Determination 15 of 2008 - Sentence

The Tribunal has included the position as part ofthe annual review of part-time holders of
public office.

The Tribunal determined that remuneration should be increased by 4.2% (rounded upwards to
the nearest $5) for the members of the Sentence Administration Board, with effect on and from
1 November 2008.

1.2
The Deputy Chair of the Sentence Administration Board shall be entitled to the
annual rate of$26,010 per annum.
1.3
A Member of the Sentence Administration Board shall be entitled to a per diem rate
of$600.
1.4
The per diem rate of remuneration for Members of the Sentence Administration
Board incorporates two (2) hours of preparation time for Sentence Administration
Board meetings.
2.
Conditions of Per Diem Payments
2.1
In this clause: (a) a reference to "business of the authority" means any business of the Sentence
Administration Board conducted by a member of the Board with the approval of
the Board, other than attendance at a Board meeting; and
(b) the day and part day rate for Sentence Administration Board meetings includes
an expected two (2) hours preparation time for each meeting.
2.2
A Member of the Sentence Administration Board shall be paid a per diem rate in
respect of such period, not less than three hours, on any one day on which he or she
attends a meeting of the Board, and/or is engaged on business of the authority,
subject to the following conditions:(a) the chairperson or nominated presiding officer, shall in each case certify
whether the period of three hours has elapsed and in so certifying may have
regard to reasonable travelling time incurred by an office holder; and

A Member of the Sentence Administration Board may also be paid a per diem rate
in respect of aggregates of periods of business of the authority of less than three
hours undertaken on behalf of the Board, subject to the following conditions:(a) individual periods of business must be on other than Board meeting days and
each period must be for a minimum of one hour;
(b) the maximum period in respect of any one day shall be the appropriate per diem
rate;
(c) eligibility for each payment shall be ce1iified by the chairperson, and in so
certifying the chairperson may have regard to reasonable travelling time in
accordance with clause 2.2; and
(d) no additional payments or consideration is to be made for meeting preparation
time.
3.
Salary Packaging
3.1
Subject to the following conditions, the Chair, Deputy Chair and Members of the
Sentence Administration Board may elect to take remuneration as salary or take a
combination of salary and other benefits best suited to his or her personal needs and
preferences.
3.2
The scheme is to be consistent with taxation laws and guidelines applicable to
salary packaging schemes, issued by the Australian Taxation Office.
