Breach of any of these regulations will be deemed to be a breach of the Resident's tenancy agreement. Breach of any of these regulations will make the Resident liable to disciplinaryactionunderthecodesetoutinsection5below. PersistentbreachoftenancyonthepartofanyresidentmayresultintheUniversity seekingaterminationofthetenancyandpossessionoftheroom-throughthecourtsif necessary. Breachofsomeoftheseregulationsmayalsoconstituteacriminaloffenceanditisthe University'spolicytoreportsuchmatterstothepolice. General 1.Residents AllresidentsmustbeastudentofTheUniversityofTheArts. 2.PersonalSafety ItisnottheresponsibilityoftheResidenceManagersorstafftoaccountforResidentsandvisitorsin anemergencyexceptthattheyarerequiredtoensurethatgeneralcontingencyplanshavebeen made.ResidentsshouldreadcarefullyandobservetheFireRegulationsdisplayedinTheCostume Storeandbefamiliarwiththelocationofallexits,alarmbellsandfirefightingequipment.Firedrills areheldonaregularbasis.Residentswithadisabilitywhowouldneedassistanceinan emergencyevacuationordrillshoulddiscusstheirneedswiththeResidencesManagerbefore startingtooccupyHalls. 3.Guests 3.1 Guestsarepermittedontositebetweenthehoursof10:00and22:00.Outsideofthese hours,includingovernightguests,residentsmusthavepriorpermissionfromaResidence Manager. 3.2 Allguestsaretobesignedintothevisitor’sbookuponarrivalandsignedoutupon departure. 3.3 Only2guestsperresidentarepermittedinhallatanyonetimeandarenotpermittedto stayovernightformorethan3nightswithina14nightperiod. 3.4 Oncearesidenthashadanovernightguestfor3nightswithina14nightperiod,the residentmaynothaveanyovernightguestsuntil21nightshaveelapsedwithoutguests. Accommodation Services Tenancy Regulations 2016-17 1 After21guest-freenights,theresidentwillagainbepermittedtohaveovernightguestsin accordancewithclause3.3. 3.5 3.6 Residentsareresponsibleforthesafetyoftheirguestsandtoensuretheyunderstandthe relevanthealthandsafetyrequirements. Guestsareonlypermittedonsitewheninthecompanyoftheresidenttheyarevisitingand arenotpermittedtoholdtheaccesskey/fobbelongingtotheresidentatanytime. 3.7 ResidentsareresponsibleforensuringtheirguestsunderstandandabidebytheHalls Regulations. 3.8 Residentsareaccountableforanybreachoftheregulationsmadebytheirguest(s)andwill beliableforthereasonablyincurredcostsofreinstatementafteranydamagecausedby theirguests. 3.9 TheCostumeStorestaffreservetherights(intheirreasonablediscretion)torefuseentryto aresident’sguest(s)atanytime. 4.Conduct Bysigningthetenancydocumentandintheinterestsofsafetyandsecurityandthewellbeingof otherresidentsallresidentResidentsagreetocomplywiththefollowingregulations. 4.1Drugs 4.1.1 Solventsandothersubstanceswhicharenotcontrolleddrugsbutmaybeusedtoproduce anintoxicating,stimulatingornarcoticeffectwhichcouldcausetheResidenttobeadanger tothemselvesorothersmaybetreatedbytheLandlordforthepurposesofthiscontractinthe samewayasunlawfuldrugs.Residentsmustcomplywithalllawsrelatingtocontrolleddrugs andpsychoactivesubstances. 4.1.2 Residentsmustnotbring,orknowinglypermit,anyunlawfuldrugsor psychoactivesubstancesintoTheCostumeStoreorconsumeorallowtobe consumedinTheCostumeStore. 4.1.3 ResidentsmustnotcomeintoTheCostumeStoreHallsiftheyareundertheinfluenceof unlawfuldrugsorpsychoactivesubstances. 4.1.4 TSHC Portfolio 1 LTD policy on unlawful drugs and psychoactive substances possession,saleorsupplyofcontrolleddrugsistoreferthemattertothepolice. Inaddition,theUniversitymaytakedisciplinaryactionand/ortreatunlawfuldruguse as a serious breach of the Resident's tenancy agreement, which may lead to that agreementbeingterminated. 