Company Sending Employees to Station in HK and Create a HK Presence

 MCL Acting as HK Administrator Providing Full Support, Without Their Having to Set Up Office of Their Own
The Company is in manufacture and rental of engineering machineries, and technical support is provided by their engineers
working at the sites of clients’ projects. In the case of HK, the Company had relied on their clients to act as sponsors for their
engineers’ HK Employment Visas, but such an arrangement restricted their assigning engineers to projects of other clients.
In 2011, they decided that they needed to take tighter control of their own business, as well as to establish a HK
Presence for more business opportunities.
2011 Sep
On a Saturday afternoon when 99.99% of HK office workers were off duty, we received an enquiry from a lawyer in Europe
who found us through internet looking for a service provider for HK company and HK visa for his client. Knowing this was a
genuine enquiry, we replied immediately and he was amazed with our fast and clear response to his urgent enquiry.
2011 Oct
We received a sudden call from Mr A saying that his lawyer referred him to contact us and would like to meet us the
following day. The following day happened to be a public holiday, and he was pleased that we had no hesitation to
accommodate his itinerary in such short notice. In the meeting, he confirmed our services and signed the documents.
Few days later, ‘Co A’, a HK Company Limited by Shares held by Mr A’s company was duly incorporated, and we were
retained to provide HK Company Secretary and Registered Office, and Maildrop for their non-statutory mailings.
2011 Nov
Mr A made another trip for Opening Corporate Bank Account in HK, and we liaised with the bank and prepared all
the documents we could well in advance.
Upon Mr A’s arrival, we picked him up from his hotel and assisted in speeding up the bank’s due diligence process. In
less than an hour, the bank account was established with internet device, PIN etc all available. Mr A was again impressed
that we did all we could to save his time, and very pleased that he could catch an evening flight home that same day.
2011 Dec
We were gradually introduced to Mr A’s colleagues in Europe, all of whom we work closely with since.
2012 Jan
Mr A’s 1st move was to take back the control of the HK visa matters from their clients by employing our HK
Employment Visa Application service, which some of the cases included their employees’ spouses and other
dependants. For expatriates already under the sponsor of their HK clients, we handled their Change of Employment
and Visa Extension. We are proud of our very high success rates even in very difficult and challenging cases.
The expatriates are from different parts of the world holding different passports. While they remain employed by Mr A’s
overseas company, Co A acted as the HK sponsor. We were since appointed HK Administrator giving advice and
providing periodic reports on their HK affairs. We also attended to all the expatriates’ HK needs, such as –
- Personal Needs : HK Identity Card, Work Permits, HK Driving Licence, Passport Renewal, Personal Bank Account……
- Housing Needs : Dealing with property agencies, landlords, contractors; Paying rentals, mobile, utility bills……
We also helped them and their family members to know and adapt to HK’s environment, provided Recruitment
Services to their spouses to find suitable jobs; assisted with finding housemaids, assisted with their children’s
schooling; and even helped with their household chores when in need……
2012 Feb
Mr A’s 2nd move was to use Co A for HK business. We assisted in analyzing the tax benefits of using HK Co A for
his HK projects as opposed to using his overseas company.
Mr A’s 3rd move was for Co A to recruit engineers in HK and from other Asian countries to create a more concrete
HK base. We then started to deal with the Employment Agreement, Mandatory Provident Fund (MPF), Employees’
Compensation Insurance, Medical Benefits, Payroll Administration, Bookkeeping……
2012 Apr
We started to handle their Employer’s Return and Individual Tax Returns of their employees, including advising on
entitlement to tax allowances, and tax exemptions provided by Double Tax Agreements.
2013 Apr
We started to provide our Accountancy services (preparation of financial statements ready for auditing) to Co A including
liaising with their Financial Controller to cater for the parent company’s consolidated accounts. We also arranged for
them Audited Report issued by HK Certified Public Accountant; and we acted as their Tax Representative in preparing
the Profits Tax Computation, Profits Tax Return and dealing with the HK Inland Revenue Department.

