regarding the Barnett property it states as the last sentence in that paragraph as follows:
"A pair of black-capped vireos was detected on the north side of the property on 9 June."
Ms. Groce further stated: "We are interested in returning to the property in 2010 for
additional vireo surveys. Given that the black-capped vireos were detected on one end of
the Barnett Property,, we,are also interested in attempting to access adjacent properties in
2010 to determine if this vireo pair is an isolated pair or if additional vireos are located
nearby." Because of the fact that a pair of Black-capped vireos has been confirmed on the
Del Barnett Tract No. 378 in Link S1 and because Link Si is a part of each of the
Alternate Routes 82, 101, 247, 249 or 250, none of those routes should be considered as
the route for the Brown-Newton Proposed Transmission Line Project.

On pages 22,128, 131, 333 and 336 of the Application there is mention of the Heart of
Texas - East Wildlife Trail (HOTE) as designated by the Texas Parks and Wildlife
Department. Links S1 and P, each of which Links are a part of each of the Alternate
Routes 82, 101, 247, 249 or 250, follow most all of that part of the Heart of Texas - East
Wildlife Trail (HOTE) as designated by the Texas Parks and Wildlife Department which
follows FM 574 W for 11.1 miles west from Goldthwaite. On page 336 of the
Application it states: "...... and Links P and S i parallel the FM 574 trail segment. As a
result, aesthetic impact to recreation users of the HOTE Wildlife Trail would be
anticipated at these segment locations." In an Information Review Request regarding the
Brown-Newton Transmission Line Project dated July 28, 2009 and prepared by Dr. Karen
H. Clary, Ph.D., Wildlife Habitat Assessment Program, Wildlife Division, Texas Parks
and Wildlife Department (TPWD), for Mr. and Mrs. Tom Duren, the owners of Tract
Number 390, as shown on page 1600 of the Application, in Link Si, described on page
1650 of the Application, Dr. Clary stated in regard to The Heart of Texas Wildlife Trail
East: "TPWD recommends avoiding placement of transmission lines in areas that are
valued for their visual and cultural aesthetics. This includes routes designated as TPWD
wildlife trails and viewing areas. Scenic landscape views and appreciation of the natural
beauty along these trails are a major component of the trail itself, its use and enjoyment
by the public. Placement of transmission lines in such areas would be considered an
adverse effect." Because the HOTE is located on Links Si and P and because those links
are each a part of the Alternate Routes 82, 101, 247, 249 or 250, none of those routes
should be considered as the route for the Brown-Newton Proposed Transmission Line
Project. In the opinion of the undersigned, placement of the Oncor transmission lines
along FM 574 W (Segments Si and P) would be an "eye sore" to this beautiful trail as
"designated by the Texas Parks and Wildlife doartment.

Our group of property owners is reacting to Oncor CCN application and filing of a
preferred route to cross San Saba County to connect Brown and Newton Switching
Stations.
We property owners realize that the PUC tasked Oncor with finding an appropriate
transmission line route from Brown to Newton. We would like to point out that
reasonable straight-line segments between the two terminals do not cross the scenic and
wild Colorado River which bounds our county north and east. Furthermore, crossing the
River into San Saba County merely obliges Oncor to plan a second needless river
crossing, causing blights on the viewscape of the scenic wild river and adversely
affecting the ecology at the river crossings and of the countryside in-between.
We strongly believe that the better choice is for Oncor to utilize the existing highways
and utility corridors north of the Colorado River instead of creating new environmental
blights through green space areas of our State.
We conclude that a greater public good, on all counts, for the people of TEXAS and the
scenic and wild Colorado River is accomplished by choosing a relatively straight-line
path from Brown to Newton following the Hwyl83 corridor.
Already the LCRA, in a related CREZ project, has listened to the public and asked for
additional time to study an expanded area and achieve substantially the same goals, i.e.,
use existing corridors instead of pristine countryside to route new transmission lines.
Oncor has not been similarly sensitive in its study.
We urge the PUC to choose relative straight-line path segments from Brown to Newton,
not crossing the wild and scenic Colorado River.

