reports it to General Services Administration
(GSA) when there is no need for the property
within their agency.

!! The CFL website enables schools
& educational nonprofit
organizations to view computers
& peripheral equipment reported

!! Final eligibility determinations of
the potential recipient &
allocation of the property are
done by the federal agency that
hold the excess equipment.

Excess Personal Property Phase
  Definition
  Any personal property under the control of any federal
agency that is no longer required for that agency’s
needs, as determined by the agency head or
designee.

Acquiring Excess Property
  Must …
  Be a “Federally” Recognized Tribe or Tribal
Organization
  And
  Have a 638 Contract with a Federal Agency
Sponsor, such as
– Bureau of Indian Affairs
– Indian Health Services
– U.S. Department of Agriculture
  Federal Agency Sponsor determines when/if
“title” passes

Golden Rules of Acquiring Excess Property
  There must be an authorized need for the
property.
  Property should not be stockpiled, but put into
use within a reasonable period of time.
  You must not acquire excess property with the
intent to sell or trade for other assets.

Do we pay for Excess Property?
  No, except for the situations listed below, you do not pay
for the property.
  You may be required to reimburse the holding agency
for excess property when:
–  Reimbursement is directed by GSA; Non-appropriated fund
property; Exchange Sale Property reimbursement required by the
owning agency; Acquiring property for use by project grantee
that is a public agency or a nonprofit organization and tax
exempt under 26 USC 501; Requesting or holding agency is DC
Government; Requesting or holding agency is wholly owned or
mixed-ownership Government corporation defined in
Government Corporation Control Act (31 USC 9101-9110)
  Acquiring agency is required to pay shipping &
transportation costs
  When applicable, acquiring agency may have to pay
packing, loading & dismantling costs

Process for Acquiring Surplus Property
  If seeking donations of surplus federal property
you should contact a State Agency for Surplus
Property (SASP) representative.

  These state-run organizations coordinate with
the federal program for the donation of federal
surplus property.

Process for Acquiring Surplus Property
  SASPs evaluate all organizations and determine
eligibility based on proof of eligibility through
proper documentation.
  SASP representatives will guide you through the
rest of the process.
  Note: Most SASPs operate on a self-sustaining
basis and may require recipients to pay a service
charge to cover handling, transportation, and
administrative expenses. These charges are
partly based on percentages of the value of the
property.

Sales Phase
  If no state or local government agency (or other
qualified recipient) expresses interest in the
personal property, the property becomes
available to the public for sale.
  GSA AuctionsSM is an electronic solution for
auctioning surplus, forfeited and exchange/sale
federal personal property. The auctions are
completely web-enabled, allowing all registered
participants to bid electronically on single or
multiple items (lots) within specified timeframes.
