Work/Make-Up Work and Exams:
If you miss turning in an assignment, you may turn it into the “Late ‘Assignments’.” The equivalent of one letter
grade will be taken off late assignments. If you miss a discussion, it cannot be reopened. It is as if you missed
that class. All work must be completed by 11:59 PM on THURSDAY, MAY 11, 2017! Your exams will be open
from the day the class begins until 11:59 PM on THURSDAY, MAY 11, 2017.

Evaluation / Assessment Methods:
A point system is used to calculate your grade. The course grade will consist of:
• Introduction and Honor Pledge
• 2 Graded Discussions
• 18 Quizzes
• 4 Exams
• One Project: Complete Bankruptcy Schedules
Discussions: There will be 2 Graded Discussions worth a total of 100 points each. Once a discussion closes, it
cannot be reopened for any reason. It is as if you missed that class.
Graded Group Discussions:
Your graded group discussions will consist of two parts. During PART 1 of the discussion, you will present
your research on the topic. Each student will submit ONE ORIGINAL POST presenting his research and
conclusion on the topic. This post will include citations for all research. Citations should include live links to
information gathered from online sources. This part of your discussion can earn up to 50 points. ORIGINAL
POSTS WILL NOT BE ACCEPTED BEFORE OR AFTER PART 1 OF THE DISCUSSION.
The second part of your graded group discussion will involve replying to TWO (2) other students’ posts. You
will “reply” during PART 2 of the discussion. Your replies should show reflection on the original post AND
provide further research on the topic. Your replies should include live links to information gathered from
online sources. This part of your discussion can earn up to 50 points (25 points for each reply). REPLIES WILL
NOT BE ACCEPTED BEFORE OR AFTER PART 2 OF THE DISCUSSION. The ‘Graded Group Discussion’ Boards
are locked so you will only be able to post during the time frame allotted.
Please review Discussion Information and Group Discussion Grading Criteria carefully for the specific
discussion topics and how your discussion will be graded.
Grading Criteria for Group Discussions:
Part 1 – Your original post will be graded for accuracy, professionalism, and timeliness. The discussions boards
are locked so you will only be able to post during the time frame allotted. Your original post can earn up to 50
points:
• Posts earning 40 – 50 points: are well researched and supported by citations or live links.
• Posts earning 30 – 39 points: posts with only one source.
• Posts earning between 0 – 29 points: unprofessional, inaccurate or incorrectly cited posts.
Part 2 – Replies to TWO (2) other posts will be graded for staying on topic, adding new information,
professionalism, and timeliness. Your two (2) replies can earn up to 50 points (25 points each).
• Posts earning 20 – 25 points: will include research from one or more sources.
• Posts earning between 0 – 19 points: unprofessional, inaccurate or incorrectly cited posts.
You are required to read ALL POSTS from other students during Part 1 and Part 2. This means you must be
online often during the graded group discussion. Please do not wait until the last few days to read posts. The
purpose of a group discussion is to build upon posts with more information and learn from other students.

Please Only Post Three Times for Each Graded Discussion. Your posts should be well- researched and add
value to the discussions. They should draw information from multiple sources and these sources must be cited.
An online discussion should mirror a face-to-face discussion in that the participants are constantly enriching the
topic, giving it a life of its own. This enriched content imbues all discussion participants with an enhanced
perspective, enabling and encouraging them to re-deposit even more insightful postings. For this cycle to take
place, I ask that everyone's postings are comprised of more than just one or two lines, and be on topic. Please
check your postings to ensure that they meet the criteria specified above. Remember, the initial spark of your
thoughts can be the catalyst to ignite another's.
Quizzes:
There will be eighteen (18) quizzes – one for each chapter. Each 30 minute quiz has 10 multiple choice or

Exams:
There will be four (4) exams. Each 120 minute exam will have 50 multiple choice/ true/false questions. You will
have TWO ATTEMPTS at each graded exam and I will take the highest score as the final score. Each exam is worth
100 points for a total of 400 points. Manage your time carefully. Click on ‘Quizzes’ to take an exam. Keep in mind,
once you start the graded exam you must take it then and you will have 120 minutes to complete the exam. You
will not be able to save it and return at another time.
Your Quizzes and Exams will be open from the day the class begins until 11:59 PM on Thursday, May 11, 2017.
Project: You will have one (1) project in this class. This project will be the complete gathering and preparation of
the Statements Schedules for a Chapter 7 bankruptcy. We will be using the FREE Bestcase Bankruptcy
educational software to complete a Chapter 7 bankruptcy. Bestcase Bankruptcy is what the majority of law
offices use to prepare bankruptcy Statements and Schedules. We will be doing “Exercises at
http://www.bestcase.com/edu/students.htm to enter the information and do the Statements, Schedules and
Voluntary Petition for our clients.
NOTE: Full instructions on the Project and the “Grading rubric” are included in the “Content” section of the
course. When you complete the project you will have to upload the forms to the “Assignment” drop box. You
would do a similar type of electronic filing to file a bankruptcy with the court. The project is worth 200 points.

GRADING POLICY: Grades will only be given to students enrolled for college credit. You may, at any time during
the semester, obtain your grade average by making an appointment or simply keeping track of your points. If
you are auditing this course, you are not eligible to take any exam or receive a grade on any project. Your grade
in this class will be based on a points system. You will receive points for the following elements of the class:

Incomplete (I) Grades:
An incomplete grade will NOT be given UNLESS the following criteria are met:
 A request in writing is submitted to the instructor prior to last three weeks of class,
 All assignments (quizzes and exams) were completed at that point in time,
 The student has a grade C or higher at that point in time.
The incomplete work must be made up before the middle of the next major semester. “I” grades
automatically convert to “F” grades if the make-up requirements are not met and the appropriate grade
change is not submitted by the deadline as published in the College Catalog.

Class Withdrawal Process:
Although it is not necessary to have approval from the instructor to withdraw from the course, you should
discuss the situation with the instructor. Many times the issue can be resolved with communication. Please
review Refund/Repayment Policy and also check with the Office of Financial Aid to determine how this
withdrawal might affect your current and future aid eligibility. If the decision has been made to drop the class,
you should:
