Robins Kitchen VIP REWARDS TERMS AND CONDITIONS
1. About the Robins Kitchen VIP Loyalty Program
1.1 The Robins Kitchen Loyalty program ('the Program') is operated by House Corporate Pty Ltd t/as
“Robins Kitchen”ABN 74 323 352 189 of 425 (‘Robins Kitchen’, 'we' or 'us').
1.2 Customers participating in the Program can obtain rewards by making purchases at participating
Robins Kitchen stores and can redeem such awards at participating stores as described in and
subject to these Robins Kitchen VIP Loyalty Program –Terms and Conditions ('Loyalty Program
Terms').
2. Applications and Card Issuance
2.1 Applications to participate in the Program ('Application') may be made online at
www.robinskitchen.au) or in a Robins Kitchen store. By making an Application, the applicant
('you') agrees to be bound by these Loyalty Program Terms. Robins Kitchen reserves the discretion
to accept or reject any Application.
2.2 On sign up you will be notified by Robins Kitchen if your Application has been accepted. Following
sign up, you will be able to participate in the Program. Your use of your VIP account will at all
times be subject to these Loyalty Program Terms.
2.3 Customers must only sign up as a Robins Kitchen VIP member once, duplicate VIP accounts may
be cancelled without the customer being notified. Cancellation of a VIP account includes
termination of the account and termination of all rewards and benefits associated to the account.
Applicants may be made by a natural person only. Corporations, partnerships and other entities
may not apply. VIP membership and the VIP member account is solely allocated to the person
who originally signed up as a Robins Kitchen VIP Member, the membership and all of its benefits
may be used only by this person.
2.4 Employees of Robins Kitchen, including head office staff and employees of its related entities and
Stores are not eligible to apply.
2.5 Your VIP Membership is valid until you or we terminate these Loyalty Program Terms. A VIP card
will not be issued as a part of this VIP Program. Should a card, or any point of sale or printed
collateral be issued at any time it is and at all times, remains the property of Robins Kitchen. You
must return the Card or printed collateral to us if we ask you to do so. Defaced, mutilated,
altered, lost or stolen cards and collateral may be replaced at a Robins Kitchen store at our
discretion. A customer does not require a VIP Card in order to hold a Robins Kitchen VIP
Membership.
3. Transactions and Reward Points
3.1 Each time you purchase goods or services at a Robins Kitchen Store you must advise the staff
member you are a Robins Kitchen VIP Member. Store staff will record the transaction and value
points ('Reward Points') will be attributed to your VIP account for each purchase at the rates
published from time to time by Robins Kitchen on the Robins Kitchen VIP Loyalty Program
Website at www.robinskitchen.com.au. Your points balance will be printed on the bottom of your
register receipt.t may take up to 24 hours after the relevant purchase for Reward Points to be
attributed.
3.2 Failure to advise a staff member that you are a Robins Kitchen VIP Member may result in points
not being assigned to your account. Robins Kitchen take no responsibility for allocating rewards
points. If points are not assigned during the initial transaction you must contact Robins Kitchen
Customer Service on 1300 136 936 within 30 days of the transaction to receive your points. A
register receipt or proof of purchase will be required in order to allocate these points.
3.3 Under no circumstances will points be assigned to a VIP account for purchases made prior to sign
up.
3.4 The initial rate of attribution of Reward Points is one reward point for every $1 spent in a Robins
Kitchen store. When 250 points are accrued a value of $10.00, able to spent on goods or services
purchased at participating Stores (in both cases, inclusive of GST), will be loaded onto your Robins
Kitchen VIP account. This initial rate may be varied by Robins Kitchen at any time in accordance
with paragraph 6 of these Loyalty Program Terms.
3.5 Robins Kitchen may also from time to time offer special promotions such as bonus points. Such
special promotions will be at the discretion of and on terms notified by Robins Kitchen on the
Robins Kitchen VIP Loyalty Program Website atwww.robinskitchen.com.au.
3.6 Reward Points may be used as payment ('Redeemed') for subsequent purchases of goods and
services at participating Stores. Such purchases may be paid for in part or in whole by redeeming
Reward Points. Where the cost of the purchase exceeds the available Reward Points, you will be
required to make up the difference with another payment method. Redemption must be for a
minimum amount of $10. No change will be given for purchases to a value of less than the
available Reward Points. More than one $10 reward can be redeemed in the same transaction as
payment for goods, if multiple $10 rewards have been accrued prior to the transaction.
3.7 $10 rewards expire 90 days after they are attributed to your account ('Validity Period').
3.8 Robins Kitchen's usual Returns Policy applies to goods and services purchased by Redemption (in
whole or in part). The Returns Policy may be inspected at any Robins Kitchen store. In the event of
a refund, any Reward Points earned for the original transaction will be deducted from your
Reward Points balance and if the original purchase was made using Reward Points, those Reward
Points will not be refunded.
3.9 Reward Points will be earned for the purchase of Robins Kitchen Gift Cards, however cannot be
Redeemed to purchase Robins Kitchen Gift Cards. Using a Robins Kitchen Gift Card as payment
will not earn Reward Points in accordance with these Loyalty Program Terms.
3.10
Please note: VIP accounts can be used to accumulate Reward Points or for Redemptions at
participating Stores only. Robins Kitchen does not warrant or represent that at any particular time
a particular Store will be a participating Store. To the extent permitted by law, Robins Kitchen
excludes all liability to you in the event that a Store does not accept your account for use.
