Orders of the Tribunal
The Learned Counsel appearing for Applicant very
vehemently denied that despite orders of the Tribunal the
Grater NOIDA Authority has removed the Municipal Solid
Waste from the land belonging to the Applicant. In fact,
according to him, they are using JCBs to dig the earth and
put soil to cover Municipal Solid Waste. This activity is
carried out illegally, unauthorizedly and in violation of the
orders of the Tribunal.
In view of the above disputed facts, it is necessary
and in fact the Applicant prays that Local Commissioner
to be appointed to verify the fact existing on the site in
question which would clearly support the application and
bring correct position before the Tribunal. Consequently,
we appoint Mr. Sharan Thakur as Local Commissioner.
The fee is fixed Rs. 35,000/- in addition to all the
expenses that would be incurred during inspection will be
paid by the Applicant.
He shall submit a report as to whether the
Municipal Solid Waste is being thrown on the site in
question, whether the Municipal Solid Waste has been
covered by soil through JCBs or otherwise and the
Municipal Solid Waste was being dumped for considerable
time over the land of the Applicant.
Parties are at liberty to remain present during the
Commissioners proceedings.
Local
Commissioner
would
conduct
surprise
inspection.
List this matter for further directions on 09th
October, 2015.