As a Protestor in connection with Docket No. 37464 the undersigned owns property located on
Link P or Link S 1 of ONCOR's Brown to Newton 345 kV Transmission Line Project and the
property I/we own either has a habitable structure located near ONCOR's Brown-Newton
Alternative Routes 82, 101, 247, 249 and 250 and /or those same Alternative Routes 82,101,
247, 249 and 250 would cross property owned by the undersigned. In that regard the undersigned
respectfully requests that the Public Utility Commission of Texas ("Commission") select
ONCOR's Preferred Route 255 as the route for the Brown-Newton Proposed Transmission Line
Project, and that Alternate Routes 82, 101, 247, 249 or 250 not be selected as the route for the
Brown-Newton Proposed Transmission Line Project, for the following reasons:
As set forth on pages 1571, 1572, 1574, 1575, 1580 and 1581 of ONCOR's Application for

a Certificate of Convenience and Necessity for a Proposed Transmission Line filed in connection
with Docket Number 37464 on October 7, 2009, there are 84 habitable structures within 500 feet
of Preferred Route 255, as opposed to 89 habitable structures within 500 feet of Alternate Route
82, 97 habitable structures within 500 feet of Alternate Route 101, 74 habitable structures within
500 feet of Alternate Route 247, 91 habitable structures within 500 feet of Alternate Route 249
and 97 habitable structures within 500 feet of Alternate Route 250, and thus Preferred Route 255
has less habitable structures within 500 feet than do Alternate Routes 82, 101, 249 and 250.
Alternate Route 247 does have 10 fewer habitable structures within 500 feet of that route but
Alternate Route 247 is 3.88 miles longer and the estimated cost of Alternate Route 247 is
$24,136,000.00 greater that Route Number 255.
2. As further set forth on pages 1571, 1572, 1574, 1575, 1580 and 1581 of ONCOR's
Application for a Certificate of Convenience and Necessity for a Proposed Transmission Line
filed in connection with Docket Number 37464 on October 7, 2009, the total length of Preferred
Route 255 is 91.88 miles as opposed the total length of Alternate Route 82 being 93.69 miles,
Alternate Route 101 being 92.36 miles, Alternate Route Number 247 being 95.77 miles,
Alternate Route 249 being 93.96 miles and Alternate Route 250 being 91.94 miles and thus
Preferred Route 255 is shorter, and therefore affects less area of private property, than do
Alternate Routes 82,101, 247, 249 or 250.
3. As set forth on pages 1591 through 1596 of ONCOR's Application for a Certificate of
Convenience and Necessity for a Proposed Transmission Line filed in connection with Docket
Number 37464 on October 7, 2009, the total estimated cost of the Preferred Route 255 is
$129,855,000., as opposed to total estimated cost for Alternate Route 82 of $142,050,000., total
estimated cost for Alternate Route 101 of $139,349,000., total estimated cost for Alternate Route