4.1.5 WheretheUniversitysuspectsthatunlawfuldrugsarebeingusedorsoldforuse byaResidentthepolicewillbeinvitedintothehalltoinvestigate. 4.1.6 Itshallnotbeinbreachoftheseregulationsforaresidentto haveorusea controlleddrug,ifitwasprescribedforhimorherbyamedicalpractitionerandis usedasdirected. 4.2Weapons Accommodation Services Tenancy Regulations 2016-17 2 4.2.1 ResidentsmustnotbringanyfirearmorairgunintoTheCostumeStore,eveniftheyhavea licenceforitoritisofakind,whichdoesnotneedtobelicensed. 4.2.2 Residentsmustnotbringanyotherweapon,orarticlewhichisintendedtobeusedasa weapon,intoTheCostumeStore. 4.2.3 TSHCPortfolio1LTDpolicyonweaponsorarticlesintendedtobeusedasweaponsisto referthemattertothepolice,butitmayinadditiontakedisciplinaryactionand/ortreatthe matterasaseriousbreachoftheResident'stenancyagreement,whichmayleadtothat agreementbeingterminated. 4.3FireSafety 4.3.1 ResidentsmustcomplyinallrespectswiththeFireRulespostedintheirroomandsetoutin the“GuidetoLivinginTheCostumeStore”handbook. 4.3.2 Residentsmustnotcausefires,useequipmentthatcouldpotentiallycausefires,and mustorsetlighttoanythinginsidehallsoronhallgrounds.Examplesof behavioursthatwouldbreachthisregulationinclude(butarenotlimitedto) fryingwithdeepfat(whetherusinganelectricfryerornot)usingbarbeques,candles,tea lights,meltingwax,usingjosssticks,oilburnersorsimilardevicesintheirbedroomor kitchen. 4.3.3 Residentsmustnotinterfereinanywaywithfireextinguishers,fireequipment,fireor smokealarms,firedoors,doorclosuresoranyfirepreventionorfiresafetyequipment. Wrongfuluseoforinterferencewithfireequipmentisacriminaloffenceandwillleadto disciplinaryactionbeingtakenunderthiscodeandcouldalsoresultwiththematterbeing referredtothepolice.Ifresidentsarefoundtohavetamperedwiththefireequipment thenastaffcalloutchargeof£30willbechargedtotheresidentorresidentsdeemed responsibletoinspecttheequipment.Ifthedamageuponexaminationisfoundtobe seriousthentheresidentwillbeliabletopayallchargesfortheequipmenttobereplaced orfixed. 4.3.4 Residentsmustnotobstructexits,stairways,corridorsorotherpassageways.Itemsfoundin suchplaceswillberemovedandthrownawayifdeemedtoberubbish,theresident(s)held responsiblewillberechargedrubbishremovalfees. 4.3.5 Uponhearingthefirealarm,Residentswillevacuatethebuildingimmediately,proceedto theagreedfireassemblypointandwaitforfurtherinstructionfromamemberofstafforthe firebrigade. 4.3.6 Residentsmustnotinterfereinanywaywithfireextinguishers,fireequipment,fireor smokealarms,firedoors,doorclosuresoranyfirepreventionorfiresafetyequipment.If residentsarefoundtohavetamperedwiththefireequipmentthenachargeof£30staffcall outfeewillbechargedtotheresidenttoinspecttheequipment.Ifthedamageupon examinationisfoundtobeseriousthentheresidentwillbeliabletopayallchargesforthe equipmenttobereplacedorfixed. 4.3.7 Noresidentispermittedtoleaveanyiron,hairstraightenerorotherpieceofpersonal electricalequipmentwhichgeneratesheatandconstitutesafiresafetyriskpluggedinand unattendedwhetherintheirownroomorinthecommonareaoftheirflat. Accommodation Services Tenancy Regulations 2016-17 3 4.4HealthandSafety 4.4.1 ResidentsmustcomplyinallrespectswiththeUniversity'sHealthandSafetyPolicy,acopy ofwhichmaybeobtainedfromtheHallsOfficeorfromtheUniversity’s web siteat www.arts.ac.uk. 4.4.2 Residentsmustnotinterfereinanywaywithanyhealthandsafetyequipment.Interference withhealthandsafetyequipmentmightbeacriminaloffenceandTSHCPortfolio1LTDcan refersuchmatterstothePolice. 