In Spain the term active population refers to people 16 years or more
who provide the labour force for the production of goods or services or

This comprises of the Ministries/Independent Services, but not the
military, the judiciary, the police, the army, local authorities or legal
entities of public law. The term “wider public sector” comprises all
of the above.
In Austria, a distinction between “civil servants” and “contract staff”
must be made. Civil servants are employed by virtue of a sovereign act
called “appointment”. As a rule, appointment is for life.
The legal status of “contract staff” is comparable to that of wage
earners and salaried employees in the private sector. When talking
about both groups without differentiation they are called “public
employees”.
In the Czech Republic, civil service includes only part of the public
administration (around 70,000). Mostly positions in the ministries and
their agencies. Staff in regional and local government are territorial
self-government officials.

In France, there is a distinction made between civil servants and not
established officers, both categories are included under the general term
of public official. Established civil servants have a statutory and
regulatory position vis-à-vis the administration which sets them apart
from not established officers, recruited on contract (fixed term or not).
In relation to Germany, the more general term “public employee”
should be used instead. A distinction is made between civil servants
and salary and wage earners in the public service. Civil servants stand
in a special relationship of service and loyalty governed by public law
and they are usually employed on life tenure. In contrast, salary and
wage earners in the public service are employed on the basis of an
employment contract.
In Spain, this term refers to pubic employees subject to administrative
law. They may be “career civil servants” and “interim or provisional
civil servants”. As a rule, the majority of public administration
positions have to be held by civil servants.
In UK, staff in regional and local government are not civil servants.

In Austria, the Civil Service Code is the Act concerning rules and ethics
for “civil servants”. The Act concerning rules and ethics for “contract
staff” is called “Contract Staff Act”.
In Greece, the Code of Civil Servants is the law applied to civil
servants concerning their terms and conditions of employment whereas
the Code of Ethics (not yet ratified by the Greek Parliament) has to do
with the rules for civil servants concerning ethical behaviour.
In Spain, this code concerns all issues not only ethics.
In Cyprus this term is not used. Legislative provisions governing
civil/public servants are included in the “Public Service Law” and
Public Service Regulations. Provisions on ethical matters are also
included in the Public Service Law.

In French law mobility of civil servants can occur in different statutory
ways. It should be noted that there is a difference between détachement
which is when the transferred official is paid by the other department or

returns to the parent department at the end of such periods.
In Cyprus this term is not used since internal mobility is not possible
for most categories of posts. Employees generally cannot be placed in
different employment other than by means of secondment. Within the
same employment (e.g. to the same Department but located in another
town) the term “transfer” is used.
In Austria, it is the transfer of power to a higher level.
“Direction” is not used in the UK.
In the Czech Republic, this term is only used in the case of the name of
