Question 2: Do you support or oppose the election of judges and why? Municipal Court Judge FTC 1-1-14 Uncontested Race Van Der Karr, Scott 1449 W Lane Ave, Columbus, OH 43221 Municipal Court Judge FTC 1-2-14 (vote for no more than one) McKinley, Kristen 3656 Cannongate Dr, Columbus, OH 43228 Email: mckinleyforjudge@ gmail.com Website: www.kristenmckinley. com Education: Indiana University of Pennsylvania, BA Economics, 1991; Ohio Northern University, JD, 1993 Occupation: Attorney for the Ohio Association of Public School Employees (OAPSE) Qualifications for Office: 20 years of litigation experience in both criminal and civil matters; 13 years representing clients in mayors and municipal courts across Ohio, including Franklin County Municipal Court. Question 1: All citizens should understand and have access to the legal system. Increasing pro bono (free) representation by practicing attorneys in various areas would begin the process of providing better access to legal help and the legal system. Currently, attorneys are not required to provide free representation to qualified citizens. Additionally, making certain that the Court is simple to understand and navigate will increase citizens’ access to the assistance that they need. As a sitting judge, I would work to improve the public’s experience with the legal system and to INDEX promote education and training on the law and legal system. Question 2: I support the election of judges. Electing judges is the only way the average citizen is able to contribute to selecting a judge. It is the citizens that will have the most contact with judges and their courtrooms. They should be able to continue to vote to elect judges. However, if we continue to elect judges, the public should be more informed about the candidates and not base selection on name recognition alone. Access to the internet and digital media may assist with voters being able to learn more about the candidates and I would encourage them to do so. Salerno, Amy 295 W Fourth Ave, Columbus OH 43201 Email: [email protected] Website: www.facebook.com/ reelectjudgesalerno Education: Youngstown State University, B.A. ’79. Occupation: Franklin County Municipal Court Judge (Since 2005) Qualifications for Office: 9 years as Judge; Ohio House of Representatives (1995-2002); Administrative Law Judge (4 years); private practice 23 years; Endorsed by AFL-CIO, IBEW and Building Trades Unions. Question 1: All citizens have a right to competent counsel in our court system. If a citizen is declared indigent, counsel will be provided by the Court. In Franklin County Municipal court we have a talented and dedicated group of public defenders that preserve and exercise these important rights every single day in my courtroom. More attorneys should volunteer at free legal clinics around the country. I’m active in promoting combat veterans with legal help through programs with the Wounded Warrior Project and a new clinic forming at my alma mater, the Ohio State University Moritz College of Law. Question 2: I support the election of judges, such as myself, for a very simple reason: accountability. All X.......................................... X elected officials are entrusted by their constituents to uphold the duties and responsibilities of the office they hold. If a judge or representative is not doing their duty they must have the consequences of an upcoming election. Judges must be held accountable for their performance over their term. I support the six-year terms Municipal Court judges are given currently. Municipal Court Judge FTC 1-3-14 (vote for no more than one) Green, James E. 1084 Cloverly Dr., Gahanna, OH 43230 Email: [email protected] Website: votejudgegreen2013. com Education: B.A., Psychology, University of Akron; J.D., Law, Ohio State University; Post Doctoral Training, Northwestern University Occupation: Judge, Franklin County Municipal Court, 1995-present; Adjunct Instructor, Columbus State Community College, 1987-present Qualifications for Office: Long term experience as a judge and a law instructor. Question 1: Insure that citizens and non-citizens alike are aware of their options for legal counsel. Have patience and be knowledgeable when explaining legal concepts and principles. Question 2: The process by which we elect judges is flawed. A better system is needed. One less political is preferred. Callender, Gwen 8772 Crampton Ave, Powell, OH 43065 Email: gwen@gwencallender. com Website: gwencallender.com Education: BA University of Wisconsin, Madison; JD The Ohio State University, Moritz College of Law Occupation: Attorney Qualifications for Office: Twenty-two years as an attorney for the Fraternal Order of Police, Ohio Labor Council, Inc. Eight years as an elected member of the Dublin City School Board. Former PTO President. Question 1: All citizens should have access to legal help and not feel intimidated to seek that help. The local bar association should seek out social service agencies who serve those who may not know how to access an attorney. Those agencies should inform the citizens, in an informal venue, of how it can provide access to an attorney. Also, working men and women need the option of appearing in court outside of normal work hours. Having a night court would enable those who may otherwise not be able to take off work or afford childcare to access the legal system. Question 2: I support the election of judges. There are few elected offices that have practically unfettered discretion in the use of the power invested in that office. One judge can affect hundreds of lives every single day. The electoral process is the checks and balances on this unfettered discretion. Municipal Court Judge UTE 1-7-16, Environmental Division (vote for no more than one) Macke, Frank 370 Adena Brook Ln, Columbus, OH 43214 Email: [email protected] Website: mackeforjudge.com Education: Ottawa-Glandorf High School (1968); The Ohio State University, B.A. (1972); Ohio Northern University, College of Law, J.D. (1974) Occupation: Self-Employed Attorney since 1975 Qualifications for Office: I have represented individuals and families in and around Franklin County for 38 years, and have been involved in many community service activities and organizations during this time. (over word limit) Question 1: There are several programs available for those with difficulty accessing the legal system, including a pro bono initiative by the Columbus Bar Association and legal clinics at both Capital University and The Ohio State University law schools. Those who choose to represent themselves are frequent users of the Franklin County Law Library and The League of Women Voters of Metropolitan Columbus Educational Fund prepared this material. Candidates were informed of the following: • Each response would be printed exactly as received and each candidate would be responsible for the content of the replies. • All responses were given a word limit, and once the response exceeded the word limit then the remainder of the response was cut off. Information and answers from the candidates have not been evaluated in any way. The League of Women Voters, in presenting this material, neither endorses nor rejects the views of any candidate quoted and does not and cannot assume responsibility for the contents of any candidate’s reply or motive. Considering all that our country has been through in recent times, it is more important than ever that our citizens be informed about the candidates and issues before them. The mission of the League of Women Voters is to encourage the informed and active participation of citizens in government and to influence public policy through education and advocacy. The publication editor is Elizabeth Grieser, with assistance from Amy Pulles, Stuart Wright, Margaret Wright, and Jacob Markey. The LWVMC Education Fund President is Amy Pulles. The information in this bulletin can also be found on the League of Women Voters website at www.lwvcols. org. For membership information in the League of Women Voters, please see our website at www.lwvcols.org. are assisted (although not given legal advice) by court personnel. The Columbus Bar Association encourages members to represent those who cannot afford a lawyer. We should better publicize these initiatives, and look for ways to improve upon them. Question 2: I support the election of judges, and believe that it is a cornerstone of our democracy. Since the adoption of the Ohio Constitution, we have had the power to elect our State’s judges, and that should not be changed. There are Rules of Conduct for the judiciary, and a system for removal. The ultimate test for choosing and retaining a judge is the ballot box. If a fix is needed, it is in how judicial vacancies are filled. Currently, it is by gubernatorial appointment from a list submitted by the party of the governor. Only Governor Strickland did it differently. Hawkins, Dan 630 Lawson Dr, Westerville, OH 43081 Email: hawkinsdaniel@ hotmail.com Website: www.JudgeHawkins. com Education: Bowling Green State University, B.S.(with honors); The Ohio State University College of Law, J.D. Occupation: Judge, Franklin County Municipal Court Environmental Division Qualifications for Office: Hear between 800-1000 cases per month in Environmental Court. Former prosecutor and head of Special Victim’s Unit in Franklin County. 2009 Sheriff’s Award of Commendation. Question 1: The Environmental Court is unique in that many of the litigants who appear before me represent themselves in complaints for housing code violations or unlicensed animals. As Judge, I have taken active steps toward ensuring those who need an attorney are able to consult with one. I also held the first of many “Open House” events down at the county courthouse to help educate the public about how the Environmental Court impacts their neighborhoods as well as provide information about who to contact for help regarding vacant and blighted properties and other nuisances in our community. Question 2: I support the election of judges. As Ohioans, we have elected judges for over 150 years and I believe in the continuation of our fundamental right to hold judges accountable. I believe as a whole our bench in Franklin County is the best in the state and our citizens should not surrender their power to elect judges to an elite few who feel they know what is best for us. Adair, James W. III 1150 Rockport Ct., Columbus, OH 43235 Email: adairforjudge@gmail. com Website: adairforjudge.com Education: University of