4.4.3 ResidentsmustnotkeepbicyclesinsidetheirroominanypartofTheCostumeStore. Bicyclesmayonlybestoredindesignatedbikestorageareas.Bikesdiscoveredonsitein non-designatedareaswillberemovedandstoredforamaximumofonemonthbefore beingdisposedof.Theuniversityacceptsnoliabilityforanylossordamagearisinginsuch circumstances. 4.4.4 ResidentsmustnotifytheResidencesManagerortheon-site/on-dutyhallsstaffofany accidentorincidentoccurringinHallsandmustalsonotify theResidencesManageror theon-site/on-dutyhallsstaffiftheyareill(exceptforminorailments).Residentsmust promptlynotifytheResidencesManageriftheybecomeawareofahealthandsafetyhazard thatislikelytoleadtoanaccident. 4.4.5 Residentsmustnotenterrestrictedareasasdesignatedbysignageand/ordirectionby membersofstaff,e.g.maintenance&cleaningstoragecupboards,tankroom,roofarea(s) andliftmotorroom(s). 4.4.6 Residentsmustnotplaceanyitemonoutsidewindowledgesorthroworcause objectstofallfromwindows,balconiesorotherpartsofabuilding. 4.4.7 Residentsmustnotdoorneglecttodoanythinglikelytobehazardousforpeople whomayhavetoworkintheirroomorflat.Thisobligationincludes(amongother things)ensuringthatcablestopersonalelectricalequipmentaresafe,emergency exitsandescaperoutesarenotblockedandmaterialssuchasbrokenglassare disposedofsafelyandwithconsiderationforotherswhomighthavetohandleit. 4.4.8 AResidentmustnotactinanywaythatputsTHSCPortfolio1Limited’s,insurance,the healthorsafetyofothersorTHSCPortfolio1Limited’sorother’spropertyatrisk. 4.5Alterationsanddamage 4.5.1 ResidentsmustnotmakeanyalterationtotheirroomortoTheCostumeStoreorgrounds. 4.5.2 Residentsmustnotcauseanydamagetotheirroom,ortoTheCostumeStoreorgrounds. 4.5.3 Residentsmustnotremoveanyfurnitureorfurnishings(includingcurtains)fromtheirrooms orfromTheCostumeStore. 4.5.4 Residentsmustnotbringanyfurnitureorfurnishings(includingcurtains)intotheirroomsor TheCostumeStore. Accommodation Services Tenancy Regulations 2016-17 4 4.5.5 Residentsmustnotrearrangethefurnitureorfurnishingsintheirroomunlessthenew arrangementcomplieswithapplicablesafetystandards.Attheendofthetenancyperiod Residentsmustleavethefurnitureandfurnishingsintheiroriginalpositions. 4.5.6 Residentsmustnotaffixanyaerial,cupboard,bookcase,shelf,picture,hookoranyother itemtothewalls,ceilingorwoodworkintheirroom. 4.5.7 TheadditionaldamagechargesforTheCostumeStorecanbeobtainedfromTSHCPortfolio 1.Bysigningthetenancyagreementtheresidentacceptsthesecharges. 4.6Noiseandnuisance 4.6.1 Residentsmustnotmakeanynoiseaudibleoutsidetheirroombetweenthehoursof2300 and0700(11.00pmand7.00am)andmustnotmakenoisewhichislikelytodisturbother peopleatanyothertime. 4.6.2 ResidentsarerequiredtohavedueconsiderationforotherresidentsinTheCostumeStore andfortheoccupiersofneighbouringproperties.Residentsmusttakecarewhenentering andleavingTheCostumeStoreandwhenusingaudioequipment,asthesearecommon sourcesofdisturbance. 4.6.3 If,havingbeenoncerequestednottomakeanoise,aresidentsubsequentlymakesnoise, theUniversitywillremoveanyitemcausingorcontributingtothenoisedisturbance.The Universitywillreturntheitemtotheresidentattheendoftheirtenancy,providedthe residentpaystheUniversity’sreasonablestoragecharges.TheUniversitymayadditionallyor alternativelytakedisciplinaryaction.TheUniversitydoesnotacceptliabilityforanylossor damagearisinginsuchcircumstances. 4.6.4 ResidentsmustnotholdapartyinTheCostumeStore(includingthegroundsofHalls) withoutfirstobtainingthewrittenpermissionoftheResidenceManagers.Residentsmust notparticipateinanyunauthorisedparty. 