MEMBERS PRESENT: Geoff Neyman, Don Wilkerson and Robb Menlove. MEMBERS ABSENT: Michelle Barron and Cortney Dennis. OTHERS PRESENT: Planning Director – Jennifer Kharrl. 7:00 P.M. 1. CALL TO ORDER: Vice Chairman Menlove opened the public meeting at 7:04 p.m. and welcomed everyone. 2. ROLL CALL: Geoff Neyman - present, Robb Menlove – present, Don Wilkerson - present. 3. REVIEW AGENDA: Commissioner Neyman made a motion to accept the agenda as written. Commissioner Wilkerson seconded the motion. Vote: Unanimous. 4. APPROVAL OF MINUTES – May 9, 2016, June 21, 2016 and July 11, 2016: Minutes were not available. PUBLIC HEARING 1. A Special Use Permit Amendment by Dr. Andy Sapp for Cherry Gulch Boys Ranch to increase the maximum number of boys permanently allowed at the facility. The current Special Use Permit was approved for a maximum of 47 boys. The amendment requests up to 50 boys. Located at 3770 E Black Canyon Highway. He stated the reason he is there is to ask for an increase in student census from 47 to 50. They have the room and facilities to accommodate 50 students at this time. The Commission reviewed and discussed the letter from Southwest District Health and the existing septic system. Commissioner Neyman made a motion to approve the amendment to Special Use Permit #465. Commissioner Wilkerson seconded the motion. Vote: Unanimous. 2. A Special Use Permit (SUP #16-002) request by Jerry Olson, to allow a commercial kennel to train a maximum of 12 dogs at one time. Located 1024 Plaza Road. T 06N, R 01W, Section 3: Applicant/representative testimony: Jerry Olson – 1024 Plaza Road. He stated that he and his son train Labradors and the training turned into a larger project than what they thought it would be. They have the maximum number allowed by code right now and the dogs are housed in an indoor kennel with its own septic system. The dogs don’t bark, most of the neighbors didn’t even realize they had dogs. If approved, a larger shop will be built to house the dogs. Public testimony: In Favor: None. Neutral: None. The Commission reviewed and discussed the number of dogs, the septic system and the training procedures. Commissioner Wilkerson made a motion to approve Special Use Permit #16-002 as it meets the standards as outlined in Chapter 7; Section 7-3 of the Gem County Zoning Ordinance with the site specific conditions of approval recommended in the staff report. Commissioner Neyman seconded the motion. Vote: Unanimous. 3. A Rezone (REZ #16-002) request by David and Kelsey Little, on property owned by Little Enterprises, LLLP, to rezone that portion of the NW ¼ of the SW ¼ lying within the Area of City Impact from A-1 Prime Agriculture (a 40 acre minimum lot size) to A-2 Rural Transitional Agriculture (a 5 acre minimum lot size). Located on Sand Hollow Road. T 06N, R 01W, Section 15: Applicant/representative testimony: David Little – 319 Maple Street. He stated that they want to build a house near the current agricultural operation. Currently it is zoned A-1 with a 40 acre minimum and they are requesting a rezone to A2 with a 5 acre minimum lot size. The parcel is 143 acres but they are only asking to rezone the portion that falls within the Area of City Impact which is allowed by the Comprehensive Plan. After being surveyed that area is approximately 25 acres. Public testimony: In Favor: None. Neutral: None. In Opposition: None. Vice Chairman Menlove closed the public hearing. Commission Discussion. The Commission reviewed and discussed the Area of City Impact and the intent of the application. Commissioner Wilkerson seconded the motion. Vote: Unanimous. REGULAR MEETING 1. ITEMS FROM THE PUBLIC: None. 2. ITEMS FROM THE PLANNING DIRECTOR/ADMINISTRATOR: Planner Kharrl reminded the Commission about the Planning Commission meeting on Friday morning at 8:30 AM to discuss the A-1 zoned land. 3. ITEMS FROM/OR QUESTIONS FOR THE DEPUTY PROSECUTING ATTORNEY: No items. 4. ITEMS FROM THE ZONING COMMISSION: The Commission discussed site visits and the conduct of the meetings. 5.