Cincinnati, B.A. Chemistry 1970; OSU, Moritz College of Law, J.D., 1973 Occupation: Attorney Qualifications for Office: Served thirteen years as counsel for the Ohio EPA; three years as Executive Director of the former Ohio Hazardous Waste Facility Board; and, twenty-three years as general practitioner, including as litigator and state administrative hearing officer. Question 1: A complete consideration of this important question involves the roles of judges, prosecutors, bar associations, attorneys, and many others within the legal system, and consider both criminal and civil proceeding, which analysis is beyond the required limitations of this forum. However, some of the areas within a court’s direct control that would offer citizens greater access are: (1) improved information through the internet; (2) help centers for pro se (self-representing) litigants; (3) greater access to language interpreters; (4) limiting or delaying the payment of court cost in certain civil cases; and, (5) greater use of alternative dispute resolution methods. Question 2: I support the election of judges, as long as political parties do not disenfranchise voters by the parties negotiating with one another to influence which incumbent judicial races are uncontested. For instance, in the 2009 General Election, eight of the nine Franklin County Municipal Court judicial races had only one candidate, including the Environmental Court race. Fortunately, the voters have a much greater choice in the 2013 election because only one of the four Franklin County judicial races is uncontested. Even more fortunate for voter choice is that the race for the Municipal Court’s Environmental Judge has three candidates. City of Bexley Mayor Uncontested Race Kessler, Ben 175 S. Question 1: The office of Columbus City Auditor has no role in the governance of Columbus City Schools. If approved by the voters in November, the City Auditor will assist in selecting an independent auditor for the schools. Once selected, that Auditor should also be independent of the City. Question 2: Because of the willingness of the City’s voters to increase the City’s income tax rate from 2.0% to 2.5% in 2009, Columbus is financially stable. Constant vigilance is necessary to continue this stability. This Auditor will continue to encourage and participate in a disciplined governance over Columbus’ finances. Question 2: I am able to raise the average Columbus resident’s income 3 times. This will solve most city problems. Member of Council (vote for no more than 3) Bainbridge, Brian C 865 Macon Alley, Columbus, OH 43206 Email: brian@ bainbridgeforcolumbus.com Website: http://www. bainbridgeforcolumbus.com Education: B.A. in History Huntington University; Ohio Real Estate License Occupation: Residential Realtor, HER Realtors; Technology Staffing Account Executive, The Eliassen Group Qualifications for Office: 2011 Hilltop Area Commissioner; Franklinton Board of Trade, member; Westgate Neighbors Association, Economic Development Chairman; Lower Lights Christian Health Center, Volunteer; Franklin County Republican Party, member and endorsed candidate. Question 1: I believe the city government should act as an oversight partnership with an independent auditing board. The Columbus City School district has failed both the citizens of Columbus and most importantly our children. The Columbus Education Commission’s “55 Recommendations” hold promise for the district’s future - however I wonder if throwing money at the problem through the 9 mil property tax hike is the right answer. I believe the city needs to do a better job at communication to the voting public the quantifiable goals and milestones before asking us to throw more money into a broken inefficient system. Question 2: As a fiscal conservative, I’m euphoric about the Rainy Day Fund. However, tax burdens and over-spending will take its toll on Columbus taxpayers. We already have the highest income taxes in Ohio at 2.5%, a 2013 increase sales tax, now they are attempting to raise the property tax and an additional bond levy. Enough is enough. My aim is to lower taxes and bring a balanced spending budget to the city. Our city is currently spending million on Olentangy River restoration, while Hilltop, South Columbus and Linden get ignored. It’s time for our resilient neighborhoods to get their share. Lawson, Greg 1508 Meadow Rd, Columbus OH 43212 Email: lawson4columbus@ gmail.com Website: www. lawsonforcolumbus.com Education: B.A. in Communications from The Ohio State University, Minor in Economics Occupation: Public Policy Analyst at the Buckeye Institute for Public Policy Solutions Qualifications for Office: My entire professional career has been dedicated to developing and implementing good public policy ranging from sound taxes to local government reform. Question 1: Given the nature of the data rigging scandal and the many deceptions that have been perpetrated on City taxpayers and, more importantly parents and children in the district, I do believe the City should play a more rigorous role. I believe an outside and truly independent auditor is necessary. I further believe the City should lead the charge for large scale reforms including implementing merit pay for teachers and reallocating existing, as