247 of $144,497,000., total estimated cost for Alternate Route 249 of $140,575,000., and total
estimated cost for Alternate Route 250 of $135,623,000. The total estimated cost for Preferred
Route 255 is, therefore, $12,195,000. less than Alternate Route 82, $9,494,000. less than
Alternate Route 101, $24,136,000. less than Alternate Route 247, $10,720,000. less than
Alternate Route 249 and $5,768,000. less Alternate Route 250. This results in a savings, if
Preferred Route 255 is chosen, of not less that $5,768,000. and as much as $24,136,000. which
will ultimately be enjoyed by Texas electric consumers if Preferred Route 255 is chosen.
4. As further set forth on pages 1571, 1572, 1574,1575, 1580 and 1581 of ONCOR's
Application for a Certificate of Convenience and Necessity for a Proposed Transmission Line
filed in connection with Docket Number 37464 on October 7, 2009, only approximately 8.97
miles of the length of Preferred Route 255 is within the foreground visual zone of state and U. S.
Highways, whereas approximately 10.74 miles of the length of Alternate Route 82 is within the
foreground visual zone of state and U. S. Highways, approximately 21.32 miles of the length of
Alternate Route 101 is within the foreground visual zone of state and U. S. Highways,
approximately 12.87 miles of the length of Alternate Route 247 is within the foreground visual
zone of state and U. S. Highways, approximately 26.90 miles of the length of Alternate Route
249 is within the foreground visual zone of state and U. S. Highways and approximately 22.75
miles of the length of Alternate Route 250 is within the foreground visual zone of state and U. S.
Highways. The result being that Preferred Route 255 has less length within the foreground visual
zone of state and U. S. Highways than do Alternate Routes 82, 101, 247, 249 or 250.
As further reasons not to chose Alternate Routes 82, 101, 247, 249 or 250 as the route for
the Brown-Newton Proposed Transmission Line Project please be further advised as follows:
1.
On pages 110, 119,120, 327, 330, 470 and 1571 of ONCOR's Application for a
Certificate of Convenience and Necessity for a Proposed Transmission Line filed in
connection with Docket Number 37464 on October 7, 2009 ("Application"), there is
repeated mention of the Black-Capped Vireo (Vireo atricapillus), a bird which was
placed upon the endangered species list of the U.S. Fish and Wildlife Service in 1987 and
remains there today. In ONCOR's Application there is no admission that the BlackCapped Vireo is in fact present in the study area only that there is "Potential for
Occurrence in the Study Area" (Application - page 119) and "All of the alternative routes
cross areas ofpotential Golden-cheeked warbler ("GCW") and Black-capped vireo
("BCW") endangered species habitat." (Application - page 1571). As confirmation that
the Black-capped Vireo is in fact present in Segment Si of the Oncor proposed route for
the Brown-Newton 345 kV Transmission Line Project, Mr. Del Barnett, the owner of
Tract Number 378, as shown on page 1597 of the Application, which Tract Number 378
is Located in Link Si, described on page 1650 of the Application, has received a report
dated July, 2009 styled "Determining the distribution and abundance of black-capped
vireos in Texas" prepared by Julie E. Groce, Research Associate, Institute of Renewable
Natural Resources, Texas A & M University, College Station, Texas, which under the
Results paragraph at the bottom of page 2 and the top of page 3 of the Julie Groce report

nearby." Because of the fact that a pair of Black-capped vireos has been confirmed on the
Del Barnett Tract No. 378 in Link S1 and because Link Si is a part of each of the
Alternate Routes 82, 101, 247, 249 or 250, none of those routes should be considered as
the route for the Brown-Newton Proposed Transmission Line Project.

On pages 22, 128, 131, 333 and 336 of the Application there is mention of the Heart of
Texas - East Wildlife Trail (HOTE) as designated by the Texas Parks and Wildlife
Department. Links S 1 and P, each of which Links are a part of each of the Alternate
Routes 82, 101, 247, 249 or 250, follow most all of that part of the Heart of Texas - East
Wildlife Trail (HOTE) as designated by the Texas Parks and Wildlife Department which
follows FM 574 W for 11.1 miles west from Goldthwaite. On page 336 of the
Application it states: "...... and Links P and Si parallel the FM 574 trail segment. As a
result, aesthetic impact to recreation users of the HOTE Wildlife Trail would be
anticipated at these segment locations." In an Information Review Request regarding the
Brown-Newton Transmission Line Project dated July 28, 2009 and prepared by Dr. Karen
H. Clary, Ph.D., Wildlife Habitat Assessment Program, Wildlife Division, Texas Parks
and Wildlife Department (TPWD), for Mr. and Mrs. Tom Duren, the owners of Tract
Number 390, as shown on page 1600 of the Application, in Link Si, described on page
1650 of the Application, Dr. Clary stated in regard to The Heart of Texas Wildlife Trail
East: "TPWD recommends avoiding placement of transmission lines in areas that are
valued for their visual and cultural aesthetics. This includes routes designated as TPWD
wildlife trails and viewing areas. Scenic landscape views and appreciation of the natural
beauty along these trails are a major component of the trail itself, its use and enjoyment
by the public. Placement of transmission lines in such areas would be considered an
adverse effect." Because the HOTE is located on Links S 1 and P and because those links
are each a part of the Alternate Routes 82, 101, 247, 249 or 250, none of those routes
should be considered as the route for the Brown-Newton Proposed Transmission Line
Project. In the opinion of the undersigned, placement of the Oncor transmission lines
along FM 574 W (Segments Si and P) would be an "eye sore" to this beautiful trail as
designated by the Texas Parks and Wildlife department.

