Professional judgement versus legal liability
Issues can arise from time to time during engineering projects. It is a
situation that every engineer could find themselves in. Engineers Australia
would like to invite members of the engineering and legal fraternities to
participate in a forum discussing project issues/risks and ways to minimise
their impacts.
Hear from keynote speakers as they describe first hand experiences in
dealing with issues that they have been faced with. Learn from the strategies
they have adopted to overcome issues and explore how these can be
principles can be applied elsewhere.
This is an excellent opportunity to hear from experienced professionals
speaking candidly about engineering and legal issues they have faced and
their results.
About the Speakers
Jan Hayes, Associate Professor - RMIT University
Dr Hayes has 30 years’ experience in safety and risk
management, her current activities cover academia,
consulting and regulation. She is an Associate Professor
at RMIT University where she is Program Leader of the
Energy Pipelines Co-operative Research Centre. Dr
Hayes is a member of the Advisory Board of the
National Offshore Petroleum Safety and Environmental
Management Authority.

Brendan Donohue, Civil Engineer Consultant
Brendan Donohue was the Project Director on the $1.1
billion Lane Cove Tunnel Project. Donohue holds both a
Bachelor of Civil Engineering (Hons 1st Class), and a
Masters in Engineering Science. Donohue specialises in
assembling, leading and motivating high-performance
teams on noteworthy projects such as the NBN Rollout,
the Hunter Expressway, the Victorian Desalination
Project, and the Royal Prince Alfred Hospital
Redevelopment.
Steven Goldstein, Barrister – Edmund Barton Chambers
Steven Goldstein graduated from the University of
Sydney in 1975 with a Bachelor in Civil Engineering.
After a successful career in building and construction,
Goldstein retrained in Law and was admitted as a
barrister in 1993. Goldstein specialises in building and
construction law and alternative dispute resolution.
Goldstein has acted as a Supreme Court appointed
Referee, Grade 1 Commercial Arbitrator, District and
Local Court arbitrator, Expert Determiner, District
Court appointed Referee, mediator and Dispute
Avoidance Board member. Goldstein held the position
of NSW Chapter Chair for the Institute of Arbitrator &
Mediator Australia, and is a Member of the
Construction Law Committee.
