RULES OF SUPERINTENDENCE
RULE 12 (E) (2)
Rule 12 (E) (2) of the Rules of Superintendence provides as follows:
“Multiple defendants or charges in criminal cases,
including traffic cases, all defendants shall be
assigned separate case numbers.
Where a defendant is charged with a
misdemeanor and traffic offense, the defendant
shall be assigned one case number. The category
selected for the case number and its case type
designator shall be that of the offense having the
greatest potential penalty.”
Although the cases filed at the Painesville Court are set up according
to Rule 12 (E) (2), the next two (2) pages are a summary of all
complaints or citations that were filed at this Court during 2011.

Mission Statement
To enhance community safety through enforcement of Court orders while
striving to empower individuals and change lives.
The Painesville Municipal Court Probation Department Employees continue to accomplish the
department’s mission and goals. Although every year brings about new challenges, the probation
department continues to flourish and generate positive outcomes not only for the offenders, but
for the community we serve.
The probation department, in the year 2014, received one thousand three hundred forty-nine
(1,349) new cases to supervise. Of the one thousand three hundred forty-nine (1,349) cases, one
hundred thirty-seven (137) of those were for community service monitoring only. One hundred
eighty-six (186) cases were referred to the Pre-trial Diversion program, providing the eligible
offender the opportunity to have the charge dismissed after fulfilling court requirements. Fiftyfour (54) written presentence investigation reports were also completed by the probation
department in 2014.
Per Ohio Revised Code §2951.021, the Court continues to require an offender placed under the
control and supervision of the probation department to pay a monthly supervision fee of twenty
dollars ($20). In the year 2014, ninety-nine thousand six hundred forty dollars and four cents
($99,640.04) was collected. The supervision fees were utilized for specialized staff, purchase of
equipment, treatment programs for probationers and state mandated continuing education for
staff.
The Court also provides house arrest, ignition interlock devices and SCRAM (Secure Continuous
Remote Alcohol Monitor) as tools for the probation department to monitor appropriate offenders.
In the year 2014, forty-eight (48) offenders served one thousand three hundred eighty-six (1,386)
days on house arrest. Twenty-eight (28) offenders served one thousand two hundred fifty-eight
(1,258) days of house arrest under the Court’s Jail Diversion program (state funded house arrest)

and twelve (12) offenders served eight hundred thirty-three (833) days of house arrest as a
requirement of bond supervision. Also in the same year, fifty-one (51) offenders had the ignition
interlock device installed on their vehicle in order to utilize limited driving privileges. In regards
to SCRAM, in the year 2014, forty-four (44) offenders were monitored for a total of two
thousand nine hundred forty-five (2,945) days (each offender served an average of eighty-nine
(89) days on SCRAM). It should be noted out of the two thousand nine hundred forty-five
(2,945) days of SCRAM monitoring, there were two thousand nine hundred twenty-five (2,925)
sober days, a 99.3% success rate.
A sanction the Court continues to aggressively use for offenders is supervised community
service work. Last year two hundred ninety-nine (299) offenders completed four thousand seven
hundred thirty-three (4,733) hours in the Court’s Community Service Work program. The
offenders are required to work under the authority of health districts, park districts, counties,
municipal corporations, townships and charitable organizations. In October of 2014, Judge Mike
Cicconetti finished his twentieth (20th) year of operating the Painesville Municipal Court Garden.
Under the guidance and supervision of Walter R. Siegel, non-violent offenders sowed, tended
and harvested the one (1) acre garden located at 3740 Center Road in Perry Township. The
plants were again donated by numerous local nurseries and an assortment of vegetables were
picked and sent to the Salvation Army, Madison Food Bank, Perry Food Bank, Teen Challenge,
Madison Senior Center and Perry Senior Center.
Painesville Municipal Court staff continues to be active with various professional organizations
such as Ohio Chief Probation Officers Association, Northeast Ohio Probation Officer’s
Association and the Lake County Corrections Board. The probation staff attended the Line
Officers Training Institute in June of 2014.

VICTIM ASSISTANCE PROGRAM
2014
It was an important and eventful year for the Painesville Municipal Court Victim Assistance
program in 2014. The program which is funded by the Violence Against Women Act (VAWA)
received an award for the continuation of funding for the 2014-2015 period. With this grant, all
victims of crime are contacted and provided information about their rights as a victim. The
grant provides funding for the full-time Victim Advocate, Sheri A. Sweeney.
The program’s office also went under construction in early 2014 to make the victim area more
comfortable and safe while they attend court hearings. The new construction provided a
separate and secure room where the offenders would not have access. This room was
dedicated and named after the late Painesville City and Madison Township Prosecutor, Ed
Powers, who sadly passed away in October 2013. His service to victims will now forever be
honored in “The Edward C. Power’s Victim Assistance Room”.
Ms. Sweeney is a project partner in the Lake County Victim Services Collaborative Committee.
Several agencies ranging from hospitals, law enforcement agencies, mental health agencies and
other victim assistance programs have joined together to coordinate greater awareness of
victims’ rights and to create a greater understanding of how these other services can assist
victims. This committee meets quarterly and is extremely helpful in pooling resources and
locating areas where victim services may be lacking.
The following statistics represent the victims serviced by the Painesville Municipal Court’s
Victim Advocate. These victims were provided criminal justice support and advocacy by way of
letters, phone calls, e-mails, courtroom advocacy, referrals and follow up support. Over 1000
phone calls were received and made concerning questions regarding court cases and referrals.