3.11
Reward Points have no monetary value (notwithstanding that they may from time to time be
denominated in dollars and cents) are not redeemable for cash and cannot be used for the
payment of credit or accounts. Reward Points cannot be transferred.
4. Assistance
4.1 You can check your Reward Points balance at any time by logging in to the Robins Kitchen loyalty
website available at www.robinskitchen.com.au (coming soon) or by calling customer service on
1300 136 936.
4.2 Visit your local Robins Kitchen store if you have any reason to believe that an error has occurred
in relation to your account.
5. Privacy Collection Statement
5.1 Robins Kitchen will use the information you provide to deliver to you the benefits of the Program
as outlined in the Loyalty Program Terms and, unless you opt out, to communicate with you about
Robins Kitchen products and promotions in the future. For these purposes, your information may
be disclosed to people within Robins Kitchen, its related entities and the Stores of and to third
parties who have been contracted by Robins Kitchen to provide services in support of the
Program.
5.2 In respect of such information, if you do not provide your personal information you may not be
able to enjoy all the features of the Program. If you have any questions about privacy or to access
your personal information, please contact us at [email protected].
5.3 You consent to the information provided by you in your Application being used by Robins Kitchen
to process your Application. If your Application is accepted, you consent to Robins Kitchen, its
related entities and the Stores retaining and using information provided by you in the manner
described above.
5.4 You consent to information provided by you, and information about transactions conducted by
you using the account, being disclosed to third parties who have contracted with Robins Kitchen
to provide services in support of the Program and customer transactions under the Program.
5.5 In respect of such information, Robins Kitchen and the Stores will comply with the Australian
Privacy Principles (APP) and with its own Privacy Policy available at www.robinskitchen.com.au.
6. Variations to and withdrawal by Robins Kitchen of the Program
6.1 Robins Kitchen may at any time vary these Loyalty Program Terms or the Program ('Variations').
6.2 The terms of any Variations will be published on the Robins Kitchen VIP Loyalty Program Website
at www.robinskitchen.com.au and in publicity and marketing materials. Customers who have
provided email addresses will be notified of Variations by email. Variations will take effect from
the date specified in the notification, or if no date is specified in the notification, from the date of
first publication of the notification ('Variation Date').
6.3 If you do not agree to a Variation, you must notify us in writing within 14 days of the Variation
Date. We will be entitled to treat such notification as notification of termination of your
participation in the Program, effective on the date we receive your notice. By purchasing a
product and acknowledging use of your VIP account to earn VIP points at a participating Store on
or after the Variation Date, you will be taken to have agreed to any such Variation unless you
have notified us that you do not agree to the Variation in accordance with this paragraph 6.3.
6.4 You may at any time, terminate your participation in the Program by logging in to the Robins
Kitchen loyalty website and processing an account termination. Such a termination will take effect
immediately.
6.5 Without limiting the scope of paragraph 6.1 Robins Kitchen may at any time vary these Loyalty
Program Terms or the Program ('Variations')., Robins Kitchen reserves the right to withdraw or
terminate the Program at any time by giving no less than 7 days' notice.
6.6 In the event of withdrawal or termination of the Program by Robins Kitchen, or your notification
to us that you no longer wish to participate in the Program under paragraphs 6.3 If you do not
agree to a Variation, you must notify us in writing within 14 days of the Variation Date. We will be
entitled to treat such notification as notification of termination of your participation in the
Program, effective on the date we receive your notice. By purchasing a product and
acknowledging use of your VIP account to earn VIP points at a participating Store on or after the
Variation Date, you will be taken to have agreed to any such Variation unless you have notified us
that you do not agree to the Variation in accordance with this paragraph 6.3. or 6.4
6.6.1 Reward Points loaded onto a Loyalty account as a dollar reward that was accumulated
before the Variation Date or the effective date of termination by you under
paragraphs 6.3 If you do not agree to a Variation, you must notify us in writing within
14 days of the Variation Date. We will be entitled to treat such notification as
notification of termination of your participation in the Program, effective on the date
we receive your notice. By purchasing a product and acknowledging use of your VIP
account at a participatinStore on or after the Variation Dateyou will be taken to have
agreed to any such Variation unless you have notified us that you do not agree to the
Variation in accordance with this paragraph 6.3. or 6.4
6.6.2 You will not be able to accumulate additional Reward Points on or after the Variation
Date or the Termination Date, as applicable.
6.7 Robins Kitchen may at any time terminate this agreement or terminate or suspend the operation
of your account without notice to you if:
6.7.1 you are in breach of any of these Loyalty Program Terms; or
6.7.2 you engage in any dishonest, illegal or fraudulent conduct.
7. Liability of Robins Kitchen and Stores
7.1 To the extent permitted by law:
7.1.1 Robins Kitchen and the Stores exclude all liability to you arising out of or in connection
with your participation in the Program or your use of your account;
7.1.2 any implied warranties, including any warranties implied under statute, are excluded;
7.1.3 Robins Kitchen and the Stores limit their liability to you, in respect of any claim,
however it arises, whether in breach of contract, in tort (including negligence) or
under statute, to the monetary value of the Reward Points accumulated on your
account at the time you make a claim against Robins Kitchen or a Store; and
7.1.4 Robins Kitchen and the Stores exclude all liability to you for any consequential or
indirect loss or damage, or for any loss of income, revenue or goodwill, however it
arises.
7.2 Neither Robins Kitchen nor any Store is a debtor or depositor and specifically disclaim any
relationship with you as debtor or depositor.
