the National Library of Wales in 1998, and this introduction appeared in their catalogue of 1936. All repair work was undertaken by them. Montgomery Borough, consisting of the resident hereditary burgesses of the town, headed by two Capital Bailiffs, the " High Bailiff " and the Low Bailiff " (see an article by the present writer in M. C, vol. 44) was set up by a charter of Henry 3rd dated 1227 and was abolished by the Municipal Corporations Act in 1885. The only document included here which deals with the affairs of the Corporation after this date is the Charter of Incorporation of Queen Victoria, dated 31st August 1885: this has been placed amongst the older Charters. The original Charter of Henry 3rd, and Inspeximus, or confirmatory, Charters of Edward 3rd, Richard 2nd, Henry 4th, Henry 5th, and Henry 6th, no longer exist. The Inspeximus Charter of Henry 4th dated 27th June, 1399, is printed with a translation in Montgomeryshire Collections, vol. 21, being copied from a "Transcript of the Charters, Laws, Statutes and Customs of the Free Borough of the Town of Montgomery" made in 1802, so that it appears that this charter was in existence as late as that year. There is now, however, no trace of it, and the surviving charters are as follows: 1 2 3 4 5 Henry 7th Henry 8th Elizabeth Elizabeth Charles 2nd 20th May 1486 16th June 1536 17th February 1561/2 19th February: 1561/2 28th June 1670 The seals have unfortunately disappeared, with the exception of fragments of Nos. 1 and 4 and the greater part of No. 3, the last of which has been as far as possible repaired. The Charters themselves, however, are in an excellent state of preservation and have been cleaned treated with vellum size. The device chosen is that commonly used by the old Corporation and which appears on the seal of the Corporation of today. The frontispiece of the volume of transcripts of 1802 contains illustrations of the "Arms" and "Seal." The Arms given are "Gules, a lion rampant Or, within a bordure of the last "; but a note in the handwriting of Mr. Edmund Edye, then Town Clerk, states that the ground should be Azure instead of Gules, and the pendant attached to the Mayoral chain (given by Mr. N. W. Fairles-Humphreys, Mayor, in 1909) has, in fact, a blue ground. These Arms are, however, not registered at the College of Heralds and it is not clear by what authority they are used: it was therefore thought more appropriate in the present instance to use the seal of the Corporation. This seal consists of two crossed keys on a plain ground and was, according to Mr. Edye, "ridiculously adopted for a new Common Seal in consequence of such being the Pitchmark for cattle in the Floce (Flos) meadow.' Why the Town Clerk should have thought this reason ridiculous is not apparent; Mr. Edye, however, lived in the days when “romance" in heraldry was preferred to accuracy, and it is permissible to think that the Bailiffs and Burgesses of the time showed a truer Historical sense than their clerk in choosing an emblem which no doubt had a respectable local antiquity. The seal engraved on the Charter box is surrounded by the words SIG: BALIVORUM ET BURGENSIUM. MONTGOMERY." The most important documents of the old Corporation are the Court Books, consisting for the most part of particulars of actions in the Court of Record. The books are invaluable to the student of the history of the Borough as they contain not only the records of actions, but also the names of the presiding Bailiffs, Jury lists and, for the greater part of the period covered, lists of admissions of Burgesses. Admissions of Burgesses from 1783 onwards are recorded in .a separate book kept for that purpose. Fuller particulars of the -contents of these Court Books will be found in the attached schedule. It may be observed that, though the earliest volume begins in 1633, the records are far from continuous until the Restoration M/B/MO 3 period. The last book is dated 1820-1877 although, as stated in the schedule, the minutes of the Courts cease in 1851. In addition to the Court Books themselves there are a number of files of papers relating to actions recorded in the books. One of the most interesting volumes is a book of the Charters and Customs of the Borough (No. 17), referred to above. This was made in 1802 and contains amongst other matters a transcript of a Charter of Henry 4th, now lost. The "Antient Manuscript," from which the transcript was chiefly made, appears to be the 16th century document numbered 32 in the schedule. The remaining documents, which include all abstract of Ministers' accounts for 1531-1540, a "Survey" of the castle dated 1592/3, and many indentures of Parliamentary returns, are fully, described in the schedule. The remarks in the schedule as to the condition of the documents refer, of course, to their state when first deposited. The manuscripts, including the Court Books, have now been cleaned and, wherever necessary, repaired with hand-made paper: all the leaves badly affected by damp have been split open and, in addition to the ordinary mending, pieces of thin silk have been placed in the centre of the repaired leaves: every leaf has been sized to restore it to its original crispness and to increase its resistance to atmospheric conditions. The volumes have been bound, some in half levant morocco -and some in full nigerian morocco. They have all been lettered and dated oil the spine and the seal of the Borough has been engraved in gold oil tile front covers. The miscellaneous documents have been cleaned, repaired and sized and either bound into volumes or, in some cases, placed in a uniform series of cloth-bound boxes. It only remains to express admiration at the careful treatment which has been expanded on the documents by the repairer and binder of the National Library and at the handsome and dignified appearance of the finished volumes; and also to congratulate the Corporation of Montgomery on their foresight in authorising the work, which has undoubtedly saved both the Charters and Documents from the inevitable risks of decay and dispersal. At one end is a copy of the will of Edward Herberte of Montgomery, esquire, March 24, 1592/3.Beginning with the other end are lists of burgesses who owe suit of court at Montgomery, 1633, and entries recording the admission of burgesses at a number of leet courts and small courts between 1637 and 1650. /2 1646-1663 COURT BOOK Paper; 332 unnumbered folios; 289 x 186 min.; sewn in parchment, with remnants of thongs. The first half of the volume has suffered from damp, and the first folios are very fragile along the top and back. The corners are also badly curled. An entry book of actions at the three weekly or small borough court or ' Court of Record ' Montgomery, 1646-1663. The actions are not confined to damages of less than forty shillings. There are also some particulars of the election and swearing in of burgesses and borough officials, a transcript of the form of proclaiming a fair at Mountgomery, and, at the end of the volume, some particulars of estrays; 1660-1665. /3 COURT BOOK Paper; 150 unnumbered folios; 284 x 191 mm.; sewn in parchment; remnant of thong. Thelwall’s troop in Ireland, extracts of particulars of composition money levied in Bachelldre, Weston, and Hopton, and a certificate by the bailiffs of Ludlow that Richard Williams of that town had subscribed the engagement to be faithful to the Commonwealth of England, 1651.
