MSSA Constitution Commission Final Recommendations on Proposed Constitutional Amendments – To Be Included on April 11, 2017 General Election Ballot ___Yes ____No ____ Abstain Amendment #1 - President & Vice President Candidates as Teams Amend the Constitution of the Student Association by adding to Article III, Section 1 (underlined section indicates amendment): The President and Vice President shall be elected at-large, and they shall run and be elected as a pair or unified ticket. Independent candidates for President and/or Vice President shall not file for solo candidacy. ____No ____ Abstain Amendment #2 – Clarifying the 10% Participation Rule ___Yes Amend the Constitution of the Student Association by substituting language in Article IX, Section 2 which would better ensure that future Constitutional Amendment Proposals are not subject to an unwieldly ratification requirement. Modify this existing language “by a simple majority of a number equivalent to at least ten (10) percent of the non-extended campus students . . . The simple majority is to be calculated from the most recent non-summer session enrollment figures.” To meet the minimum 10% participation threshold all General Election Ballots cast are all to be counted together whether or not they indicated “yes,” “no,” or “abstain” on each proposed amendment. Eliminated from each amendment’s final ratification result would be all “abstain” votes cast. Ratification of an amendment is then determined by a simple majority of the addition of only the “yes” and “no” ballots cast. ___Yes ____No ____ Abstain Amendment #3 – Constitution Housekeeping Changes Amend the Constitution of the Student Association by addition, substitution, and/or deletion all relevant Articles to address these “housekeeping changes”: Remove “Undeclared Senators” language substituting “At-Large Senators” to reflect that the “Undeclared Major” voting constituency no longer exists; Eliminate duplicative line about the Centennial Student Union Board election, and formalized Student Union Director an ex-officio nonvoting Board member to ensure communication in the long-term; Abolish “Limited Voting” restrictions so voters have freedom to vote on each open Senator seat in given categories; Ensure that the Senate can act to fill a Senator vacancy during the 2nd meeting following meeting where vacancy was declared in the meeting agenda; Reformat Article V on Independent Boards & Commissions to highlight a “Section 2: Judicial Commissions” which already includes the Constitution Commission, the Ethics and Standards Commission, and the Elections Commission.
