R u l e s of P r o c e d u r e f o r the Judicial C o m m i s s i o n
1.
The C h a i r m a n and V i c e - c h a i r m a n shall be e l e c t e d by
m e m b e r s of the C o m m i s s i o n ( C o m m i s s i o n e r s ) and s h a l l
hold office f o r the unexpired portion of t h e i r t e r m s as
C o m m i s s i o n e r s . If they a r e r e - e l e c t e d C o m m i s s i o n e r s
they will b e eligible f o r r e - e l e c t i o n as C h a i r m a n and

V i c e - c h a i r m a n . The Chairman and V i c e - c h a i r m a n shall
not be of the s a m e c l a s s , so that the t e r m s of office of
Chairman and V i c e - c h a i r m a n will not expire simultaneously.

When the Chairman is unable to attend a meeting, the
V i c e - c h a i r m a n will undertake the duties of the C h a i r m a n ,
and will, p r o tempore, have all the powers of the C h a i r man.

The Commission m e e t s a t the t i m e o f e a c h C o n g r e s s , and
a t its f i r s t meeting s h a l l c o n s i d e r the nomination of a l t e r nates for absent C o m m i s s i o n e r s (Draft P r o p o s a l 60).
Except i n the election of Chairman and V i c e - c h a i r m a n ,
nominees approved by the Commission will have the voting
rights of the C o m m i s s i o n e r s they r e p r e s e n t .

A minimum of five C o m m i s s i o n e r s , who mustinclude the
Chairman o r V i c e - c h a i r m a n and a t l e a s t one P e r m a n e n t
S e c r e t a r y , can proceed to the nomination and approval of
a l t e r n a t e s f o r m e m b e r s not attending the C o n g r e s s .
After a l t e r n a t e s have been approved, s e v e n Commissione r s and approved a l t e r n a t e s s h a l l make a quorum.
5 . A l l votes s h a l l be taken by a show of hands unless a s e c r e t ballot is demanded by at l e a s t one-third of the
C o m m i s s i o n e r s (and a l t e r n a t e s ) p r e s e n t . The votes of 8
or m o r e C o m m i s s i o n e r s a r e r e q u i r e d to approve a n official OPINION or a n amendment of the International Bacteriological Code of Nomenclature , but on other subjects
a simple majority will suffice. In the event of a tie the
Chairman s h a l l h a v e a casting vote. When m e m b e r s wish
to r e c o r d a unanimous decision, a f r e s h vote m a y be
called f o r and taken.

The c l o s u r e of a discussion m a y b e proposed and seconded at any time a f t e r the discussion on one subject has
proceededfor m o r e than 3 0 minutes. The Chairman m u s t
put such a motion to the vote without further discussion.

Title of the Code. The S e c r e t a r y p r e s e n t e d a p r o p o s a l that
the name of the code should be changed to International Code
of Bacteriological Nomenclature; this was seconded by D r
Murray.
After discussion i t was a g r e e d unanimously that
D r . Thjdtta's amendment, seconded by D r . M u r r a y , should
be accepted. This amendment r e a d asfollows: It is proposed
that the title of the bacteriological code should b e changed
f r o m International Bacteriological Code of Nomenclature t o
International Code of Nomenclature of B a c t e r i a and V i r u s e s ,
with a s h o r t title of Bacteriological Code.

given to proposal 10a with the modification that the last

based upon the name of a contained family.

Consideration was given t o t h e

approved unanimously.
Draft P r o p o s a l 12 (p. 3 9 ) . It was a g r e e d unanimously that
this proposal should be rejected.
Draft P r o p o s a l 13 (p. 39). The proposal was accepted unanimously. It was further a g r e e d that the Committee on Bact e r i a of the Botanical Congress ( D r . 0. N. Allen, C h a i r m a n )
b e requested to confer with the suitable botanical committee
with r e f e r e n c e t o the t r i b a l ending - e a e .
Draft P r o p o s a l 14 (pp. 4 1 -44). I t was a g r e e d that because of
the rejection of d r a f t proposal 12 the sentence
"The nomenclatural type genus of a family whose
name is recognized as an exception (See Note
Rule 3 ) m a y be fixed by the Judicial Commission,
p r e f e r a b l y at the time that approval to the exception is made. I '
i n p a r a g r a p h ( 1 ) should be deleted. It was f u r t h e r a g r e e d
that the l a s t sentence of the p a r a g r a p h beginning "A neotype
c u l t u r e " should r e a d as follows:

"An author when publishing the name of a new taxon
should designate the type and, i n the c a s e of a
s p e c i e s or sub-species, the collection where the
type s t r a i n o r equivalent is p r e s e r v e d . "

be made to make this Recommendation a Rule.
Draft P r o p o s a l 50 (p. 57) was approved unanimously.
Draft P r o p o s a l 51 (p. 57) and Appendix B (pp. 70-72) w e r e
considered together.
Draft proposal 51 was approvedunanimously,and Appendix B,
as amended, will be considered at the next meeting. It was
proposed by D r . Cowan and seconded by D r . M u r r a y that
Provision 5 of the Bacteriological Code should authorize a
list of p r e f e r r e d spellings f o r n a m e s of taxa and epithets,
and that wherever it i s s t a t e d i n the Bacteriological Code
that a spelling m a y be c o r r e c t e d , s u c h c o r r e c t i o n c a n only
be made with the approval of the Judicial Commission.
Approved spellings will be published in the l i s t of p r e f e r r e d
spellings. This w a s approved .unanimously and the C h a i r m a n
was a s k e d to p r e p a r e the n e c e s s a r y addition o r change to
P r o v i s i o n 5 and to r e p o r t to the next meeting.
D r a f t P r o p o s a l s 5 2 , 5 3 , 5 4 , 5 5 and 56(pp. 57-58)were approved
unanimously.
Draft P r o p o s a l 57 (p. 59). In the l a s t line of the p a r a g r a p h
labelled 5 the word may should be substituted f o r the word
will.
As amended, the d r a f t proposal was approved unanimously.

Draft P r o p o s a l 58 (p. 60) was amended to r e a d as follows:
P r o v i s i o n 4, Section B, Subsection 8. One o r other of the
P e r m a n e n t S e c r e t a r i e s s h a l l b e designated a m e m b e r of e a c h
subcommittee and shall be responsible only for advising the
s p e c i a l i s t subcommittee on the i n t e r p r e t a t i o n of the B a c t e r i ological Code.
With this amendment the proposal was approvedunanimously.

Draft P r o p o s a l 62. The Chairman and S e c r e t a r i e s w e r e ins t r u c t e d t o p r e p a r e a n amendment to P r o v i s i o n 5 B 2 to modify the methods of requesting and challenging Official OPINIONS. Requests for OPINIONS should be accompanied by a
fully documented statement of the relevant f a c t s ; any challenge of a n OPINION should a l s o be accompanied by a r e a soned and documented argument.
Minute 6 . It was a g r e e d unanimously that the OPINION on
the g e n e r i c name Bacillus i s s u e d in 1936 should be r e f e r r e d
to as OPINION A (1 93 6 ) .
OPINION 4, conserving the g e n e r i c name Bacterium had been
challenged by D r s . Borman, Kauffmann and o t h e r s . It was
a g r e e d that the two original r e q u e s t s for the conservation o r
rejection of the name Bacterium should be r e f e r r e d to the
Nomenclature Committee.
OPINION 3 , relating t o t h e gender of n a m e s of b a c t e r i a l gene r a having - b a c t e r as the final component, had been challenged
telegraphically by D r . R . S. B r e e d . After consideration the
Commission unanimously confirmed its adherence to the
original OPINION.

P r o p o s a l to amend the Bacteriological Code.
Draft P r o p o s a l 62, r e f e r r e d f r o m the meeting of 5th Septemb e r , was submitted f o r consideration. The proposal, which
was a g r e e d to unanimously, r e a d :
I n s e r t between the first and second sentences of P r o
vision 5 B 2 the following: "A r e q u e s t for a n OPINION should
be accompanied by a fully documented s t a t e m e n t of the r e l e vant f a c t s ; when a r e q u e s t is not supported by adequate evidence it s h a l l be r e t u r n e d t o the s e n d e r for revision. When
a n OPINION is challenged the b a s i s of the challenge s h a l l be
stated and supported by a documented statement of the r e l e vant f a c t s . I '
An annotation could explain that the Commission will indicate
the deficiences of the statement and will suggest how it could
be improved.

Minute 8 . Report of the Editorial Board
D r . Buchanan, C h a i r m a n of the Board, reviewed the h i s t o r y
of the establishment of the International Bulletin of B a c t e r i olorrical Nomenclature and Taxonomy. He r e p o r t e d difficulties i n producing such a bulletin without adequate financial
backing. However, financial support f r o m s e v e r a l scientific
bodies had been provided and this help was g r e a t l y a p p r e ciated. The circulation of the Bulletin is s t i l l s m a l l , but a n

M u r r a y proposed that enquiries should be made i n Holland

Minute 9. Reference back of OPINION 4
At i t s meeting on 7th September the Nomenclature Committee
had r e f e r r e d back to the Commission OPINION 4 with the instruction to r e j e c t t h e generic name B a c t e r i u m and the family name B a c t e r i a c e a e .
I t was a g r e e d that time was needed to p r e p a r e a r e v i s i o n of
OPINION 4 .
The C h a i r m a n will p r e p a r e OPINION 4 ( r e v i s e d ) rejecting
the generic name Bacterium and the family name B a c t e r iaceae.
The d r a f t will be circulated t o the C o m m i s s i o n e r s
and-postal approval of i t s wording will be sought.
Minute 10. Choice of the type s t r a i n of the s p e c i e s E s c h e r i c h i a coli. D r . Cowan r e p o r t e d that he had asked v a r i o u s
experts to examine the descendant of E s c h e r i c h ' s original
s t r a i n of Bacterium coli commune (NCTC 86, ATCC 4157).
The experts a g r e e d that the s t r a i n was culturally and biochemically typical, but unfortunately was not typable s e r o logically. D r . Cowan was asked to explore the possibilityof
selecting as type a s t r a i n that was serologically typable.

so much work.
The Commission unanimously e x p r e s s e s its thanks to P r o f .
Buchanan f o r the work he had put into p r e p a r a t i o n s for the
