Background:
We have reevaluated the administrative fees and court costs charged for violations that are prosecuted
through the City's administrative adjudication system. We are proposing to increase the administrative
fee for overweight truck violations from $25 to $40. The current $25 fee has been in place since 2005.
The fee covers costs for hearing room security, recording of the hearing, prosecutor's fee, staff time and
the hearing officer's time.
At the April 27, 2009 meeting, the Committee approved this change to the ordinance.
Recommendation:
Move final approval of an ordinance changing the overweight truck violation administrative fee from $25
to $40.

OF THE CITY COUNCIL OF THE CITY OF PARK RIDGE
AMENDING ARTICLE 13, CHAPTER 21, SECTION 11
SECTION 1: BE IT ORDAINED, by the City Council of the City of Park Ridge that
Article 13, entitled "Traffic," Chapter 21 entitled, "Overweight and Oversized Vehicles,",
Section 11 entitled, "Penalties for Overweight Truck Violations of Illinois Vehicle Code" of the
Municipal Code of the City of Park Ridge is hereby amended to read in its entirety as follows:

PENALTIES FOR OVERWEIGHT TRUCK VIOLATIONS OF ILLINOIS
VEHICLE CODE
A.
Whenever any vehicle is operated in violation of the provisions of Section 15-111
or subsection (d) of Section 3-40 1 (d) of the Illinois Vehicle Code, 625 ILCS 5/15-111 and 625
ILCS 5/3-401(d), the owner or driver of such vehicle shall be deemed guilty of such violation
and either the owner or the driver of such vehicle may be prosecuted for such violation. Any
person, firm or corporation who is convicted for a violation of Section 15-111, including, but not
limited to, a maximum axle or gross limit specified on a regulatory sign posted in accordance
with paragraph (g) or (h) of Section 15-111, shall be fined according to the following schedule
except for weights of 5001 or more pounds overweight:

For vehicles that are 5001 or more pounds overweight, the fine shall be computed by assessing
$750 for the first 5000 pounds overweight and $75.00 for each additional increment of 500
pounds overweight or fraction thereof. Also, an administrative fee of $40.00 is added to the fine
amount.
B.
If a second division vehicle and load are operated within the City of Park Ridge
and the required registration fees and taxes for the gross weight of the vehicle and load have not
been paid or the vehicle and load exceed the registered gross weight for which the required fees
and taxes have been paid by 2001 pounds or more, the operator or owner shall be fined as stated
in Paragraph A of this Section. For any unregistered vehicle or vehicle displaying expired
registration, no fine shall exceed the actual cost of what the appropriate registration for that
vehicle and load should have been as established in Paragraph C of this Section.
C.
The following are the registration fees for vehicles and loads as set forth below:

SECTION 2: BE IT FURTHER ORDAINED that this Ordinance shall be in full force
and effect from and after its passage, approval and publication according to law.
SECTION 3: BE IT FURTHER ORDAINED that the City Clerk is hereby authorized
and directed to publish said Ordinance in pamphlet form according to law.
Adopted by the City Council of the City of Park Ridge, Illinois this
2009.
