RIC Office Use Only ID No. Date received Research, Innovation & Commercialisation Invention Disclosure Form Overview An Invention Disclosure is a description of your invention or development that is provided to the University. You are encouraged to submit an Invention Disclosure whenever you feel you have discovered something unique and for all developments that you feel may solve a significant problem and have commercial value. This should be done well before presenting the discovery through publications, poster sessions, conferences, press releases, or other communications. Once publicly disclosed (i.e. published or presented in some form to non-­‐University listeners), an invention may have restricted or minimal potential for patent protection. When you disclose your invention to the University, it starts a process that could lead to the commercialisation of your technology. It is essential that all researchers seek advice from and discuss their invention or research development with the Research Innovation & Commercialisation Business Development representative for their Faculty before submitting any Invention Disclosure. University Intellectual Property Statute and Intellectual Property Principles The University of Melbourne Act 2009 is enacted by the Victorian state parliament and under section 28 of the Act the University Council has powers to make University statutes and regulations. Intellectual Property is noted in Section 29h as a subject for a university statute. The current Statute 14.1 -­‐ Intellectual Property and associated Intellectual property principles “specify the manner in which intellectual property lawfully able to be regulated by the University is to be developed, protected, managed and commercialised”. The current policy has been in force since 11/12/2006. Important information in respect of disclosure of inventions: •

All staff, honorary appointees, visitors and student creators of Intellectual Property have a duty to disclose inventions
with potential commercial value, or where required by a third party agreement (Statute 14.1.7(2)).
Where intellectual property of potential commercial value is so disclosed, the University will diligently consider whether
to protect that intellectual property and keep the creator informed of the action which it is taking (clause 14.2 of these
principles)
Where the relevant invention is of a patentable nature, subject to full details having been provided as part of the
disclosure, the University will have 30 days in which to decide whether it wishes to file an application for the grant of a
provisional patent (clause 14.4 of the principles).

The form also serves to establish a legal record of the date of conception of the invention. An Invention Disclosure remains a confidential document, and should fully document your invention so that the options for commercialisation can be properly evaluated and pursued. Submission of an Invention Disclosure starts the formal technology commercialisation process. Before submitting the Invention Disclosure to the University you should: a) Discuss your invention with your Business Development representative; b) Confirm that all co-­‐inventors/contributors have been made aware of and agree with the contents of the submission; and c) Ensure best efforts are made not to publically disclose the inventor and related research to any external parties (this includes submission of conferences abstracts and presentation or publication of the research through any forum). The technology assessment is the period in which the TLS reviews the Invention Disclosure (with your input), conducts patent searches (if applicable), and analyses the market and competitive technologies to determine the invention's commercialisation potential. The assessment process will guide the University’s strategy on whether to focus on licensing to an existing company or creating a new business start-­‐up. Please read the embedded guidance notes when completing this invention disclosure form.
