ORDINANCE 2000-0-250 AMENDING THE ORDINANCE PASSED DECEMBER 15, 1981, AND MOTION PASSED ON SEPTEMBER 17, 1992 THEREBY INCREASEING ·THE ANNUAL SALARIES OF THE MEMBERS OF THE CITY COUNCIL FROM $6,000 TO $12,000 PER YEAR AND THE SALARY OF THE MAYOR OF THE CITY OF LAREDO FROM $18,000 PER YEAR TO $36,000 PER YEAR, PURSUANT TO ARTICLE II., SECTION 2.02 OF THE CITY CHARTER WHEREAS, the City of Laredo has established a procedure to adjust the Mayor and City Council member's salaries pursuant to Article II, Section 2.02 of the City Charter; and WHEREAS, the City Council, passed a motion during the City Council meeting held on September 18, 2000 instructing the City Manager to draft an introductory ordinance to increase the annual salaries of the Mayor, and the members of the City Council as follows, the Mayor's salary shall be increased from $18,000/Yr. To $36,000/Yr. And the City Council Member's salary shall be increased from $6,000/Yr. To $12,000/Yr., in accordance with the provisions set forth in Article II, Section 2.02 of the City Charter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT: Pursuant to the provisions of Article II, Section 2.02 of the City Charter, it hereby authorizes an amendment to the Ordinance passed on December 15, 1981, and the Motion passed on September 17, 1992, thereby increasing the annual salaries of the Mayor, and the members of the City Council as follows, the Mayor's salary shall be increased from $18,000/Yr. to $36,000/Yr. and the City Council Member's salary shall increase from $6,000/Yr. to $12,000/Yr. BACKGROUND: The City Charter specifically details actions for adjusting the annual salary for the Mayor and City Council members. As stated in the City Charter Article II Section 2.02, City Council may determine the annuai salary of the Mayor and City Council members by ordinance, but no ordinance increasing such salary shall become effective for the Mayor and all City Council members until the date of commencyment of their respective new term provided that such respective new term follows the adoption of the ordinance by at least three (3) months. Salaries f(lr City Council members and for the Mayor were established by an ordinance passed in December 15, 1981 at $6,000 per year. The Mayor's annual salary was subsequently increased to $18,000 b:y City Council action on September 17, 1992. FINANCIAL: There is no financial impact for this Fiscal Year. The finance impact will be when the respective new term increases the salary for each council member and mayor position. COMMITTEE/BOARD RECOMMENDATION: STAFF: That City Council introduce this ordinance. ARTICLE II CITY COUNCIL Section 2.01 COMPOSITION, ELIGIBILITY AND TERMS (A) Composition There shall be a City Council composed of a mayor and eight (8) Council members. The City shall be divided into eight (8) districts and a City Council member shall be elected from each district. Whenever the term "City Council Member" is used in this Charter it means member of the City Council other than the mayor. (B) Eligibility The Mayor and all City Council members shall be qualified voters of the City, and shall have resided for twelve (12) months within the City immediately preceding the election. Each City Council member mu~t be a resident of the district he represents at the time of his election, and must maintain his residence in the district from which he was elected throughout his term of office. If the Mayor shall cease to be a resident of the City, or if any City Council member shall cease to be a resident of the district from which he was elected, he shall forfeit his office. (C) Terms The Mayor shall serve a four (4) year term with a limit of two (2) elected four (4) year terms. The City Council Members ~hall serve a four (4) year staggered term with a limit of two (2) elected four (4) year terms as a City Coucilmember and may serve two (2) elected four (4) year terms as Mayor. A person may serve two (2) elected four ( 4) year terms as a member of the City Council and two (2) elected four (4) ye~r terms as Mayor. Excluding any time served through appointment or an elected unexpired term prior to being elected to a four (4) year term. Section 2.02 COMPENSATION; EXPENSES The City Council may determine ~:he annual salary of the Mayor and City Council members by ordinance, but no ordinance increasing such salary shall become effective for Mayor and all City Council members until the date of commencement of their respective new term, provided that such respective pew term follows the adoption of the ordinance by at least three (3) months. The Mayor and City Council members shall get a salary deduction to be assessed for each unexcused absence from a regular City Council meeting. The Mayor and City Council members shall receive reimbursement for their actual and necessary expenses incurred in the performance of their duties of office. Section 2.03 PROHIBITIONS (A) Holding Other Office Except where authorized by law, no Council member shall hold any other City office or employment during the term for which he was elected to the Council, and no former Council member shall hold any compensated appointive City office or employment until one year after the expiration of the term for which he was elected to the Council. (B) Appointments and Approvals Neither the Council nor any of its members shall in any manner dictate the appointment or removal of any City administrative officer or employee whom the City Manager or any of his subordinates are empowered to appoint, but the Council may express its views and fully and freely discuss with the City Manager anything pertaining to appointment and removal of such officers and emplqyees. (C) Interference with Administration Except for the purpose of inquiries and investigations under Section 2.06, the Council or its members shall deal with City officers and employees who are subject to the direction and supervision of the City Manager solely through the City Manager and neither the Council nor its members shall give orders to any such officer or employee neither publicly nor privately. Section 2.04 VACANCIES: FORFEITURE O:ll' OFFICE, FILLING OF VACANCIES. (A) Vacancies The office of the Mayor or of a Council member shall become vacant upon his death, resignation, removal from office in any manner authorized by law, or by forfeiture of his office. (B) Forfeiture of Office The Mayor or a Council member shall forfeit his office if he (1) lacks at any time during his term of office any qualification for holding the office prescribed by this Charter or by law, (2) shall fail to meet the residency requir~ments for his election to office, (3) is 4
