Following the event, immediately after receiving
clearance from the security forces, staff members
of the Tax Authority Compensation Fund (Property
Taxation) arrive at the site of the attack, accompanied
by appraisers and engineers.
The teams screen the damaged apartments/
businesses/offices, explain their rights to injured
parties and guide them with regard to the claim
forms.
Damage to Buildings
The State assumes responsibility to compensate you, by
law, for damages caused to buildings as a result of war
operations. This is aimed at restoring the situation to its
former state as quickly as possible.
The staff of the Compensation Fund (Property Taxation),
along with professionals, will visit you and make an
appraisal. The appraisal will help determine the monetary
compensation, so that the damage can be renovated with
the assistance of the professionals of your choice.
Damage to Domestic Objects in Residences
If objects in your home have been damaged, in
accordance with the regulations, compensation
for domestic objects is implemented based on the
"domestic objects" price list and the size of the family.
In any event, loss of cash and checks, or jewelry and
art damaged in the event, does not qualify the owner
for compensation.
An updated price list of "domestic objects" is included
in the "War Damage Voluntary Insurance for Domestic
Objects" guide. Please note that you can extend the
insurance coverage for "domestic objects" by means
of a token premium payment by filling the "Online
Declaration Form" at the Israel Tax Authority website
www.taxes.gov.il.
The compensation value for the domestic objects
that were damaged will be determined based on the
cost of repair. If, in the opinion of the director of the
Compensation Fund (Property Taxation), the object is
beyond repair, the compensation value will correspond
to the value of a similar, new domestic object instead.
Damage to Vehicles
Owners of vehicles damaged in a hostile act, will apply to
the staff of the compensation department in the area, so as
to estimate the damage, and will immediately be referred
for repair of the damage at any garage they choose, on
condition that the Compensation Fund (Property Taxation)
appraiser shall approve the repair before it is performed.
At the time of application, the claim form must have the
following documents attached: Driver's license; police
certificate (including: the vehicle number and the signatures
of the police investigator and officer); power of attorney (if
the claimant is not the owner of the vehicle – the power of
attorney form may be downloaded from the Tax Authority
website); leasing agreement (if the vehicle is under longterm lease); lease agreement (for taxi drivers); insurance
company certificate (for repairs of over NIS 10,000, an
insurance company certificate regarding lack of claim must
be attached); and a copy of the check/confirmation from
the bank/from the bank account in the name of the
claimant.
Damage to Business
Business equipment and stock: Coverage of damage to
business equipment, by law, is based on the market value of
the equipment (willing seller to willing buyer value in the free
market), in its pre-damaged state; you are required to prove
ownership of the damaged contents.
With regard to stock, you are entitled to compensation based
on the cost value of the damaged stock (without VAT), after
offering proof of ownership of the stock.
To the proof of damage, you must add a list of the equipment/
stock which was damaged, financial statements or
documents attesting to your ownership of the equipment/
stock (purchase invoice, stock reports confirmed by an
accountant, etc.). All material is to be submitted to appraisers
in our employ, based on their request.
The claim forms are to be attached with an income tax
certificate regarding tax withholding, and a copy of a blank
check to confirm bank details, in addition to all documents
that the appraisers require you to submit.
Passers-by Involved in a Hostile Event
If you were involved in a hostile event and your personal
belongings were damaged at the time, please apply to the
staff of the Compensation Fund (Property Taxation). Please
make an attempt to present the damaged items, so that it will
be possible to estimate the damage.
