Your participation will make it possible for Lewis & Clark Law students and local, national and international public interest organizations to pursue remarkable work that spans a variety of fields—from public defense to environmental protection to providing legal services to immigrants and low-income families. We encourage you to take the opportunity to read the personal stories—located in the Auction Program—describing how Lewis & Clark law students used their 2010 PILP Stipends to benefit public interest organizations. We hope these first-hand accounts will give you some insight into the positive and lasting effects that supporting PILP can have on our community. In the past year, PILP has continued to increase the level of public interest programming at the Law School, with support from Dean Klonoff and the rest of the law school faculty and staff. PILP is working to create more networking events where students can connect with lawyers currently working in public interest fields. PILP also continued a number of our annual fundraiser events, including PILP Karaoke Explosion and Poker for PILP—all of which have succeeded in raising funds to support public interest organizations in need of legal support! The annual PILP Auction combines the generosity of businesses and alumni, the sacrifice of student board members, committee chairs, and volunteers, and the dedication and support of our entire Law School community. Kelsyn Bevins, Emily Campbell & Molly Kitchell PILP Auction Co-Directors 2 About PILP HISTORY AND MISSION The Public Interest Law Project (PILP) was founded in 1990 by Lewis & Clark Law School students as a chapter of the National Association of Public Interest Law, now called Equal Justice Works. PILP’s mission is to encourage and enable law students to pursue public interest law careers. The group is entirely student-run, from the three student Auction Directors, to the PILP Executive Board, to the dozens of volunteers. These student efforts are made possible by the substantial support and encouragement from Dean Klonoff, the Faculty, and Staff. SUPPORT FOR PUBLIC INTEREST ORGANIZATIONS PILP’s Stipend Program utilizes Auction funds and other contributions for the benefit of our communities. By enabling public interest organizations to hire summer law clerks, PILP’s stipend program is increasing the effectiveness of these organizations and their ability to fulfill their missions. Recipient organizations work on important issues such as constitutional rights, Native American rights, juvenile rights, support for survivors of domestic violence, environmental protection and many other worthy causes. These organizations are often severely under-funded and PILP’s Stipend Program provides them with desperately needed assistance they could not otherwise afford. SUPPORTING LRAP: ENABLING PUBLIC INTEREST LAW PRACTICE PILP supports Lewis and Clark’s Loan Repayment Assistance Program (LRAP) through advocacy, outreach, and direct financial support. LRAP helps ensure that alumni can accept legal positions with non-profits, civil legal services, indigent defense, and other public interest organizations. The program assists alumni in these low-salaried positions pay the principal and interest on law school loans. LRAP supports our alumni’s traditional commitment to public interest. Nationally, only 5% of law graduates enter public interest positions. In 2009, 13% of Lewis and Clark alumni were working for non-governmental public interest organizations, and another 15.5% were in government service. While the median public interest salary is significantly below that for all graduates, the debt load is higher. In 2009, the median national starting salary for public interest attorneys was $43,000, whereas the median salary for all firms together was $103,000. By easing the debt burdens incurred during law school, the LRAP program makes choosing a career in public interest law a viable option for more young attorneys. THE IMPORTANCE OF PILP’S ANNUAL AUCTION The annual PILP Auction is the single largest source of funds for the Stipend Program. Over the past three years, the Auction has funded 45 stipends valued at up to $5,000, which reflects the rate many organizations pay their summer clerks. Roughly four of every five dollars raised at the annual auction is directly invested to support ¬important public interest initiatives in Portland and around the world. In addition, the Auction itself raises awareness of and support for public interest law among students and the legal community. ENCOURAGING PUBLIC INTEREST CAREERS - WHY YOUR SUPPORT MATTERS Lewis & Clark Law School and PILP believe in the importance of encouraging public interest work within the legal profession and making legal services available to public interest organizations. LRAP and the stipend program help achieve these goals by enabling graduates working in public interest jobs to make ends meet, enabling public interest employers to hire more attorneys within their current budgets, and helping public interest groups increase employee retention rates. Your support for all of these initiatives provides graduates greater flexibility in establishing public interest legal careers, and encourages more public interest-minded students and citizens to become lawyers. 