opposed to new revenues, to focus on the challenges so many students have outside school that prevent them from being ready to learn. Question 2: I support the full restoration of the “Rainy Day” fund to around $75 million so that the City can be prudent during unforeseen economic downturns. However, I do not support holding onto revenue just because we can. Fundamentally, we must continue to grow business in Columbus, particularly small businesses, that can help restore the many pockets of the City that still have double-digit unemployment rates. By doing this, we can grow the tax base and increase financial stability without having to raise our rates. Miller, A. Question 1: This November, Columbus residents will vote on the future of our schools and, as a result, the future success of our city. Thanks to the hard work of a diverse Commission engaged with our whole community, we have a package of reforms that voters can enthusiastically support. While some will try to distract us with rumors and speculations, these reforms are not about regulating city schools. These measures are about funding the right priorities, supporting responsible school administration, and providing independent oversight at a time of great challenge and opportunity. I’m proud to support this historic opportunity for our children. Question 2: As the owner of an information technology business, I know how critical it is for companies to utilize technology to save money and increase efficiency. As a City, we are investing in fiber networks to promote connectivity of City information and services and as an economic development tool to attract and retain companies that are providing good, high paying jobs for our residents. My Small & Minority Business Development Committee is partnering with the Economic and Community Development Institute to ensure access to business mentoring programs and capital to help make small businesses successful. Question 1: The last report card for Columbus City Schools demonstrates the challenges we face. While we, as elected officials at the city, don’t regulate the schools, we can’t sit on the sidelines in the midst of this crisis. Thankfully, we’ve all stepped up, labor leaders and business executives, educators and parents, elected officials and interim administrators. Together, we are united behind bold reforms that can bring quality education to all students. Question 2: As chair of the Public Service & Transportation and Utilities Committees, I work to make sure that Columbus coordinates major construction projects with state, county and township agencies to ensure the lowest possible price to complete the project and limit the negative impact of the work on our community. Our capital budget funds tens of millions of dollars each year building new roads, sidewalks, sewers and waterlines. These projects are needed to make sure we are a great 21st century community. Harding Rd, Columbus, OH 43209 Email: Jstaley@triumphcomm. com Website: TysonforCouncil.com Education: B.S. in Business Administration from Franklin University Occupation: Art Gallery Owner and Columbus City Councilmember Qualifications for Office: Current Councilmember with a distinguished career in business, nonprofit management and public service. Lifelong resident of Columbus. Question 1: The challenges with Columbus City Schools threaten the future success of our children. When faced with such a critical challenge, we all have a responsibility to heed the call – as citizens, community leaders, and elected officials. That’s what we’ve done with the Columbus Education Commission. Working together with the entire community, we’ve developed commonsense reforms to bring real change and accountability for our schools. Given the depth of the challenges, we must have a community-wide focus, independent oversight, and bold reforms that are 3 accountable to the families we serve. Question 2: As Finance Committee Chair, I work directly with Mayor Coleman’s Finance and Management Department and our line time City Auditor, Hugh J. Dorrian. Columbus has made tough decisions to align government spending with precious resources to deliver critical City services that provide for safe and strong neighborhoods. City Council remains committed to saving money in our Rainy Day Fund and supports the goal of achieving a balance in the fund of $75 million by 2018. The city of Columbus is expected to have $51 million in the fund by 2014. Schneider, Nick 75 W. California Ave Columbus, OH 43202 Email: schneiderforcouncil@ gmail.com Website: Schneidercampaign. com Education: B.S. in Communication from Ohio University, though I’ve been working on shedding the propaganda spewed all over me. Occupation: Videographer, Citizen Journalist, Small business owner, Nephilim Fighter Qualifications for Office: Personally gathered the signatures required to run for council, and paid my own filing fees. Question 1: If your asking if an appointed for the last 30 years Columbus City Council should take over responsibilities from an elected Columbus School Board, my answer is no. They should act under what authority they have to hold those involved accountable for breaking the law. The city shouldn’t be taking delegated powers away from the School Board. They