Amendment #28 is a Type 3 Formal Amendment to the 2015 FTIP. Amendment #28 makes necessary funding changes to the existing projects and programs new projects as indicated in Attachment 1. The proposed project changes have been determined to be exempt from the requirement that a conformity determination and/or regional emissions analysis be performed per 40 CFR 93.126, 93.127, or 93.128. Because the projects are exempt, no further conformity determination is required. In addition, the projects and/or project phases contained in Amendment #28 do not interfere with the timely implementation of any approved Transportation Control Measures (TCMs). 2015 FTIP meets all applicable transportation planning requirements per 23 CFR Part 450 and 40 CFR Part 93. The projects included in this amendment are not in common with any other amendment currently open for public comment or being processed. A seven-day public review period for Amendment #28 commenced on August 18, 2016 and concluded on August 25, 2016. The public participation process for Amendment #28 to the 2015 FTIP is consistent with San Joaquin Council of Governments board adopted Public Participation Plan. On August 25, 2016 the San Joaquin Council of Governments Board of Directors approved Amendment #28 by resolution R-17-03. State and Federal approval is required for Amendment #28 to the 2015 FTIP. The FTIP is the four-year capital improvement program that provides any agency receiving the federal funding the authority to move forward to seek approval to expend the funds. If a project is not identified in the TIP, an amendment to the plan is needed. There are different “types” of amendments, depending on the change proposed. Amendment #28 is a Type 3 amendment which adds projects that are exempt from conformity into the FTIP. The amendment would modify eight listings and add one new listing, involving changes to the following programs: State Minor Program and State Highway Maintenance Program. Notations in CTIPS for the 2015 FTIP are added as follows: CTIPS ID 212-0000-0684: Grouped Projects for Safety Improvements – Minor Program: adds one project totaling $2,673,000 in Minor Program funds to grouped listing in FY 16/17. CTIPS ID 212-0000-0685: Grouped Projects for Resurface/Rehab on SHS – Highway Maintenance: adds two projects totaling $5,558,000 in Highway Maintance funds to grouped listing in FY 16/17. The details behind the amendment can be found at www.sjcog.org/index.aspx?nid=110 which was posted for the required seven day review period. The changes made by Amendment #28 do not interfere with the conformity analysis years as assumed for the regional emissions analysis of the currently conformed and amended 2015 RTP and 2015 FTIP. The cost changes for these projects do not interfere with the timely implementation of any approved Transportation Control Measures (TCMs). The 2015 FTIP as amended meets all the applicable transportation planning requirements per 23 Code of Federal Regulations (CFR) Part 450. RECOMMENDATION: SJCOG staff is recommending the SJCOG Board approve FTIP (Type 3) Amendment #28 to the 2015 FTIP and Adopt Resolution R-17-03. FISCAL IMPACT: Approval of the SJCOG staff recommendation would add one new project into the FTIP, and make adjustments to eight project listings. In total, these additions and adjustments amount to a total of increase of $8,231,000 over the four year FTIP period (FY 2014/15 – FY 17/18). BACKGROUND: The Federal Transportation Improvement Program (FTIP) is a financially constrained transportation programming document developed by SJCOG through its member agencies and in cooperation with State and Federal agencies and the eight San Joaquin Valley counties. The premise behind an FTIP is that it serves as the incremental implementation (four years) of the long-range Regional Transportation Plan (RTP). The FTIP also serves to present federal funding agencies with manageable components to fund the long-range plan. If any amendments made to the FTIP cause a change in the financial element, it is required that a revised financial plan be open to public comment. SJCOG is proposing a Type 3 amendment to the 2015 FTIP (FY 2014/15 – FY 17/18). This amendment consists of addition of projects exempt from Air Quality Conformity. PUBLIC INPUT: SJCOG posted the amendment documentation on the SJCOG website on August 18, 2016 at www.sjcog.org. Comments can be accepted on the FTIP Amendment #28 until noon on August 25, 2016. PROGRAM TOTAL Page 5 of 5 Attachment 4 RESOLUTION SAN JOAQUIN COUNCIL OF GOVERNMENTS R-17-03 RESOLUTION APPROVING(TYPE 3) AMENDMENT #28 TO THE 2015 FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM (FTIP) WHEREAS,the San Joaquin Council of Governments(SJCOG)is a Regional Transportation Planning Agency and a Metropolitan Planning Organization(MPO),pursuant to State and Federal designation; and WHEREAS,federal planning regulations require MPOs to prepare and adopt a long range Regional Transportation Plan(RTP)for their region; and WHEREAS,federal planning regulations require that MPOs prepare, adopt, and maintain a Federal Transportation Improvement Program(FTIP)for their region; and WHEREAS,the 2015 Federal Transportation Improvement Program Amendment #28(2015 FTIP Amendment #28)has been prepared to comply with Federal and State requirements for local projects and through a cooperative process between the Federal Highway Administration(FHWA), the Federal Transit Administration(FTA),the State Department of Transportation (Caltrans), principal elected officials of general purpose local governments and their staffs, and public owner operators of mass transportation services acting through the SJCOG forum and general public involvement; and WHEREAS,the 2015 FTIP(Type 3) Amendment #28 program listing is consistent with: 1)the 2014 Regional Transportation Plan; 2)the 2014 State Transportation Improvement Program; and 3)the Corresponding Conformity Analysis; and WHEREAS,the 2015 FTIP(Type 3) Amendment #28 contains the MPO's certification of the transportation planning process assuring that all federal requirements have been fulfilled; and WHEREAS,the 2015 FTIP(Type 3) Amendment #28 meets all applicable transportation planning requirements per 23 CFR Part 450. WHEREAS, projects submitted in the 2015 FTIP(Type 3) Amendment #28 must be financially constrained and the financial plan affirms that funding is available; and WHEREAS,the 2015 FTIP(Type 3) Amendment #28 is consistent with the adopted Confornuty Analysis for the 2015 FTIP and the 2015 RTP; and Page 2 of2 R-17-03 WHEREAS,the 2015 FTIP(Type 3)Amendment#28 does not interfere with the timely implementation of the Transportation Control Measures; and WHEREAS,the 2015 FTIP(Type 3)Amendment#28 conforms to the applicable SIPs; and WI~REAS,a 7-day public review process occurred from August 18,2016 to August 25, 2016 consistent with the SJCOG adopted Public Participation Plan.