3 Procedures for Bidding and Redeeming GENERAL INFORMATION Each participant receives a bid number at registration. Please keep track of this number, because it allows you to bid in all sections of the Auction. During registration, you may choose to pay by credit card using the AuctionPay system. AuctionPay captures credit card information at registration to make things simpler for you. You can also decide to pay by credit card at any time during or after the Auction by going to the cashier and having your card swiped at the AuctionPay terminal. Only the highest bidders are charged. All credit card data is deleted from the system when checkout is complete. You may also choose to pay by cash or check at the end of the night. Following registration, we invite you to enjoy the jazz, refreshments, company, and exciting Auction items! SILENT AUCTION After registration begins at 6:00 pm, the Silent Auction officially begins. Once the Auction opens, bid by writing your bid number and your bid amount on the bid sheet accompanying your items of interest. Please note the minimum bid and minimum raise for each item. The main Silent Auction closes in three sections. The Black Section, located in the hallway, closes at 7:00 pm. The Silver Section, located in front of the stage, closes at 7:20 pm. The bid number posting the highest bid or the Guaranteed Bid Price at the close of each section will win the item. Each bid amount has a number of slots, corresponding to the number of people who can attend. At the end of the evening, only the top bidders get to go, so keep your eye on the Board to keep your spot. For example: If there are four slots available for the package, the top four bidders win. FRANCIE GRAHAM had the opporunity to clerk for Legal Aid Services of Oregon in Portland, OR One of the experiences that drew me to law school was serving lowincome families as child support case manager at Oregon’s Department of Justice. As I watched parents struggle to navigate the legal system on their own, I wished I could take a more active role as an advocate. Clerking this summer at Legal Aid Services of Oregon (LASO), an organization that provides a wide variety of civil legal services to people living in poverty, was a perfect fit for me. LASO and the Oregon Law Center serve over 20,000 clients each year, but the demand for services far outweighs the supply, so summer law clerks provide critical support to LASO attorneys and clients. Clerking for LASO was a fabulous experience. I refined my research and writing skills and got hands-on experience in many different practice areas: I researched and wrote memos on housing, family law, public benefits, and consumer law issues; interviewed domestic violence survivors and connected them with volunteer attorneys; tracked foreclosure-related evictions; and answered questions from parents on the child support hotline. I observed trial court dockets, moot court oral argument preparation, and oral arguments at the Oregon Court of Appeals. I was also surrounded by an incredible community of supportive attorneys whose example strengthens my commitment to poverty law. I am so grateful to PILP for giving me the opportunity to learn and serve my community at LASO. The stipend gave me a chance to provide direct, tangible services to the most vulnerable members of our community—a chance I would never have had without the generous support of PILP. Thank you! . . . RICH DEITCHMAN spent his summer clerking for The Freshwater Trust in Portland, OR Before entering law school, I was interested in hydrologic science and stream restoration. I majored in geology in college and completed a graduate degree in hydrology. PILP provided me the opportunity to work The Freshwater Trust (TFT) for the summer on legal and policy issues related to stream restoration. TFT works collaboratively to engage communities in restoring and maintaining freshwater health. TFT’s Conservation Department partners with public and private landowners to undertake habitat and stream flow restoration projects that improve water quality and native fish habitat. As an intern, I worked with TFT staff to do legal research and writing projects relating to liability for NGOs in the event that an in-stream restoration project causes personal injury or property damage; restoration projects including research and travel to meet with landowners engaged in flow projects in Eastern Oregon; and conservation advice with restoration field work. In addition to the substantive legal work, I was able to meet various attorneys, government agency staff, local watershed leaders and private landowners. TFT’s staff includes many non-legal employees (land and education managers) with whom I developed friendships. I was able to learn more about stream restoration science and the basics of non-profit organization management. Overall, I had a productive experience and a great introduction to environmental legal work in Oregon. Also, I met a lot of great folks working on important water issues and had the chance to get out and see environmental work in other parts of Oregon. ADRIANNE DELCOTTO had the chance to clerk for Trustees for Alaska in Anchorage, AK The PILP stipend made it possible for me to intern with Trustees for Alaska this summer. Trustees is a non-profit public interest