are elected and derive their authority by the same people who elect council and the mayor. Concentrating powers always leads to less accountability in the future, and sets a bad example for the children. Question 2: Fix the broken At-Large system of representation at Columbus City Council. It’s time we entered the modern era and join every other major city in the United States and have District based representation at City Council. You can’t improve financial stability through central economic planning. It doesn’t work in the long run. It must be achieved organically, with true participation of the citizens and entrepreneurs. Financial stability will never be achieved without acknowledging the nature of inflation. Once the people understand where inflation comes from, our economic destiny becomes one made of the people and not the academic elitists. Ashburn Jr. Youth Center Question 1: Voters elect the CCS Board of Education to serve as macro-level leaders of the District, not micromanagers. The Board’s responsibilities should entail: Accountable decisionmaking/development of HR, finance, and administrative policy; Co-develop a vision and mission for the District that is shared throughout CCS; Hire the best District leadership in the persons of the Superintendent, Treasurer, and Internal Auditor; Establish clear directives via policy and expectations for leadership; and Serve as liaisons between CCS and all community stakeholders. The Board must also assist with creating systems that encourage a culture of organizational learning, flexibility and effectiveness. Question 2: Fiscal stability begins with changing the way budgets are decided. The forecast should be three-years instead of five. This would more accurately align with the state biennial budget approval process and better determine what the District will receive. Secondly, CCS can adopt a zero-based budgeting process that targets specific priorities like curriculum, staff, capital improvements, transportation, etc., while helping the District live within its means. This would also include investigating employees cost savings in healthcare and work streamlining. Thirdly, CCS should create a surplus or rainy day fund that limits the need for tax levies every four years. Corner, Beverly J. 3589 Norwood St, Columbus, OH 43224 No survey received. The Superintendent is accountable to the Board. However, it is imperative that the Board of education is on one accord in asking questions and giving clear direction through policy creation. Question 2: Believe it or not, the District has historically been financially stable. (with the help of local tax payers) To ensure this legacy continues, I believe we must continue to monitor, assess, and spend wisely, while still providing each and every student with a 21st Century Curriculum. School funding plagues most districts and thereby making it a challenge to operate without other funding sources. (State and Federal) I will remain steadfast on ensuring that these funds are carefully allocated for students’ progress. Paretti, Dominic 522 1/2 S. I am a member of the CCS Board of Education External Monitoring Committee, and I (over word limit) Question 1: The board should have a mutual relationship with the superintendent and not simply be a rubber stamp for all policies and budgets. In order to have a mutual working relationship, the board must be engaged and ready to do the hard work necessary to improve the school district academically. The board has to balance the superintendent’s agenda, the Mayor’s Education recommendations, and their own board agenda. being a member of the board means more than just attending the mandatory twice-a-month board meetings. I look forward to having a robust and continuous relationship with the superintendent. Question 2: The school district must be willing to do all it can do reduce overhead, waste, fraud and duplication. Passing the levy and implementing the independent auditor will be a step in the right direction. The board must continue to make the necessary changes outlined by the Mayor and the Education Commission, by reducing its total budget by $200 million over the course of five years. These changes will allow more transparency with our tax dollars and improve academic progress by pin pointing areas where more investment would be needed in our classrooms. Question 1: The Board’s role includes providing support and adopting policies that lead to increased student achievement. We should “stay out of the weeds”, allowing the District to carry out day-today operations while holding senior officers and other administrators accountable. I asked the Interim Superintendent to review and communicate to the Board about: Ensuring financial stability; Increasing public/ parent/teacher interaction and communication. 