BUSINESS NAME: ____________________________________________________________________________ CITY OF LEDUC Accessory Use - Home Occupation Conditions of Approval Small businesses run from a home may be one of two types – home office or home occupation. These are defined and regulated in the City’s Land Use Bylaw according to Section 21.6, or as outlined in the following information. HOME OFFICE - means a secondary use located within a dwelling for the purpose of a business which: (a) (b) (c) (d) (e) does not require business associated visits; does not require any non-resident persons employed within the dwelling; is not detectable from outside the dwelling; does not extend the business activity to the garage or outside yard; and does not have a business-related vehicle. A Home Office requires: a) A Business Licence, operated in accordance with the City’s Business Licence Bylaw and renewed annually ----------------------------------------------------------------------------------------------------------------------------------------------------- HOME OCCUPATION - means a secondary use to the residential use of a dwelling for the purpose of a business which: a) b) c) d) e) f) g) may have business associated visits to the residence to a maximum of fifteen (15) per week; may have one non-resident person employed in the dwelling; is not detectable from outside the dwelling; may have some business activities extend to the garage and/or an accessory development; may have some storage related to the business located inside the dwelling, garage and/or an accessory development; may have a commercial vehicle; and does not use any outside yard for storage or any type of business activity. A Home Occupation shall: a) not permit more than six students or customers to be in attendance at any one time for businesses performing a service to the community or instruction of arts or crafts; b) not have more than one business-related vehicle parked on the property at any one time; and c) not allow any utility trailer parked on the property in association with the Home Occupation to exceed 6.0 m in length. A Home Occupation requires: a) A Development Permit, as approved by the Development Authority for a use accessory to the principal dwelling and renewed annually; and b) A Business Licence, operated in accordance with the City’s Business Licence Bylaw and renewed annually. ----------------------------------------------------------------------------------------------------------------------------------------------------- 2 In addition to the above sections, the following regulations shall apply to both Home Office and Home Occupation: a) no exterior sign or advertisement shall be displayed; b) a sign displayed from inside the building is permitted to a maximum size of 46 cm x 13 cm; c) there shall be no outside business activity, or storage of material, equipment or products on the lot; d) no commodity other than the product or service of the home occupation or home office shall be sold on the premises; e) pollution control is as established under Section 20.11 of the Land Use Bylaw; f) parking and pedestrian or vehicular traffic, in the opinion of the Development Officer, shall be characteristic of the District in which the business is located; g) the business shall not be a cause of inconvenience to adjacent landowners or tenants; h) there shall be no major alterations to the dwelling or any accessory development. Minor alterations may be permitted at the discretion of the Development Authority; i) there shall be absolutely no maintenance or repair to vehicles or equipment at the residence; and j) the storage of dangerous or hazardous goods or materials for the business shall be at the discretion of the Development Authority. NOTE: A Home Occupation permit may be cancelled by the Development Authority on 30 days notice where the regulations of the Land Use Bylaw or the permit conditions have not been met. A permit will be assessed annually at the time of re-issuance of the business licence and a decision made regarding re-issue of the permit.