4.6.5 Residentsmustnotbullyothersorbehaveinawaywhichconstitutesassault,harassment, nuisanceorannoyancetostaff,otherstudents,visitorstotheUniversityoroccupiersof neighbouringproperties.TheUniversitywilltreatveryseriouslyanythreatening,menacing, aggressiveorantisocialbehaviorandwilldealwithallegationsofsuchbehaviorunderthe StudentDisciplinaryCode.Wheresuchbehaviourispredicatedonanotherperson's protectedcharacteristic(suchasgender,race,colour,nationality,religionorsexuality)the Universityislikelytoreferthemattertothepoliceandmaytakeactioninternallyunderthe University’sDiversitypolicy. 4.6.6 TheResidenceManagersmayrequireanyResidenttoremovefromTheCostumeStoreany picture,poster,videoorotherrepresentationofanexplicitlyviolentorsexualnatureifin thereasonableopinionoftheResidenceManagersthatitemwouldbelikelytocause offencetoothers. 4.7Securityandkeys 4.7.1 ResidentsmustensurethatentrancedoorstoTheCostumeStoreareproperlysecuredafter enteringorleavingthebuildingandpromptlyreportanyproblemwiththelockingdevices. Accommodation Services Tenancy Regulations 2016-17 5 4.7.2 ResidentsshouldmakesurethatthedoortotheirroomisproperlysecuredandTSHC Portfolio1LTDexcludesallliabilityforlossordamagewherethedoortoaroomhasbeen leftunlocked. 4.7.3 IfaResidentmislayshis/herdoorentrycardorkey,theymustnotifytheResidenceManager immediately.TheResidenceManagerwillarrangeareplacement,buttheResidentwillbe responsibleforpayingthecostofthereplacement(includingreplacementlocksif necessary). 4.7.4 Residentsmustnotalterorduplicateanydoorentrycardorkeyorallowanyotherperson tousetheirdoorentrycardorkey. 4.7.5 ResidentsmustnotallowanyunknownpersonintoHallsunlessthatpersonhasshown reliableidentificationandtheResidentisreasonablysatisfiedthatthepersonhasa legitimatereasontobeattheHalls.ThisregulationdoesnotrequireResidentstochallenge unknownpersonsorattempttopreventthemgainingaccess,particularlywherethe Resident'sownpersonalsafetymightbeputatrisk.TheUniversity'sauthorisedstaff[and contractors]willalwayscarrywiththem,andoffertoshow,anidentitycardwiththeir photographanddetailsoftheperson'sposition. 4.8Lightsandelectrical 4.8.1 Residentsmustpromptlyreporttostaffanymaintenancedefectsespeciallywaterleaks, electricalfaults,breakages. 4.8.2 Residentsmustnotchangeanylightbulborlampshadeintheirroomorinanyotherpartof TheCostumeStore.Ifalightbulborlampshadeneedsreplacing,Residentsshouldcontact Reception. 4.8.3 Residentsshouldnotuseanyformofadditionalheatingintheirroomorinanyotherpartof TheCostumeStoreunlesssuchadditionalheatingissuppliedbytheUniversitywherehalls heatinghasfailed. 4.8.4 Residentsshouldnotusecookingappliances(whichincludeskettles,microwaves,toasters andricecookers)inanypartofTheCostumeStore,exceptinthekitchenareasofHalls. 4.8.5 Residentsmaynotusecubeadapters. 4.8.6 TheResidenceManagermayrequestanyResidentonorafterarrivaltoprovidehim/her withfulldetails(includingmanufacturer,typeofequipment,loading,andwhetherit complieswithrelevantsafetystandards)ofalltheResident'selectricalequipment,which s/heintendstouseinTheCostumeStore. 4.8.7 Residentsmustallowstaffonrequest(aftergivingreasonablenotice)toinspectanyitemof electricalequipment,whichs/hebringsintoTheCostumeStore,andtotestitforsafety. 4.8.8 ResidentsmustnotuseanyelectricalequipmentwhichtheResidenceManager(inhis/her reasonablediscretion)considersunsafeandmusteitherremoveitfromTheCostumeStore within3daysofbeingrequestedtodosoorhanditintotheResidenceManager,tobe collectedattheendofthetenancyperiodor(ifearlier)ontheResidentgivingan undertakingtoremovetheitemfromTheCostumeStorethatday. 