Dear Guy
Have you been able to consult with your client with respect to the north elevation
windows?
In addition I have been investigating the status of Ash Close following the receipt of
objections to the development. It appears that the Close is not an adopted highway.
Could you therefore confirm that your client has control of the access along Ash Close
and through the car park to the application site.
Yours sincerely,

Hi Tim
Whilst I still have to consult my client I have been considering the query regarding the windows
to the north elevations and wondered whether we may keep them if they are obscure and fixed
lights? Operationally I understand that the windows work in the proposed position and I have
concerns over the vulnerability of low level windows to the west elevation.
We have no details regarding he soft landscaping at present, please would you condition as
necessary.
Kind regards
Guy

Hello Guy
As the application determination date is 1st October 2015 it would be appreciated if you
could agree an extension of time for determination of the planning application for a
further 2 weeks (to 16th October 2015) to allow this issue to be resolved.
Meanwhile have you worked up any soft landscaping details? If you have this could
avoid a condition requiring the submission of further detail.

Hi Tim
I will consult with my client and be back to you as soon as possible but he is out of the office
until Friday.
He was happy to accept a condition reducing the brightness of the signage form the 1600 applied
for to the 800 set out in the highways guidelines.
Kind regards
Guy

Thank you for your call this morning during which you undertook to consider a reduction
in the lighting level of the adverts to no more than 800 cd/sq m as requested by the local
highway authority (Derbyshire County Council).
In working through the application details and comparing then to those previously
approved on this site it is apparent that previous approvals had no windows on the
northern elevation (the elevation which faces the adjoining dwellings) to prevent the
potential for overlooking and disturbance,.
In view of the distances involved please will you consider the removal of these windows
to prevent the potential for overlooking and loss of privacy and the increased potential
for noise disturbance from the gym. If windows are required perhaps they could be
placed in the west elevation.
Please give me a ring if your wish to discuss the above.
Yours sincerely,
