VENDOR, EXHIBITOR AND HOSPITALITY SITE RULES AND REGULATIONS
All vendors must register online at www.H2OMGfest.com.
Payment for non-food vendor space is required with your registration and is non-refundable.
Food vendors are required to pay a refundable $250 deposit with registration.*
We will make best available placement on a first-come basis.

GENERAL INFORMATION
SETUP/TEAR DOWN:
 All exhibitors MUST check in before setting up any part of their booth or stand.
 Setup hours will be Wednesday, February 22 from 2-8pm and Thursday, February
23 from 9am– 1pm.
 Tear down will take place on Sunday, February 26 from 6–9pm and Monday,
February 27 from 8–10am.
 Absolutely no vehicle access will be permitted during festival operating hours.
HOURS OF OPERATION: It is important to offer our guests the full H2OMG Festival
experience. Therefore, there will be no refunds (including deposits) if the exhibitor chooses to
move out early. On event days, vendors are expected and required to be open, staffed and
ready for business when the gates open and are required to operate continuously until
designated closing times. Closing early is not permitted and we encourage you to stay open
later than the end of racing for the day to serve the remaining patrons. Vendors shall not tear
down of exhibits in the exposition building until the public has cleared the facility after
designated closing time. Release forms are not required for load out. Vendors are solely
responsible for any and all property left on the grounds after 10am on Monday, February 27,
2017.

EXCEPTIONS: The Vista Point Zone, West Pits Hospitality Zone and Lake
Pleasant Regional Park Discovery Center areas will not be open on Thursday,
February 23 and close at 6pm daily.
ADMISSION/PARKING: Non-food vendors will be provided with two (2) daily admission
tickets (8 total) and two (2) daily parking passes (8 total). Food vendors will receive four (4)
daily admission tickets (16 total), four (4) daily parking passes (16 total) and one (1) special
permit lot pass. Anyone working a booth must have a pass or must purchase one to
enter the festival. No exceptions.
ACCESS TO PREMISES: Vendors shall allow access to premises for H2OMG Festival
Management plus public safety personnel at all times.
TEMPORARY STRUCTURES: All vendor stands must be designed to withstand high winds
(gusts) without creating a danger to the public. Any obstruction or obstacle that is deemed
by Festival Management to represent a hazard must be immediately corrected. All
temporary (e.g., tents, shade coverings, etc.) shall be anchored in accordance with the
manufacturer’s specifications or in a manner as approved by the Vendor Coordinator or
other designated person.. All structures are subject to inspection and approval by the
City of Peoria. All holes made for these structures must be filled and repaired accordingly.
Side walls are recommended for wind protection and overnight security.
DELIVERIES: No shipments shall be received by H2OMG Fest LLC prior to specified dates.
Any deliveries expected during the festival shall be directed to and picked up at areas
designated by the H2OMG Festival staff.
LOUD SPEAKERS/AMPLIFIED SOUND: No public address systems, loud speakers,
amplifiers, broadcasting devices, music or other objectionable method shall be used by
vendor or his/her employees if it interferes with other booths or operation of the
festival. Consult with the Vendor Coordinator if you have questions.
SIGNAGE: Exhibitor’s signs advertising their products shall reflect the true image of the
product being sold. Example: accurate thread counts of sheets, logos or brands advertised
must be authentic. Food vendors shall post in a conspicuous manner at the front entrance
to place of business, a sign showing the price to be charged for food, meals, beverages, or
other articles to be sold. Absolutely no hand-written signs are permitted!
SOLICITING OUTSIDE OF ASSIGNED BOOTH: Soliciting in areas outside of assigned
booth is prohibited. Booths must keep all personnel, product and equipment within the
line limits of their booth. Violators are subject to contract cancellation, forfeiture of
rental fees and removal from festival site, plus may not be offered a contract for the following

year(s).
LICENSING/PERMITS: All vendors are required to operate under all applicable local,
state and federal regulations. These include (but is not limited to) business licensing,
health department permits, reseller’s permits, etc. Any vendor in violation may be
closed.
SALES TAX: Vendors shall be responsible for all city and state sales taxes including licenses
to conduct transactions.
SECURITY OF BOOTH: Security within your exhibit is your responsibility and yours alone.
Merchandise and contents including personal property should be secured at all times.
Insurance should be obtained by the exhibitor/vendor against loss and or damage. Neither
H2OMG Fest LLC nor its employees, servants or agents shall accept or be responsible in any
way for the property of the exhibitor or vendor.
TRASH REMOVAL: All vendors shall keep their space and areas clean and trash free.
Vendors are requested to sweep their spaces each night and after closing. Trash barrels,
containers and compactors shall be placed in suitable locations throughout the grounds for
frequent collection.
ALCOHOLIC BEVERAGES AND ILLEGAL DRUG USE: NO alcohol is permitted at a
vending site at any time. No ale, beer, wine, or other intoxicating beverage of any kind shall
be kept, sold or given away by any vendor or any of their employees. Vendors are not
allowed to consume alcoholic beverages, be intoxicated, or exhibit the aftereffects of
excessive alcohol consumption while “on the clock.” Operating your booth space while
consuming alcohol or while intoxicated is grounds for immediate dismissal and security
deposit forfeiture. Illegal drug use in any form will not be tolerated and similarly result in
immediate dismissal and security deposit forfeiture.
ANIMALS: Animals shall be prohibited from being around or in any space location. All pets
shall be kept inside their owner trailer or closed living quarters. If the pets are outside, the pet
shall be leashed with the person responsible for the animal controlling the leash. Pet owners
shall be required to pick up after their pets whenever deposits are made by the pet. Pet owner
liability shall be the total and complete remedy of any and all claims involving animals.
VIOLATIONS: If a violation of any rule or contract is noted, an infraction ticket will be
written and left on site. Violations may result in immediate closure of the site or disallow a
return in subsequent years.
FOOD VENDORS ONLY
VENDING PRIVILEGE COMMISSION: A twenty percent (20%) vending commission
will be charged to all participating food vendors. Payment of this fee is due (via cash or
check) at the Vendor Office no later than 12 Noon on Monday, February 27.

*DEPOSIT: A $250 deposit is due with your online registration. The deposit will be
credited towards your payment to H2OMG LLC upon final settlement. However, any
damage to the facility or excessive refuse may result in a deduction. The deposit is
nonrefundable if you are a no-show for the event or not open during the hours of operation.
CASH REGISTERS: All sales must be recorded by use of an approved cash register. So
that accurate records can be kept, sales cannot be made from an open cash box, apron or off
the counter. Each cash register is required to provide the following:
 Legible detail tape set with current date and time.
 Digital visual indicator so prices are in plain view as they are rung up.
 Consecutive transaction number.
 Cumulative “Z” counter.
 “X” reading.
 Grand Total counter that cannot be reset.
 Key protector.
 PLU-Price Look Up/Preset Keys must be set separately for each item being sold,
even if the price is the same.
DAILY GROSS RECEIPTS & Z REPORTS: A daily gross receipts report stating the
previous day’s sales must be turned into the Vendor Office no later than 12 Noon the
next day. A daily Z report tape from a cash register is required and attached securely
(stapled, not paper clipped) to the daily gross receipt report that gives a breakdown
and accounting of all sales activity for the day.
BEVERAGE EXCLUSIVITY: The festival possesses contract obligations related to the sale of
all beverages. We will provide contact information on how to order product in advance
of the event. Any exception needs to be approved by the Vendor Coordinator.
PROPANE TANKS: Propane tanks/cylinders are to be secured from movement. Propane
hoses are to be listed for propane use and free from damage.
SANITATION: Under no circumstances is grease or any solid waste material to be poured
into rubbish barrels, dumpsters or drains. All waste water must be disposed of at an
approved location. Check with the Vendor Office for the location of grease/oil/wastewater
dumping stations. Sanitary conditions must be maintained by placing all refuse in garbage
containers and cleaning around their area when necessary.
FOOD TRUCKS/TRAILERS. All food trucks/trailers will need to comply with the following
requirements. Food trucks/trailers that do not comply will not be allowed to remain at the
event.

Where cooking produces grease laden vapors, a Type 1 exhaust hood is required.
The exhaust hood/duct system must clean and in proper working condition.

Where cooking produces grease laden vapors, an automatic fire suppression
system is to be installed to protect the exhaust hood, duct and cooking appliances.
All automatic fire suppression systems are to have a current inspection tag(s)
and/or paperwork and be free from any deficiencies. Tags and/or paperwork are
deemed current if the inspection was conducted within the last six (6) months.
A Class “K” portable fire extinguisher is required anytime an automatic fire
suppression system is present. A current inspection tag or paperwork is required.
Tags and/or paperwork are deemed current if the inspection was conducted within
the last twelve (12) months.
A minimum 2-A:10-B:C rated dry chemical fire extinguisher is required. A current
inspection tag or paperwork is required. Tags and/or paperwork are deemed
current if the inspection was conducted within the last twelve (12) months.
A pressurized water fire extinguisher (2-1/2 gallon), or approved water source, is
required anytime a solid fuel (wood, charcoal, etc.) is used for cooking. A current
inspection tag or paperwork is required. Tags and/or paperwork are deemed
current if the inspection was conducted within the last twelve (12) months or
purchased new within the last twelve (12) months.
All internal generators are to be properly vented away from the vehicle.
OUTDOOR COOKING. Where outdoor cooking is conducted, outside of food trucks or
trailers, it will need to comply with the following requirements. Outdoor cooking that does
not comply will not be allowed to remain at the event.
 No open flames or cooking are allowed under tent canopies.
 A Class “K” portable fire extinguisher is required anytime a deep fryer (any type) is
present. A current inspection tag or inspection paperwork is required. Tags and/or
paperwork are deemed current if the inspection was conducted within the last
twelve (12) months or purchased new within the last twelve (12) months.
 A minimum 2-A:10-B:C rated dry chemical fire extinguisher (5 – 6 pound size) is
required. A current inspection tag or inspection paperwork is required. Tags
and/or paperwork are deemed current if the inspection was conducted within the
last twelve (12) months or purchased new within the last twelve (12) months.
 A pressurized water fire extinguisher (2-1/2 gallon), or approved water source, is
required anytime a solid fuel (wood, charcoal, etc.) is used for cooking. A current
inspection tag or paperwork is required. Tags and/or paperwork are deemed
current if the inspection was conducted within the last twelve (12) months or
purchased new within the last twelve (12) months.
 No smoking is allowed under the canopies and must be posted.
 Generators are to be kept a minimum of twenty (20) feet from any canopy.
 Electrical cords are to be free from damage. Any damaged cords are to be replaced.
 Propane tanks/cylinders are to be secured from movement. Propane hoses are to
be listed for propane use and free from damage. Any damaged hoses or hoses not
listed for the proper use are to be removed.
 A “back of house” area must be created using caution tape or some other form of
barrier to prevent the public from coming in contact with the cooking appliances.

INSURANCE: ALL VENDORS, EXHIBITORS AND HOSPITALITY SITE HOSTS will
provide a certificate of insurance wherein H2OMG Fest LLC and its agents are additional
insured for ongoing and completed operations via a comprehensive general liability
endorsement or commercial general liability in the minimum amount of $1,000,000
($2,000,000 for Food Vendors). All vehicles must also be insured as outlined below.
The Certificate of Insurance must be on file at the Vendor Office prior to setup.
You will not receive your vendor packet nor be allowed to set up without the certificate of

The following statement should be present on the endorsement:
o “H2OMG Fest LLC and its agents are named as additional insureds for ongoing
and completed operations. The general liability insurance evidenced above is
primary and non-contributory. Any coverage carrier by the additional insured is
excess and shall not contribute. Waiver of subrogation applies on behalf of the
additional insureds for general liability and worker compensation.”
APPLICATION INFORMATION
H2OMG Fest LLC is an Idaho Limited Liability Company doing business as “H2OMG
Festival.” All vendors must have a contract with H2OMG Fest LLC. Each contract is
specifically written for the spaced leased. DO NOT HAND WRITE ITEMS INTO YOUR
CONTRACT. Exhibitors are bound by the items of their contract, which include the
information and rules in this document.
The contract for each exhibit shall be issued only to the owner of the exhibit. Contracts issued
are non-transferable. The misrepresentation of ownership, operation, appearance of any
exhibit or the subletting of space in any manner shall be considered breach of contract and

grounds for the cancellation of the vendor’s contract and the immediate removal from the
H2OMG Festival.
Completing our application does not guarantee participation and/or acceptance into the
H2OMG Festival. Applications will be reviewed and submissions will be accepted until all
spaces are filled. Fully completed applications will be reviewed first.

CONNECTED WITH OR INCIDENT TO THE H2OMG FESTIVAL. MANAGEMENT
FURTHER RESERVES THE RIGHT TO DETERMINE UNFORESEEN MATTERS NOT
COVERED BY THESE RULES AS IN ITS JUDGEMENT IT MAY DETERMINE NECESSARY.