4.9Cleanlinessandkeepingingoodcondition Accommodation Services Tenancy Regulations 2016-17 6 4.9.1 EachResidentmustkeephis/herroom,includingthefurniture,fixturesandfittingsclean, tidyandingoodcondition. 4.9.2 IfinthereasonableopinionoftheResidenceManageraResident’sroomisinsucha conditionastobeahazardtohealthorlikelytocausedamagetoTSHCPortfolio1LTD propertyorcontents,theResidenceManagermaygivetheResidentwrittennoticetoreturn theroomitsproperconditionwithin48hours.Ifonfurtherinspectiontheroomhasnot beencleanedandtidiedtotheResidenceManager'sreasonablesatisfaction,theResidence ManagermayemploycleanersandchargethecoststotheResident.(pleaserefertothelist ofchargesforTheCostumeStore). 4.9.3 TheadditionalcleaningchargesforTheCostumeStorecanbeobtainedfromTSHCPortfolio 1LTD.Bysigningthetenancyagreementtheresidentacceptsthesecharges. 4.10Sharedareas 4.10.1 ResidentsinTheCostumeStorehavesharedresponsibilityforsharedareassuchaskitchens, andmustkeepthemclean,tidyandingoodcondition. 4.10.2 EachResidentmustcleanupafterthemselvesimmediatelyafterusingasharedarea,paying particularattentiontowashingupcookingutensils,cutleryandcrockery,andwipingup spillagesoncookersandworksurfaces. 4.10.3 Whereacleaningserviceisprovided,domesticstaffwillcleansurfaceareas,butwillnot cleankitchenequipment,utensils,cutleryorcrockery.Decayingfoodorunwasheditems whichappear(inthereasonablediscretionofthedomesticstaff)toconstituteahazardto healthmaybedisposedofbythedomesticstaffandTSHCPortfolio1LTDwillnotbeliable tocompensatetheResidentforanypersonalbelongingsdiscardedforthisreason. 4.10.4 IfResidentssharingakitchendonotkeepitcleanandtidyTSHCPortfolio1LTDmaybringin cleaners(eitheronsitestafforexternalcleaners)andre-chargethecosttotheResidents whosharethatfacility(pleaserefertothelistofchargesforTheCostumeStore). 4.10.5 Wheredamage(s)tosharedareashasoccurredandasingleResidenthasnotbeenidentified and/oracceptedresponsibilityTSHCPortfolio1LTDshalldividetheassociatedcosts betweenmultipleResidentsasreasonablyaspossible.AllResidentsreceivinganinvoicefor costsofthiskindhavearighttoappeal.Allappealsmustbemadeoutinwritingtothe ResidentialManagerandsubmittedwithin7workingdaysofthedateoftheinvoice.The ResidentialManagerwillrevieweachcaseindividuallyandinstructtheResidentwithina further10workingdaysoftheirdecision. 4.11Overflowsandblockages 4.11.1 Residentsmustnotusebaths,basins,sinksorstoragesystemsinawaythatmakesthem,or wouldbelikelytomakethemoverflow.Paints,plaster,chemicalsandanyothersolidwaste mustnotbedisposedofusingthesink. 4.11.2 Residentsmustnotcauseanyblockageinanytoilet,wastepipeordrain. 4.11.3 ResidentsmustpromptlyreporttotheResidenceManagersanyblockage,overfloworany disrepair,whichislikelytocauseablockage,overflow. 4.12Picturesandnotices Accommodation Services Tenancy Regulations 2016-17 7 4.12.1 Residentsmustnotputpictures,postersorotherdecorationsonanysurfaceinTheCostume Storeexceptonthepinboardsprovidedforthatpurposeandmustpayforanydamagethey causebyfailingtocomplywiththisregulation. 4.12.2 Residentsmustnotdisplayanypictures,posters,advertisementsorothersignsintheir roomsorinTheCostumeStore(otherthanmessagesofatemporary,domesticnature)soas tobevisiblefromoutside. 4.13Pets ResidentsmustnotkeeppetsorotheranimalsintheirroomsorinHallsunlesstheResidenceManager hasgiventheirwrittenpermission(whichwillnotbeunreasonablywithheldwheretheanimalis necessaryandtrainedfortheassistanceofadisabledperson). 