NO. 2600 Regionaì the Col umbi a and setbacks Distrjct in open ITIONS In thj s byì aw "alluvial fan" means an alluvial depos.it of a watercourse a) where it jssues from a mountain valley or gorge upon a plaìn, b) at the junct'ion of the watercourse w'ith a tributary of that watercourse; "enactment" has the meanjng given adoptìon of thjs bylaw; in the Interpretation Act on the date of "flood construction level" the level des'ignated jn section 3; means "flood level" means the level designated as such on the map for the purposes of determ'ini ng fl ood construct j on I evel s and fl oodpl ai ir setbacks under Section 3 and 4; "floodpìaìn" means the part of the Salmon Valley desìgnated in SectjonZ "floodpìa'in setback" means the setback designated jn Section 4 from the natural boundary of a waterbo-dy or watercourie behjnd which any habitable area must be constructed "floor or located; system" means the lowest floor system of a bui'lding or structure; "hab'itable area" means _any :pqc-e or room, jncluding a manufactured home, that is or can be used for dwelìing purposes, businãss, or the storage of goods which are susceptible to damage by floodwater; l1ap'l means lhe qap that forms schedule A to this Bylaw, descrjbed Floodplain of Salmon Rjver - Salmon Arm to Falklandi as BYLAT¡I N0. "Mi 2600 PAGE 2 n'ister" means the Minister of Envìronment, Lands and parks or of that Mi n i ster; a de'legate "natural boundary" means the visible hìgh water mark of any waterbody or watercourse includìng any dormant side channels of any watercourse, where the presence and action of the water are so common and usual, and so long continued in all ordinary years as to mark on the sojl of the bed of the waterbody or watercourse a character distinct from that of its banks, in vegetat'ion, as wel I as i n the nature of the so'il j tsel f ; "natural ground elevation" means the lowest level of the surface human disturbance of the surface; parcel determjned before any of a I'Pudl' means a surface made of concrete, to the uppermost surface of which blocks, posts, runners.o_r stnip footings have been affjxed for the purpose of supportì ng a hab'itabl e area; "parce'I" means any lot, b'lock or other area jn wh jch land which jt js subdjvided, but does not jnclude a highway; js held or jnto "standard dyke" means a dyke buiIt and ma'intained pursuant to any to a design approved by the l'1jnjster, wjth a minjmum flood crest elevation at least equal to the flood constructjon level applicable to the dyke; enactment, "water body" means a lake or other body of water other than a watercourse; and "watercourse" means any depression in the land that: (a) js of natural or human origìn; (b) has well defjned banks; (c) has a bed 0.6 metres or more below the surroundìng rand; and (d) either: (ì) gives direction to moving water for an aggregate of at least 6 months during any calendar year; or (ii) has a drainage area of 2 square kjlometres upstream from the poìnt of consjderation. or more FLOODPLAIN DESIGNATION 2, Thls Bylaw appljes to-the part of the Columbja shown on the map. The flood construction level: (a) for a parce'l outside the act'ive part of the Bolean Creek alluvial fan, as shown on the map, is the greater of: (i) the level for the parcel determ'ined by'interpolatìon of the flood levels applicable to the parcel as set out the map; and ( on fl ood I evel s appì'i cabl e to the parcel are set out on the map, the level that is 1.5 metres above the highest natural boundary of any watercourse or waterbody adjacent to the parcel; and i i ) where no (b) for a parcel withjn the active part of the Bolean Creek alluvial fan, as shown on the map, is the greater of: i) 0.6 metres above the natural ground elevat'ion for the parcel; and ii) the flood construct'ion level for the parcel determined by app'ìying Sect'ion 3(a). FLOODPLAIN SETBACK DESIGNATIONS 4. The folìowing floodplain setbacks are designated as appl icable: a) for a parceì adjacent to the Salmon R'iver, 30 metres from the natural boundary of the Salmon River; b) for a parce'l upstream of the apex of the Bolean Creek alluvial fan, as shown on the map, 30 metres from the natural boundary of c) Bolean Creek; for a parcel downstream of the apex of the Bolean Creek alluvial fan, as shown on the map, 15 metres from the natural boundary of Bolean Creek; BYLATJ N0. 2600 PAGE 4 for a parceì not described jn Sectjon 4(a) to (c), 15 metres from the natural boundary of any watercourse; for a parce'l adjacent to a waterbody, 7.5 metres from the natural boundary of any waterbody; and despìte the rest of this section, 7.5 metres from a standard dyke for a parcel protected by a standard dyke. d) e) f) DETERMINATIONS UNDER BYLAt-l 5. Subject to Section 7, on any parceì: a) the underside of any floor system, or the top of any pad, supporti ng any habi tabl e area must be above the fl ood construction level for the parcel and must comply wìth the floodpìain setback for the parcel; and b) any landfjll required to support a floor system, or pad, supporting a habitable area must not extend within the floodplain setback for that parcel. EXEMPTIONS FROI4 BYLAt.l REQUIREMENTS 7. Sectjon 6 does not apply to a parcel if, under the Munjc'ipal Act, the Minister has, subject to condjt'ions the Mjnjstelimposes, exempted a development or type of development from the requirements of Section 6. OFFENCE 8. A person who contravenes a provision and of th'is Byìaw is guilty of an offence is liable on conviction to a fine of not more than $2000 or to imprisonment for not more than 6 months, or both.
