GENERAL TERMS AND CONDITIONS for the Congress “re.comm” of epmedia Werbeagentur GmbH (hereinafter referred to as Organizer) (As of: December 2016) Preamble To make the contents better readable and understandable, any gender-specific phrasing was waived in gender-specific references. The male gender used in this text applies to both genders equally. 1. Subject Matter and Area of Application 1a) These General Terms and Conditions (AGBs) govern the relationships the Organizer as the legal entity of re.comm has with the congress participants. They govern all agreements of re.comm whether they are free of charge or not free of charge. The utilization of any services of the Organizer whatsoever within the framework of re.comm is subject to these terms and conditions. An agreement of the participation in the re.comm is only concluded after the registration has been confirmed in writing. Any changes and/or amendments to this Agreement must be set forth in writing. Verbal agreements are only effective if confirmed in writing. 1b) For the completely published text of the AGB in its effective version go to the homepage of re.comm at www.recomm.eu. 2. Cancellation of the Event The Organizer is entitled to cancel re.comm for financial reasons. In this event, you are paid back any attendance fees already paid. There are no additional claims. 3. Changes in congress agenda The Organizer reserves itself the right to replace individual lectures of re.comm or to cancel them or to change the event venue. Such changes do not result in any right for repayment of the attendance fee or parts of the attendance fee or other expenses. 4. Rejecting a Registration The Organizer has the right to reject registrations to the re.comm without justification. 5. Whats included? 5a) For three event days, the Organizer holds the trade Congress “re.comm” for real estate professionals. Dates, contents and speakers are published in the Congress program and under at www.recomm.eu. The Organizer reserves itself the right to change the program at any time. 5b) Each Congress participant must pay the attendance fee. The fee includes the program for trade professionals and the entertainment program. What‘s not included? Arrival and the accommodations in the event of booking only the Congress pass. 5c) Taking photos, videos and audio recordings during the lectures is principally prohibited or may only be done with the express permission of the Organizer. 6. Settlement and Payment 6a) Stating all necessary information accurately and paying the Congress fee in full are required for a binding registration. Payment is made by invoice. 6b) To ensure that only authorized persons participate in the event, the Congress participants agree to identify themselves at the Congress with the Congress ID card provided by the Organizer upon the request of a congress employee on-site. Congress cards are non-transferable. 7. Cancellation Terms 7a) The cancellation of a registration and the transfer of a registration to another person must be done in writing. 7b) If the registration is cancelled, the Organizer reserves itself the right to keep a cancellation fee of 30% of the attendance fee. Cencellation until 30th June 2017 is free of charge. For any cancellations from 2 September 2017 or non-participation without cancellation, the attendance fee is not refunded. If a replacement participant is named for a canceled registration, then the cancellation fee is waived. 7c) In the event, the re.comm 2017 does not take place, then the Organizer refunds 100% or all Congress fees already paid. Any additional claims are excluded. 8. Liability 8a) All Congress participants and speakers visit the event on their own risk. 8b) The Organizer shall not be liable for any damages suffered by Congress participants provided the Organizer did not cause these damages by gross negligence. This indemnification applies also in reference of the behavior of the Organizer‘s agents and/or repre sentatives. In the event of a violation of significant contractual duties, the Organizer shall only be liable within the scope of the foreseeable damage. 8c) The statute of limitation for asserting any claims for compensation toward the Organizer shall be six months. 9. Privacy 9a) The information provided by the Congress participants during the registration is stored and processed electronically and they are treated strictly confidential in accordance with the regulations of the Austrian Data Protection Act in its effective version. 9b) By stating the postal or e-mail address, fax number and mobile phone number, the Congress participant agrees (can be revoked at any time) to receive information material from the Organizer by mail, fax, e-mail or SMS and the Congress participant agrees with the EDP-supported recording and processing of his data. 9c) The data protection declaration of the Organizer does not apply to Internet pages to which reference is made by link or button and which were not created by the Organizer. 10. Final Clauses If individual provisions of this Agreement are ineffective in whole or in part, or if this Agreement contains a gap, it does not affect the remaining provisions or parts of such provisions. Respective legal regulations take the place of the ineffective or missing provisions. 11. Jurisdiction, applicable law All rights and duties of “re.comm” are subject to Austrian law.