4.14University'sreputation WhetherattheHallsorelsewhere,Residentsmustnotbehaveinawaywhichcouldbereasonably beconsideredtobringthenameoftheUniversityintodisrepute. 4.15Tenancyagreement 4.15.1 ResidentslivinginTheCostumeStoremustcomplywiththetermsoftheirtenancy agreement. 4.15.2 TheUniversitymaytakecourtactiontoenforcethetermsofatenancyagreementand/or disciplinaryactionundertheDisciplinaryCode(AccommodationServices). 4.15.3WhereabreachofthetermsofaResident’stenancyagreementisalsoacriminaloffenceit isTSHCPortfolio1LTDpolicytoreportsuchmatterstothepolice. 4.15.4 Indecidingwhethertotakecourtactionand/ordisciplinaryactionand/orreferamatterto thepolice,TSHCPortfolio1LTDshalltakeintoaccountanypenaltiesalreadyimposedor likelytobeimposedontheResident. 4.15SmokingPolicy 4.15.1 Itisacriminaloffencetosmokeinsharedareasinsidehalls.Since1stJuly2007allUniversity oftheArtsLondonhallsofresidencehavebeensmoke-free.Smokingisnotpermittedinany partofthebuildingincludingstudybedrooms,corridors,kitchens,bathrooms,andcommunal areas.SmokingwithinthegroundsofTheCostumeStoreisonlypermittedoutofdoorsin thedesignatedsmokingareas. 4.15.2 InsideHalls,Residentsmustnotusee-cigarettes,sheeshapipesorotherdevicesdesignedor intendedtobeusedforcreatingorinhalingsmokeorvapour. 4.15.3 TSHCPortfolio1LTDwilltreatanybreachofthisregulationasaseriousbreachofthe Resident'stenancyagreementwhichcouldleadtodisciplinaryactionbeingtakenunderthe University’sAccommodationServicesDisciplinaryCode 4.16Theft Accommodation Services Tenancy Regulations 2016-17 8 4.16.1 ResidentswillnotremovepropertythatbelongstootherresidentsortotheUniversity withoutpriorpermissionfromtherightfulowner. 4.16.2 AnyallegationoftheftbyaresidentwillbeinvestigatedundertheDisciplinaryCodesetout insection5oftheseregulations.However,theftisacriminaloffenceandAccommodation Serviceswillalsoreferthematterforthepolice. 4.16.3 Anyprovenincidentoftheftwillbedealtwithasaseriousbreachoftheresident’stenancy regulationsanddealtwithundertheDisciplinaryCodesetoutinsection5andmayleadto terminationoftheResident’stenancy. 5DisciplinaryCode 5.1 5.2 5.3 5.4 5.5 5.6 5.7 5.8 WhereaResidentisinbreachoftheobligationsintheirtenancyagreementorhasfailedto complywithTheCostumeStoreregulations,TSHCPortfolio1LTDand/ortheUniversitymay (whereappropriate)referthemattertothepoliceand/orbeginproceedingsintheCounty Courtand/ortreatthematterasadisciplinaryissue. Inseriouscasesafteradisciplinaryhearing,orasanalternativetoadisciplinaryhearing underthiscode,theResidentialOperationsManager,ortheHeadofAccommodation ServicesmayreferthemattertotheResident'sHeadofCollegeandorDeanofStudentswho may,inappropriatecasesandhavingregardtotheoutcomeofanyproceedingsunderthis code,takeactionundertheDisciplinaryCodeforStudents. ThisCodesetsouttheproceduretobefollowedbytheUniversityandtheResidentwhen disciplinaryactionistaken. AllegationsofabreachofthetenancyagreementorabreachofHallRegulationsshallbe madetotheResidenceManagerwhowillinvestigatetheallegationandendeavourtoestablish thefacts. IfinthereasonableopinionoftheResidenceManagertheallegationissubstantiatedbut notserious,thentheResidenceManagershallgivetheResident(s)averbalorfirst writtenwarning,whichmayberecordedontheResident'sfilefortheremainderoftheir tenancyperiod. IfinthereasonableopinionoftheResidenceManagertheallegationissubstantiatedand serious,thentheResidenceManagercangivetheResident(s)theirsecondwarning,which