of the South Park Township
Board of Supervisors
July 13, 2015
Pledge of Allegiance
Roll Call
Dave Buchewicz presiding. Board member Walt Sackinsky was
present. Also in attendance were: Karen Fosbaugh, Township
Manager and Paul J. Gitnik, Esq., Township Solicitor. Board
Member Ed Snee and Chief Dennis McDonough were absent.
Two or more members of the Board of Supervisors were together on
the following occasions which ma}' or may not qualify as an
administrative action(s), conference(s) and/or executive sessions(s):
Monday, June 8, 2015 - After the regular meeting of the Board of
Supervisors held on June 8, 2015 to discuss personnel matters.
Monday. June 22, 2015 - Litigation and personnel matters.
Tuesday, June 30, 2015 - Litigation and personnel matters.
Monday, July 13, 2015 — Prior to the regular meeting of July 13,
2015 to discuss personnel matters.

Call on the People
Dave Oyler, 3321 Brownsville Road Ext. - Mr. Oyler reported on
the Greenway Sojourn, which came through the Township on June
25th. He stated that approximately 300 bicycle riders came through
the Township between 11:00 a.m. and 2:00 p.m. Mr. Oyler
distributed handouts to the Board members and discussed the
various photographs taken during the event. He also discussed an
article hi the Post-Gazette relative to grants for Trail Towns, and
stated that South Park Township could be a potential Trail Town.
He explained that the Township has an approximate 30 mile stretch
of open area, and there is under-utilized real estate which could be
used to build businesses to cater to the trail riders. Mr. Oyler

mentioned that the "T" could potentially bring riders to our area
from Pittsburgh, and the connecting trail which brings riders into the
County Park is an added incentive. He encouraged the Board to
consider contacting Trail Town representatives and looking into
making South Park Township a Trail Town. Mr. Oyler further
explained that the Montour Trail will eventually become part of the
National Trail, and it also acts as the access trail for the Great
Allegheny Passage to the Pittsburgh International Airport. He stated
that there is potential for quite a bit of traffic throughout the
Township. Mr. Oyler thanked the Board for their time and offered
to provide contact information for the Trail Town program. Mr.
Buchewicz asked that Mr. Oyler send him and Mrs. Fosbaugh the
information.

Bill Kelly, 6559 Zupancic Drive - Mr. Kelly complained about
noise on July 4th. He explained that from 8:00 p.m. until past 11:00
p.m. there were sustained explosions. Mr. Buchewicz asked if he
contacted the Police. Mr. Kelly replied that he did not, and he asked
if there is a Noise Ordinance. Mr. Buchewicz replied that the
Township does have a Noise Ordinance. Mrs. Fosbaugh responded
that Mr. Kelly should speak directly to Chief McDonough, who is
currently attending a conference. Mrs. Fosbaugh stated that she will
provide Chief McDonough with Mr. Kelly's contact information.
Mr. Kelly mentioned that former Library Director, Sharon Bruni,
has been very helpful, and he is disappointed to see her go.
Cindy Atchison, 3121 Southern Drive — Mrs. Atchison discussed
an on-going problem with suspicious traffic on Southern Drive.
She explained that she has provided license plate numbers, dates and
times and is frustrated that the activity still continues. Mr.
Sackinsky responded that there is an on-going investigation and
assured Mrs. Atchison that the Police have been using the
information she has provided. Mrs. Atchison continued to express
her frustration and concern about the safety of the children on the
street. Mr. Buchewicz stated that the Board and Mrs. Fosbaugh will
meet with Chief McDonough next week regarding the matter. Mrs.
Atchison stated that she will provide the recent license plate
numbers that she has acquired. Mr. Gitnik mentioned that if there
are repeat vehicles on her street, she should also provide that
information to the Police. Mrs. Atchison continued complaining
about an incident that occurred at 3:30 a.m. last Saturday. She
explained that there were people outside yelling, screaming and
blowing a car horn. She contacted the Police wrho arrived shortly
after her call. Mrs. Atchison stated that two police officers spoke to
two girls who did not live there, but did not speak to the
homeowner. Mr. Buchewicz stated that they will continue to try to
resolve the situation.

Denis Kowalski, 3120 Southern Drive - Mr. Kowalski stated that
he lives directly across from the house in question on Southern
Drive. He discussed the on-going traffic and excessive noise. Mr.
Kowalski explained that at 3:00 a.m. to 3:30 a.m. there have been
approximately a dozen people in the front yard and out in the street,
yelling, screaming, and cursing. He mentioned that one evening,
while he was sitting on his front porch, a man was walking back and
forth in front of the house. He approached Mr. Kowalski and told
him that his neighbor is a crack dealer, and his girlfriend left him
and his child and is currently in his neighbor's house. The man
asked for a screwdriver, so that he could remove the license plate, so
that his girlfriend could not drive the car. Mr. Kowalski continued
discussing another incident that took place in the middle of the
night, where he wras again approached by several people, but was
not sure of their intentions. Mr. Kowralski expressed his concern
that there may be retaliation. Mr. Buchewicz mentioned that a
reporter is present, and he does not want to jeopardize the
investigation. He reiterated that he will be meeting with Chief
McDonough, regarding the situation, on Monday.
Cindy Atchison - Mrs. Atchison added that the cars are stopping
two houses down from her house. She stated that Barbara Durost
told Mrs. Atchison that they call someone on their cell phone when
they are parked in front of her house. Afterwards, they pull away
and go around the bend onto Shortlee Drive. Mrs. Atchison
described another incident where a car parked in front of her house.
When her husband inquired as to what they wanted, they started the
car and left. They came back 1/2 hour later with a damaged left rear
quarter panel. Mrs. Atchison stated that the situation is getting
worse. Mr. Sackinsky restated that they will meet with Chief
McDonough to determine the status of the investigation.

Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
the minutes of the regular meeting of the Board of Supervisors held
on June 8, 2015. All members voted aye. Motion carried.
Action on Invoices
Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
the invoices for the month of June, 2015. All members voted aye.

Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
the Non-Exclusive License Agreement by and between the
Township of South Park (Grantor), and Richard and Charlotte
Cleaver (Grantees), to permit the construction of a fence over a
storm sewer easement located on Lot No. 16 of the Markiewicz
Plan, Lot and Block No. 1010-P-294, being 2809 Stanley Street,,
and authorizing the appropriate Township officials to execute said

Agreement. All members voted aye. Motion carried.

and Michele Whelan
Motion by Mr. Sackinsky. seconded by Mr. Buchewicz to approve
the Non-Exclusive License Agreement by and between the
Township of South Park (Grantor), and John R. and Michele LipaWhelan (Grantees), to permit the construction of a fence over a
drainage easement located on Lot No. 207 of the Piney Ridge Manor
Plan No. 2, Lot and Block No. 884-E-18, being 2493 RidgeRoad,
and authorizing the appropriate Township officials to execute said
Agreement. All members voted aye. Motion carried.
Mr. Sackinsky informed the Cleaver's and the Whelan's that by
signing the agreement, they acknowledge that the Township has the
right to take down the fence in order to do any necessary work in the
easement and are not obligated to restore the fence.

Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
granting the release of the cash bond in the amount of $16,666.66
posted in accordance with Act 98 to guarantee the completion of the
corrective measures, being the demolition and site restoration,
associated with the home located at 6077 Pleasant Street which was
severely damaged by a structure fire, as requested by the property
owner Andrew W. Knuth III in correspondence dated June 25, 2015.
All members voted aye. Motion earned.

Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
the Land Development Agreement by and between South Park
School District and the Township of South Park, the purpose of
which is to guarantee the completion of the site improvements for
the project identified as the South Park School District Land
Development - Addition and Alteration to the South Park Middle
School, located at 2500 Stewart Road, and authorizing the
appropriate Township officials to execute said Agreement. All
members voted aye. Motion carried.

the Storm Water Facilities Maintenance and Monitoring Agreement
by and between South Park School District and the Township of
South Park, the purpose of which is to guarantee the proper
construction, inspection, operation, maintenance, repair, elimination,
monitoring and/or replacement of the on-site facility. The
Agreement is associated with the project identified as the South Park
School District Land Development - Addition and Alteration to the
South Park Middle School located at 2500 Stewart Road, and
authorizing the appropriate Township officials to execute said
Agreement. All members voted aye. Motion carried.

Council
the Land Development Agreement by and between the Montour
Trail Council and the Township of South Park, the purpose of which
is to guarantee the completion of the site improvements to the
project identified as the Montour Trail Council Minor Land
Development, Pleasant Street Extension, Phase 8A4, located at
Pleasant Street, with the following condition:
1. The General Contractor that is awarded the project shall be
responsible for posting the Performance Bond in the amount of
$493,589.85 prior to the commencement of any construction
activities;
and authorizing the appropriate Township officials to execute said
Agreement. All members voted aye. Motion carried.

Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
Application for Payment No. 3 as submitted by Insight Pipe
Contracting, L.P., in the amount of $85,834.07, for the work
completed to date on the project identified as the 2015 Sanitary
Sewer Rehabilitation Project, as recommended by the Township
Engineer. All members voted aye. Motion carried.

Painting Bid Package
Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to approve
the Proposal submitted by the firm EPM Architecture at a cost not to
exceed $5,000 to prepare the bid documentation for the exterior
painting of the South Park Township Municipal Complex. All
members voted aye. Motion carried.

the preparation and advertisement of bids for the project identified

Painting Work, scheduling the bid opening for Tuesday, August 4,
2015, at 10:00 a.m., with action on said bids anticipated to take
place at the regular meeting of the Board of Supervisors scheduled
for Monday, August 10, 2015. All members voted aye. Motion
carried.

Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to ratify'
final payment to the Victor Paving & Construction, Inc. in the
amount of $18,902.90 for the project identified as the 2014 Road
Program, as recommended by the Project Engineer. All members
voted aye. Motion carried.

resignation of Sharon Bruni from her position as the Library

Chapter 107, Article XIII, of the Code of the Township of South
Park, being "Sewers," as it relates to certification and municipal lien
letters, with action on said Ordinance anticipated to take place at the
regular meeting of the Board of Supervisors scheduled for August
10,2015. All members voted aye. Motion carried.
Motion by Mr. Sackinsky, seconded by Mr. Buchewicz to authorize
the attendance of Sgt. David Starzynski to a training session with
regard to a defensive driving course sponsored by the National
Safety Council which will be held in New Stanton, PA on August
12, 2015, at no cost to the Township. All members voted aye.

Mr. Buchewicz - Mr. Buchewicz commended Sharon Bruni for her

professionalism and good job as Library Director, and commented
that the Township will miss her. Mr. Buchewicz hopes that her
replacement will be equally as dedicated.
Charlotte Cleaver, 2809 Stanley Street - Mrs. Cleaver inquired as
to who will be Sharon Bruni's replacement. Mr. Buchewicz replied
that the Township is currently taking applications. Mrs. Fosbaugh
added that Librarian Jeff Connolly will be temporarily serving as
Interim Library Director until a replacement is hired.