environmental law firm providing free legal counsel to local and national conservation groups, Native villages, community and citizen groups, statewide coalitions, hunting and fishing groups, and individual Alaskans. Trustees takes on critical environmental and natural resources issues affecting Alaska. In particular the firm focuses on issues related to mining development and exploration, clean water, endangered species, and global warming, arctic and ocean ecosystems, and public lands. Most of the clients Trustees represents could not afford to bring legal claims without the firms’ free litigation services, and would thereby be prohibited from effectively participating in the judicial process. At Trustees, I had the opportunity to draft litigation documents and attend the resulting hearings regarding the application of herbicides to public lands. Under the guidance of Trustees skilled and knowledgeable Trustees attorneys I also conducted research, prepared motions and appeals, discussed litigation strategies, and observed depositions in preparation for a trial. I was extremely fortunate to have spent my summer interning at Trustees for Alaska. The experience opened my eyes to an exciting career as an environmental attorney and inspired me to strive to return to Alaska as a practicing attorney. I am grateful to PILP for enabling me to accept an internship with Trustees for Alaska; without PILP my experience would not have been possible. . . . ADAM ADKIN spent the summer clerking for Community Alliance of Tenants in Portland, OR Helping nonprofits so that they are able to more effectively operate and benefit the causes they were created to serve was a major motivating force that brought me to law school. As I progress along with my legal career, I hope to retain an emphasis on working with socially beneficial organizations. For that reason, working with the Community Development Law Center (CDLC) this summer was an incredible opportunity. CDLC, a program of Legal Aid Services of Oregon, provides legal assistance to nonprofit organizations benefiting low-income individuals and families in Oregon. While working at CDLC, I was able to provide much needed legal services and advice to a number of local nonprofit organizations that otherwise may have been forced to shut down. I know that my work benefited my community by enabling excellent, local nonprofit organizations to serve their communities. I am incredibly thankful for the PILP stipend that I received. The debt that I have incurred to attend law school places a serious limitation on my activities and the employment opportunities that I am able to consider. Despite my desire to work with the incredible social-benefit organizations of Oregon, the prospect of incurring additional debt to provide for my living expenses was very unattractive. MILES JOHNSON had the opportunity to clerk for Greater Yellowstone Coalition in Driggs, ID After just one year at Lewis and Clark, the PILP program enabled me spend the summer working on the very issues that brought me to law school in the first place. My background is in fisheries science, and I came to law school, in large part, to continue working on fisheries and water issues in the West. As an intern with Greater Yellowstone Coalition, my main task was to investigate and oppose the construction of a proposed hydro-electric dam on the Bear River in southeastern Idaho. This assignment allowed me to advocate for the preservation of native fish species and wild, free-flowing rivers. I would ask for nothing more than to work on similar issues for the rest of my legal career. Interning with GYC exposed me to the process by which the federal government decides whether to allow the construction new hydro-electric dams. This regulatory process involves several federal and state natural resource agencies and is governed by the Federal Hydropower Act, the Clean Water Act, the Endangered Species Act, state and inter-state water rights, elements of contract law, and a host of agency rules. It was my job to research all of the possible legal challenges to the proposed hydro-electric dam and analyze whether GYC could or should pursue those remedies. The PILP program allowed me to spend my 1L summer learning the intricacies of the hydro-electric licensing process—a complex administrative proceeding that I will almost certainly encounter again. More broadly, this experience helped me to refine my legal research and writing skills in a real-world context through writing memos and drafting comments to various natural resource agencies. But for PILP’s generous support, this exciting and valuable experience would have been unavailable to me. . . . TARA GALLAGHER was able to spend her summer clerking for Crag Law Center in Portland, OR When I applied for law school, I pictured myself having an amazing career as a public interest attorney. I wanted to be like Robert F. Kennedy Jr. and the Riverkeepers, fighting for environmental justice in the court of law. But when I arrived at Lewis & Clark, I wasn’t sure I had what it took to be a litigator. This summer, however, my PILP stipend allowed me to work for Crag Law Center. Crag offers a laid back, enthusiastic work environment where the attorneys are passionate about their cases and committed to educating the future