mayberecordedontheResident'sfileforupto12months.Dependingontheseriousness ofthebreachasecondwarningcanbeissuedwithoutafirstwarninghavingbeenissued. TheResidenceManagercanalsoissueasktheResidenttoenterintoaGoodNeighbour Agreementatanytime. AResidentmayappealagainstthedecisionoftheResidenceManagerbywritingtothe ResidentialOperationsManagerwithin5workingdaysofbeingnotifiedofthedisciplinary decision. If,inthereasonableopinionoftheResidenceManager,anallegationisseriousandif, afterinvestigation,theResidenceManagerreasonablyconsidersthatthereisacaseto answer,theUniversity'sAccommodationServicesdepartmentwillnotifytheResidentin writingoftheallegationsmadeagainsthim/herandoftherequirementtoattenda disciplinaryhearingataspecifieddate,timeandplace. Accommodation Services Tenancy Regulations 2016-17 9 5.9 5.10 5.11 5.12 5.13 5.14 TheResidentshallhaveatleast48hours’noticeoftheproposeddisciplinaryhearing, andshallbeentitledtobringafriendorrepresentativeand,ifreasonablyrequired,an interpretertothehearing.InthisinstancetheResidentshallgivetheUniversity’s AccommodationServicesdepartment24hours’noticeofthisintention. ThedisciplinaryhearingwillbeconductedbytheUniversity'sAccommodationServices personnel.Nopersonwhomadeanallegationorwasinvolvedinthepreliminary investigationshallhearthecase,thoughtheycanbepresentatthehearing. TheResidentmayrespondorallytotheallegationsorsubmitawrittenstatementandany writtenwitnessstatements.TheResidentmayaskrelevantquestionspertainingtothe allegation(s).Allwrittenstatementsmustbeformallysubmitted24hrsbeforethetimeofthe disciplinaryhearing. AccommodationServicespersonnelmayaskrelevantquestionsoftheResidenttowhom theallegationspertainandofanywitnessescalledbytheResident. Iftheallegationisfoundnottobesubstantiated,nofurtheractionwillbetakenagainst theResident. Iftheallegationisfoundtobesubstantiated,dependingontheseverityofthetenancy breach(es)theUALstaffmemberconductingthedisciplinarymeetinghasthepowerto imposeoneormoreofthefollowingpenaltiesandshalltakeintoaccountanypenalty alreadyimposedinrelationtothesamematterbyanyotherbody: (a) afirstwrittenwarning,toberecordedontheResident’sfilefortheremainderoftheir tenancyperiod. (b) asecondwrittenwarning,toberecordedontheResident'sfilefor12months. (c) athirdandfinalwrittenwarningtoberecordedpermanentlyontheResident’sfile. (d) arequirementfortheResidenttogiveawrittenundertakingastotheirfutureconduct. (e) anorderthattheresidentismovedtoanotherroomtoanotherroomofsimilar costandstandard. (f) anorderthattheResidentpaysforlossordamagewhichtheyhavecaused. (g) areferraltotheResident'sHeadofCollegeand/orDeanofStudents,incasesof veryserioustenancybreachwhomay,inappropriatecasesandhavingregardtothe outcomeofanyproceedingsunderthiscode,takeactionundertheStudent DisciplinaryCode.ApplicationoftheStudentDisciplinaryCodecanresultin immediate72hrsuspensionfromcollegependingfurtherinvestigationandif, followinginvestigation,anallegationissubstantiated,possiblesanctionsare: (iii)areprimandtobewrittenontheResident’sfile; (iv)awrittenwarningand/orrequirementtogiveawritten undertakingastofutureconduct; (v)paymenttobemadeforanylossordamagecausedeitherfully orinpart; (vi)withdrawalofregistrationforaperiodofupto12months; (vii)recommendationofexpulsion. (h) anorderthattheResident’stenancyagreementisterminated(subjecttodue processoflawandtherequirementsoftheProtectionfromEvictionAct1977andthe HousingAct1988).IfUALwishestheResidenttoleave,UALshallservenoticeonthe