7 Reviewing, recommending, and implementing procedures that specifically address our data. Recruiting, training and retaining high-quality teachers and principals. Providing support and resources for teachers. Offering autonomy and accountability at the school level to improve leadership. Question 2: I support approving the 9.01 mil levy and an independent auditor on the November ballot. We have a historic opportunity for improving Columbus City Schools, while laying the groundwork for making charter schools work for students, parents, and taxpayers. This one time opportunity: funds proven research-based strategies to help students succeed; sets aside dollars to recruit and retain our best school leaders; pledges the district to reduce expenses by $200 million over the next five years; allows sharing local dollars with highly rated charter schools that will allow for replication of effective high-performing schools in Columbus. I know & appreciate the struggles of trying to learn, work, & raise a family in Columbus because I live it, and provide that viewpoint to the BOE. Question 1: The Board should chart the course of the District with input from parents, students, neighborhood residents, staff, neighborhood businesses, and civic leaders and enact control that requires the Superintendent stays true to the course as set. The Board needs to be the active watchdog over taxpayers dollars and district assets, require proof of benefit before spending. Research all information given and look at all sides of an issue then vote on the staff recommendations, not simply concede the information supplied is true. Allow the Superintendent to run the day to day operations with strong leadership not followship from the board. Question 2: Establish a “Rainy Day Fund” sufficient enough that if state/federal funding is cut or tax revenues go down we don’t have to immediately start cutting the budget in “crisis mode” running to the voters for a bailout. I would stop paying both the consultants and the administrator that hires them, one or the other. Educational Service Center City of Columbus Ballot Issues Ballot Issue 50 Columbus City School District – Proposed Bond Issue and Tax Levy Explanation Issue #50 authorizes the School District to: (1) (a) issue bonds in the principal amount of $175,000,000 for the purpose of paying the local share of the state school construction program and making other school improvements; and (b) to levy a 1.01 mill property tax to pay the annual debt charges on the bonds. (2) levy an additional 8 mill property tax for the current expenses of the school district including an independent auditor, early childhood education, expanding and replicating high performing district schools, and hiring, retaining and training high quality teachers. One mill is to be allocated to partnering community schools. The additional property tax contained in Issue 50 will be 9.01 mills and will cost owners of residential property an additional $315 per year per $100,000 of valuation in addition to the current $1,328.00 per $100,000 of valuation. Arguments that have been made in support of Issue 50 Issue 50 will implement the Columbus Education Plan, a comprehensive plan which is based on accepted best practice in education reform. The Plan and Issue 50 are supported by a coalition of civic and business leaders who have made a new commitment to improving the Columbus City Schools. · Investing more resources in the Columbus schools is a fair and effective way to reduce poverty in Columbus. Arguments that have been made in opposition to Issue 50 · The Columbus City Schools have been failing primarily because of poor administration. Voters should not be asked to vote on a new levy until there is evidence that things have improved. · Given the current income level for many District voters it is totally unreasonable to ask them to approve a 24% increase in the property tax for schools. · Allocating property tax money to charter schools (labeled as “community schools” on the ballot) is a major change in public policy. Voters should be given the chance to vote on this idea separately. Ballot Issue 51 Columbus City School District - Establish the Position of Independent Auditor Explanation Issue #51 authorizes the School District to create the position of independent auditor. With approval, the selection of this person will be determined by a committee consisting of the mayor of the City of Columbus, president of the school district board of education, council president of the City of Columbus, auditor of the City of Columbus, and probate court judge of Franklin County. This individual will serve an initial term of five years, subject to reappointment or succession. The Columbus City School District will be responsible for compensation for the independent auditor and the cost of this auditor’s operations and functions. An estimated $1 million per year, according to the Columbus Board of Education Millage Committee, will be allocated to fund an independent auditor, staff, and operations. Arguments that have been made in support of Issue 51 · Creation of an independent auditor will ensure integrity of all financial, performance, and data reports to state and federal agencies. · Removing total control over district audits from Columbus City Schools will increase public confidence. Arguments that have been made in opposition to Issue 51 · An additional district auditor with a staffed office is an expensive duplication and creates more administrative bureaucracy. · Establishment of an independent auditor funded completely by the district but appointed mostly by elected officials outside the district, weakens control of an elected school board.