generation of lawyers. Working with Crag, I was mentored by talented and experienced environmental litigators. I was privileged to be a part of some really big moments such as receiving a decision from the Ninth Circuit Court of Appeals ruling that logging roads were point sources under the Clean Water Act and watching President Obama announce that there would be no offshore drilling in Alaska this season. Throughout the summer, I improved my research and writing skills, received in the field training, and ran the upper Clackamas in an inflatable kayak. I realized the life and career I pictured were attainable. It will take lots of hard work, perseverance, and mentors like the Crag staff, but it is possible. ERIN MCKEE spent last summer clerking for Sponsors Organized to Assist Refugees in Portland, OR This summer I worked as the legal intern for Sponsors Organized to Assist Refugees, or SOAR Legal. SOAR Legal provides low-cost immigration services to refugees, asylees, and low-income immigrants who may not otherwise have access to legal services. Among its many services, it assists with family-based petitions, green card applications, naturalization applications, humanitarian parole, and employment authorization. My work at SOAR Legal was a balance between legal research and writing and direct client contact. I researched a wide-range of issues, from public interest parole for religious minorities from the Former Soviet Union and Iran to the immigration consequences of certain crimes. I also wrote several memoranda and client letters, and regularly corresponded with the U.S. Citizenship and Immigration Services and embassies throughout the world. In addition, I conducted initial consultations for walk-in clients; assisted with asylum screenings; took affidavits; and prepared applications for a variety of immigration benefits. Having so much direct client contact crystallized the tremendous impact and import of an immigration lawyer’s work. To provide such necessary services to people who are often unfamiliar with the U.S. legal system was both humbling and rewarding. I have long been passionate about the human and civil rights of noncitizens, and my experience at SOAR Legal has solidified my resolve to pursue a career in immigration law. Without the PILP stipend, I would not have been able to take this amazing position. . . . KELSYN BEVINS had the opportunity to clerk for Metropolitan Public Defender in Portland, OR I came to Law School because I believe access to legal resources and services is a significant problem in our society. Metropolitan Public Defender (Metro) cannot afford to pay summer law clerks, but aligns with my interests and helps so many people in our community, so I approached them about partnering with me in applying for a PILP stipend. Metro provides criminal defense for indigent clients. They have juvenile, misdemeanor, minor felonies, major felonies and capital divisions. Metro attorneys represent clients at every stage during their criminal prosecution, and can represent either parents or children in juvenile dependency adjudications. At Metro I received the same comprehensive trial skills training that new attorneys in the office receive. I wrote Oregon Appellate and Supreme Court opinion summaries weekly, partnered with misdemeanor and juvenile attorneys on their cases, attended numerous trials, and wrote legal memos and motions. My biggest projects of the summer were an in-trial reference guide on prosecutorial misconduct; a legal memo on problems facing the awarding of fugitive time-served credit in Oregon county jails; a motion to suppress evidence that went before a judge in Washington County and won. I got an inside view of criminal defense work and got to see what non-profit legal organizations are like. The PILP stipend made it possible for me to take such a rewarding, hands-on and educational summer position I would not have been able to take otherwise. PATRICK SULLIVAN clerked for Confederated Tribes of the Umatilla Indian Reservation in Pendleton, OR I worked for the Confederated Tribes of the Umatilla Indian Reservation (CTUIR), an Indian tribe near Pendleton, Oregon. I worked on several projects. The majority of my time was spent developing a guide to Small Business Administration (SBA) programs that give minorityowned businesses, including tribally-owned businesses, priority in receiving federal contracts and subcontracts. I presented this work to the tribe’s Committee on Economic Development and worked with that committee and my supervisor to plan a new business. I also conducted research for the tribe’s consideration of incorporation of UCC Article 2 into its commercial code, and on the extent of tribal jurisdiction over power transmission infrastructure on the reservation. The most fascinating project came in a moment of downtime - a tribe member’s dancing regalia recently appeared on the internet 40 years after it was stolen. I met with the owner and we are working to retrieve it for her. This was my dream job for the summer, and my supervising attorney has hired me to continue our work during the school year. The experience and networking of the PILP stipend jump-started my career in the Oregon legal and Native American communities. . . . LOGAN PERKINS was able to spend her summer clerking