As a Protestor in connection with Docket No. 37464 the undersigned owns property located on
Link P or Link S1 of ONCOR's Brown to Newton 345 kV Transmission Line Project and the
property Uwe own either has a habitable structure located near ONCOR's Brown-Newton
Alternative Routes 82, 101, 247, 249 and 250 and /or those same Alternative Routes 82, 101,
247, 249 and 250 would cross property owned by the undersigned. In that regard the undersigned
respectfully requests that the Public Utility Commission of Texas ("Commission") select
ONCOR's Preferred Route 255 as the route for the Brown-Newton Proposed Transmission Line
Project, and that Alternate Routes 82, 101, 247, 249 or 250 not be selected as the route for the
Brown-Newton Proposed Transmission Line Project, for the following reasons:
1.
As set forth on pages 1571, 1572, 1574, 1575, 1580 and 1581 of ONCOR's Application for
a Certificate of Convenience and Necessity for a Proposed Transmission Line filed in connection
with Docket Number 37464 on October 7, 2009, there are 84 habitable structures within 500 feet
of Preferred Route 255, as opposed to 89 habitable structures within 500 feet of Alternate Route
82, 97 habitable structures within 500 feet of Alternate Route 101, 74 habitable structures within
500 feet of Alternate Route 247, 91 habitable structures within 500 feet of Alternate Route 249
and 97 habitable structures within 500 feet of Alternate Route 250, and thus Preferred Route 255
has less habitable structures within 500 feet than do Alternate Routes 82, 101, 249 and 250.
Alternate Route 247 does have 10 fewer habitable structures within 500 feet of that route but
Alternate Route 247 is 3.88 miles longer and the estimated cost of Alternate Route 247 is
$24,136,000.00 greater that Route Number 255.
2. As further set forth on pages 1571, 1572, 1574, 1575, 1580 and 1581 of ONCOR's
Application for a Certificate of Convenience and Necessity for a Proposed Transmission Line
filed in connection with Docket Number 37464 on October 7, 2009, the total length of Preferred
Route 255 is 91.88 miles as opposed the total length of Alternate Route 82 being 93.69 miles,
Alternate Route 101 being 92.36 miles, Alternate Route Number 247 being 95.77 miles,
Alternate Route 249 being 93.96 miles and Alternate Route 250 being 91.94 miles and thus
Preferred Route 255 is shorter, and therefore affects less area of private property, than do
Alternate Routes 82,101, 247, 249 or 250.
3. As set forth on pages 1591 through 1596 of ONCOR's Application for a Certificate of
Convenience and Necessity for a Proposed Transmission Line filed in connection with Docket
Number 37464 on October 7, 2009, the total estimated cost of the Preferred Route 255 is
$129,855,000., as opposed to total estimated cost for Alternate Route 82 of $142,050,000., total
estimated cost for Alternate Route 101 of $139,349,000., total estimated cost for Alternate Route

