the bankruptcy case.

So a couple of things
housekeeping-wise.

The debtor received a stalking horse

bid from WS 2017, LLC, an affiliate of YM, and
16
then received two overbids, one from Fashion Nova
17
of $1.65 million, and one from GB Brands of $1.65
18
million.

In connection with the intellectual
20
property assets that we are seeking to sell,
21
there's been some discussion about the sale of
22
customer data by the company.

The company has been working with a
24
consumer privacy ombudsman in this case, Elise
25
Frejka, who has provided the company certain

guidance in terms of what her recommendations will

be as it relates to the transfer of personally

identifiable information.

And in particular as it relates to

e-mails, as we've disclosed to the interested
6
parties, the debtor maintains e-mails principally
7
in two databases.

One is a marketing database that
contains principally e-mails, that's called List
10
Track.
List Track is a third-party service they
11
use to push e-mail campaigns.

database consists of approximately 2.97 million
13
opt-in e-mail addresses.

That e-mail
In addition, the debtors, since 2007,

have maintained an order management system called
16
EMS that maintains information related to orders
17
placed on its ecommerce sites randb.com and
18
wetseal.com.

The EMS website contains
20
approximately 6.8 million e-mail addresses
21
associated to purchase order histories of
22
customers.

In consultation with the consumer
24
privacy ombudsman, we've agreed to limit the sale
25
of e-mail addresses in the EMS system to customers

who have not otherwise opted out, who have

purchased product in the last 18 months.

So there probably -- or there

definitely are e-mail addresses associated to

customers that are older than 18 months.