for Pine Tree Legal Assistance in Bangor, ME My PILP stipend allowed me to spend my first summer in law school working in a legal services organization getting a taste of public interest law and getting my feet wet in the real world of legal work. Pine Tree Legal Assistance is the state of Maine’s primary legal services organization, providing free legal aid to low-income people who would otherwise completely lack representation in the legal system. By supporting my time as a legal intern at Pine Tree, PILP helped to level the playing field for lowincome Maine people facing daunting legal problems. At Pine Tree I worked on a variety of legal issues ranging from evictions to Social Security benefits to employment discrimination. One of the most gratifying parts of my experience was knowing that even as a first year law student, I was able to provide significant assistance to clients who would otherwise find it very challenging to advocate for themselves. I acted as an advocate for clients in Administrative Hearings with Public Housing Authorities, helping them to retain their public housing or Section 8 subsidy. I advocated for clients with diminished mental capacity to ensure their Social Security benefits would not be reduced as a result of a simple mistake. I negotiated with landlords to allow tenants extra time in their housing, keeping entire families from imminent homelessness. Seeing firsthand the difference that legal representation means to low-income people deepened my commitment to public interest law. The need for poverty lawyers clearly far outstrips the availability of legal services for low-income people. The biggest lesson I learned this summer was how much power lawyers have over the lives of their clients. It is essential that those of us with the good fortune and privilege to go to law school, understand the responsibility associated with our new position in society. SARAH DANLEY spent last summer clerking for Northern California River Watch in Sebastopol, CA Northern California River Watch (NCRW) is a small non-profit that works to protect the waterways of Northern California. NCRW combines education, pollution prevention, enforcement and preservation to protect many different types of waterways and communities throughout the region. I came to Lewis and Clark to learn about environmental law with an interest in eventually working in public interest environmental law. My work at NCRW allowed me to work towards this goal. That work included research and writing memos regarding the Clean Water Act (CWA) and the Resource Conversation and Recovery Act (RCRA). I was also able to draft CWA and RCRA letters for violators of the acts. One of the best parts of working for a small non-profit was the ability to work closely with the attorney who runs the legal portion of NCRW, which allowed me to see how a small non-profit operates. I was also able to improve my legal writing and research skills through direct interaction with the lawyer. In addition I was able to attend several motion to dismiss hearings, a few pretrial settlement meetings and a nonbinding arbitration hearing on a major toxic torts case. JENNY KEATINGE clerked for International Fund For Animal Welfare in Washington DC The PILP stipend program made it possible for me to spend the summer working in Washington DC at the International Fund for Animal Welfare (IFAW). As one of the world’s leading animal welfare organizations, IFAW works in more than 40 countries to safeguard wild and domestic animals. I chose to clerk at IFAW because I wanted to get some hands on experience working to establish stronger wildlife conservation policies and animal welfare laws. I also wanted to develop a broader understanding of the hurdles an international non-profit faces in animal protection and learn more about what systems we have in place nationally and internationally to safeguard endangered species. I was able to expand my understanding of the applicable US laws and management strategies, and the effects the international negotiating process has on domestic standards. Over the course of the summer, I worked on a range of projects involving state and federal wildlife policy. I spent a lot of time researching and writing about the ownership of exotic pets in the US, and evaluating strategies to develop more stringent regulation for these animals. I also had the opportunity to attend meetings of the Endangered Species Coalition, a group of non-profits working together to strengthen the ESA. I attended a Senate briefing on the Great Cats and Rare Canids Act, which is new legislation that IFAW is trying to pass, and assisted with background research in support of a biodiversity campaign for the United Nations Earth Summit in 2012. I learned how IFAW collaborates with government officials and other non-profits to legislate and lobby for animal protection and I became more familiar with international legal issues affecting wildlife by participating in their weekly staff meetings. The PILP stipend gave me the financial ability to travel to DC and spend the summer working on the issues I came to law school for. Working at IFAW was an amazing experience, and I feel very lucky to have been able to contribute to such a great organization. I could not have done it without PILP.