247 of $144,497,000., total estimated cost for Alternate Route 249 of $140,575,000., and total
estimated cost for Alternate Route 250 of $135,623,000. The total estimated cost for Preferred
Route 255 is, therefore, $12,195,000. less than Alternate Route 82, $9,494,000. less than
Alternate Route 101, $24,136,000. less than Alternate Route 247, $10,720,000. less than
Alternate Route 249 and $5,768,000. less Alternate Route 250. This results in a savings, if
Preferred Route 255 is chosen, of not less that $5,768,000. and as much as $24,136,000. which
will ultimately be enjoyed by Texas electric consumers if Preferred Route 255 is chosen.
4. As further set forth on pages 1571, 1572, 1574, 1575, 1580 and 1581 of ONCOR's
Application for a Certificate of Convenience and Necessity for a Proposed Transmission Line
filed in connection with Docket Number 37464 on October 7, 2009, only approximately 8.97
miles of the length of Preferred Route 255 is within the foreground visual zone of state and U. S.
Highways, whereas approximately 10.74 miles of the length of Alternate Route 82 is within the
foreground visual zone of state and U. S. Highways, approximately 21.32 miles of the length of
Alternate Route 101 is within the foreground visual zone of state and U. S. Highways,
approximately 12.87 miles of the length of Alternate Route 247 is within the foreground visual
zone of state and U. S. Highways, approximately 26.90 miles of the length of Alternate Route
249 is within the foreground visual zone of state and U. S. Highways and approximately 22.75
miles of the length of Alternate Route 250 is within the foreground visual zone of state and U. S.
Highways. The result being that Preferred Route 255 has less length within the foreground visual
zone of state and U. S. Highways than do Alternate Routes 82, 101, 247, 249 or 250.
As further reasons not to chose Alternate Routes 82, 101, 247, 249 or 250 as the route for
the Brown-Newton Proposed Transmission Line Project please be further advised as follows:

On pages 110, 119,120, 327, 330, 470 and 1571 of ONCOR's Application for a
Certificate of Convenience and Necessity for a Proposed Transmission Line filed in
connection with Docket Number 37464 on October 7, 2009 ("Application"), there is
repeated mention of the Black-Capped Vireo (Vireo atricapillus), a bird which was
placed upon the endangered species list of the U.S. Fish and Wildlife Service in 1987 and
remains there today. In ONCOR's Application there is no admission that the BlackCapped Vireo is in fact present in the study area only that there is "Potential for
Occurrence in the Study Area" (Application - page 119) and "All of the alternative routes
cross areas of potential Golden-cheeked warbler ("GCW") and Black-capped vireo
("BCW") endangered species habitat." (Application - page 1571). As confirmation that
the Black-capped Vireo is in fact present in Segment S 1 of the Oncor proposed route for
the Brown-Newton 345 kV Transmission Line Project, Mr. Del Barnett, the owner of
Tract Number 378, as shown on page 1597 of the Application, which Tract Number 378
is Located in Link S1, described on page 1650 of the Application, has received a report
dated July, 2009 styled "Determining the distribution and abundance of black-capped
vireos in Texas" prepared by Julie E. Groce, Research Associate, Institute of Renewable
Natural Resources, Texas A & M University, College Station, Texas, which under the
Results paragraph at the bottom of page 2 and the top of page 3 of the Julie Groce report

regarding the Barnett property it states as the last sentence in that paragraph as follows:
"A pair of black-capped vireos was detected on the north side of the property on 9 June."
Ms. Groce further stated: "We are interested in returning to the property in 2010 for
additional vireo surveys. Given that the black-capped vireos were detected on one end of
the Barnett Property, we are also interested in attempting to access adjacent properties in
2010 to determine if this vireo pair is an isolated pair or if additional vireos are located
nearby." Because of the fact that a pair of Black-capped vireos has been confirmed on the
Del Barnett Tract No. 378 in Link S1 and because Link S1 is a part of each of the
Alternate Routes 82, 101, 247, 249 or 250, none of those routes should be considered as
the route for the Brown-Newton Proposed Transmission Line Project.
