FEBRUARY 24, 2014 – REGULAR MEETING

EASTSIDE UNION SCHOOL DISTRICT
CALL TO ORDER AND ROLL CALL
Mrs. Johnson, Vice President, called the Eastside Union School District (EUSD) Board of Trustees
Regular Board Meeting of February 24, 2014, to order at 5:30 p.m. in the Eastside Union School
District Boardroom.
Members present:

Ms. Crawford was absent due to illness.
PUBLIC COMMENTS ON AGENDA
No comments from the public were made.
ADOPTION OF AGENDA
The Governing Board adopted the agenda as submitted by a motion made by Mrs. Foster seconded by
Ms. Thompson, and carried by the following vote:

CLOSED SESSION HELD
The Board of Trustees entered into closed session at 5:31 p.m. in order to meet for the following
reasons:
1.
To deliberate and determine whether Student No. 13-14-17 should be expelled (EC § 48918).
2.
Update on pending Litigation Matter #081513 (GC § 54956.9).
3.
Conference with Legal Counsel-Anticipated Litigation: Government Code sections 54956.9(d)(2)
and (3) and 54954.4(c)).
4.
Update from the District Negotiation Team regarding Eastside Teachers Association (ETA) and
CSEA Chapter 779 with District Representatives Mark Marshall, David Howard, and Maria
Palmer (GC § 54957.6).

Mrs. Johnson reconvened the meeting into open session at 6:00 p.m.

CLOSED SESSION REPORT
Mr. Pincetich, Clerk, reported the Governing Board took the following action:
1. The Governing Board took action to accept the waiver of the right to an expulsion hearing and
expel Student Number 13-14-17 from the Eastside Union School District from January 27, 2014
through the end of the 2013/2014 school year by a motion made by Peggy Foster, seconded by
Doretta Thompson, and carried by the following vote:

2. The Governing Board rejected the claim for damages for pending Litigation Matter #081513 (GC §
54956.9) by a motion made by Peggy Foster, seconded by Doretta Thompson, and carried by the
following vote:

3. A conference was held with legal counsel relative to anticipated litigation: Government Code
sections 54956.9(d)(2) and (3) and 54954.4(c)). No additional action was taken.
4. The Board received an update from the District Negotiation Team regarding last week’s
Negotiation session with the Eastside Teachers Association; the Board has provided the team with
direction.

February 18, 2014 were adopted as submitted by a motion made by Peggy Foster, seconded by Doretta

PERSONAL APPEARANCES
GENERAL
Alicia Turner, Josefina Roma De Sharp, and Janeth Vargas, Columbia parents, addressed the
Governing Board regarding their concerns about the possibility of the Columbia SDC class being
moved to Tierra Bonita. Ms. Turner explained parents had heard teachers referring to the Special
Education Community and it moving to Tierra Bonita. She felt calling it a Special Education
Community was not fair; it was worse than being bullied. Ms. Turner said the SDC students
needed a little extra time for eating breakfast in the cafeteria. She had seen students’ trays taken
away from them because it was 8:00 a.m. and the students needed to be in class. Mrs. Johnson
asked the parents to set up an appointment with Dr. Marshall and Margo Deal to discuss their
concerns further.
Ms. Thompson asked Ms. Turner for clarification as to whether she was concerned that the
students were being moved or was it the jargon used to describe the Special Education
Community. Ms. Turner said it was the jargon. They are building a new school and the students
will be going to an older school.
Ms. Roma De Sharp expressed her concern with the number of students in Mrs. Helble’s class.

There were 16 students assigned to the same group with one teacher and two assistants. She had
an issue with what looked like the same program being used for instructing all of the students in
the classroom. Ms. Roma De Sharp was also concerned that the children were not being included
in field trips and cultural activities.
Mrs. Johnson thanked the parents for addressing the Board. She again asked for the parents to set
up a meeting with the District Administration. If the parents still had concerns after the meeting
then they should address the Board again.
EASTSIDE TEACHERS ASSOCIATION
David Dionne, ETA Vice President, said the ETA Negotiating Team was disappointed to receive
an ultimatum from the District Negotiating Team at the table during the last negotiation session.
ETA hoped the Board will reconsider and direct its Bargaining Team to resume negotiating with
ETA.
CSEA CHAPTER 779
No reports were presented at this time.

Dr. Marshall had the Cabinet Team share news, milestones, and upcoming projects in their
departments with the Governing Board.

RESOLUTION NO. 13-14-13 ADOPTED
The Governing Board adopted Resolution Number 13-14-13 in order to eliminate one 4.0 hour
Instructional Aide I – Library position at Columbia and then took action to increase one 4.0 hour
Instructional Aide I – Library position at Columbia to a 6.0 hour assignment by a motion made by
Doretta Thompson, seconded by Peggy Foster, and carried by the following vote:

SECOND READING OF POLICIES
The Governing Board agreed to review BP 4119.1/42119.1/4219.1/4319.2, Civil and Legal Rights, at
an upcoming meeting.
GENERAL CORRESPONDENCE
1. Legislation Update: No reports were presented at this time.
2.
Responses to community members: No reports were presented at this time.
3.
Student attendance was reported to be at 3,318 students as of February 19, 2014.
4.
A student study and reward trip schedule was reviewed.
REPORTS BY THE SUPERINTENDENT
Dr. Marshall presented information regarding the following:
 Black History Month Observations: Dr. Marshall acknowledged all the schools for having various
activities in recognition of Black History Month. Dr. Marshall attended the NAACP’s Black
History Celebration and he noted that his monthly District Monthly Message had been shared at
the meeting by the NAACP President. It was refreshing to note that the District’s stakeholders
share the District Monthly Message.
 Additional Resources: Dr. Marshall had the opportunity to participate in the Center for Alternative
Law and Mediation Meeting. He was asked to serve on their Board and to serve as their Chief
Financial Officer. The Center does mediations for corporations which is a resource for the
District.
 2013/2014- Initiatives Update: PBIS/SST Online/Project READ Implementation/Upcoming
Mathematics Curriculum Fair in Palmdale.
 Budget Road Show(s)/ LCAP-LCFF Meetings.

Dr. Marshall reported the African American Advisory Committee was scheduled to meet on March
4,2014 at2:30 p.m. and 5:30 p.m. The Committee had requested that more teachers would come
to the meetings.

Eastside Elementary Principal Posting/Selection Process.
Mrs. Jaggi complimented the community for having a record number of attendees at the EPAC
Meeting held on February 21. She said 250 people were in attendance for the meeting at
Columbia.

BOARD
1. Mrs. Foster said she had attended the EPAC Meeting at Columbia. She said the first and second
grades along with Diane Helble's SDC class presented a wonderful program.
2.
Ms. Thompson had the opportunity to visit Columbia, Eastside, and Cole earlier in the day.
Ms. Thompson toured Columbia Elementary with Ms. Ortega and Mr. Goines and was impressed
with the classrooms. She was pleased to see Cornell Notes being used by students in the third
grade classes. Ms. Thompson believes in exposing children to learning opportunities early on so
they are better prepared when they get to junior high, high school, and college. Ms. Thompson
liked that Columbia Elementary has an active conflict resolution component in place. Restorative
justice is being used by the Admin staff when dealing with minors who engage in f,rghting type
behaviors. The staff shared that any minor that is involved in any type of physical altercation
actually has to go through a conflict resolution meeting with Ms. Vy'ise, Counselor at Cole Middle
School. Ms. Thompson was happy to see that the two schools were collaborating to assist the kids
in developing skills that would aid them in dealing with conflict. Students were definitely using
IPads to do testing in classrooms as well as research.
Ms. Thompson had the opportunity to tour Eastside Elementary with Principal Deal. She was able
to visit with Mrs. Little who had been her son's teacher in kindergarten. Ms. Thompson saw many
positive things going on at Eastside. She would like to see Eastside Elementary get an Air Printer
for the IPads. Ms. Thompson said her visit to Cole Middle School was good as it had been during
her last visit. Ms. Thompson said she was pleased to be a member of such a great team of
professionals. Ms. Thompson's goal is to stick to her campaign platform to be fair, firm,
consistent, and to make this a more harmonious environment for all parties so we can get some
more learning, teaching, and educating done. Ms. Thompson said she appreciated everyone and
hoped we can continue to work together wonderfully as a collaborative team.
3.
Mrs. Johnson thanked the schools for the invitations to read at their sites for Read Across America.
Mrs. Johnson really enjoys participating and it also gives her a chance to check on more things.