Residentundersection8HousingAct1988and,ifnecessary,applytocourtfora Accommodation Services Tenancy Regulations 2016-17 10 possessionorder.InanyproceedingsUALwillclaimanysumstheResidentowes plusinterestandcosts. TheUniversity’sAccommodationService’sdepartmentwillprovidewrittenconfirmationof anydecisionwithin5workingdaysofthedisciplinaryhearing 5.16 TheUniversity’sAccommodationService’sdepartmentshallmakeawrittenrecordof thehearing,whichwillincludethereportoftheinvestigation,asummaryofthe evidenceheardorpresented,andthedisciplinarypanel’sfinding.Thiswillbemadeavailable uponwrittenrequestbytheResident. 5.17 TheResidentmayappealagainstthedecisionoftheUALstaffmemberconductingthe disciplinarymeetingbywritingtotheHeadofAccommodationServiceswithinfiveworking daysofbeingnotifiedofthedisciplinarydecision.Theappealwillnotbetreatedasarehearing,butwillbeheardonthebasisofareviewoftheoriginaldecision.TheHeadof AccommodationServiceshasthepowertoreversethedecisionofthedisciplinarymeeting reducethepenaltymadebythedisciplinarymeeting,orupholdtheirdecision.5.18 If theUniversityhasfoundagainstaResidentatadisciplinaryhearingandthatResidentis subsequentlyinbreachoftheseRegulations,theResidentmaybesubjecttofurther disciplinaryproceedingsundertheseRegulations.Dependingontheseriousnessofthe actualandallegedbreaches,theResidentialOperationsManagermayreferthematterto theResident'sHeadofCollegeortheDeanofStudentsasanalternativetoadisciplinary hearingundertheseRegulations.TheHeadofCollegeortheDeanmay,inappropriate casesandhavingregardtotheoutcomeofanyproceedingsundertheseRegulations,take actionundertheStudentDisciplinaryCode. 5.19 Additionallytotheregulationscontainedherein,residentsortheirguests,whilstinhallsof residence,shallnotbehaveinanywaythatbreaksthelaw.AnyactionorbehaviourinThe CostumeStorethatisagainstthelawcouldbedisciplinedinaccordancewiththiscode, referredtotheResident’sheadofcollegeand/orreferredtothepolice. 5.15 6.UniversityoftheArtsLondonDebtCollectionProcedure–OnbehalfofTSHCPortfolio1LTD 6.1 6.2 6.4 6.5 TheAccommodationServicesCentralFinancePersonnelwillsendareminderletterto Residentswhohavenotpaidthefirstpaymentofrent.Thisletterwillbesentwithin7days ofthefirstpaymentbecomingdue. Ifrentremainsunpaidforafurther14daysafterthedateofthereminderletter,,the AccommodationServicesCentralFinancepersonnelshallsendaNoticeofBreachletter detailingthenatureofthebreachandgivingtheResidentafurther7daystoremedythe situation. IfrentorfeesremainsunpaidafterthedatespecifiedintheNoticeofBeachletterthe AccommodationServicesCentralFinancePersonnelshallreferthecasetotheHeadof AccommodationServicesforreview.TheHeadofAccommodationServicesshallrefercases totheCreditControlunlessthereisasubstantialandcompellingreasonfornotdoingso. WhereacaseisreferredtotheCreditControlwhethertheresidenthasleftorremainsin occupationofTheCostumeStorethefollowingwilloccur: 6.5.1 WhereadebtorhasceasedtobeaResident,aletterofdemandwillbesenttothedebtor's lastknownpermanentaddresswithinsevendaysofthereferralbytheHeadof Accommodation Services Tenancy Regulations 2016-17 11 AccommodationServices.Theletterwillstatethatifpaymentisnotreceivedwithin7days thenproceedingswillbestartedforrecoveryofthedebt. 6.5.2 Iftheletterofdemandisreturned,theAccommodationServicesDepartmentmayinhis/her reasonablediscretionemployatracingagent. 6.5.3 14daysaftertheletterofdemand(thisallowstheResidentafurther7daysleeway)the CreditControlDepartmentwillcheckwithotherrelevantdepartmentswhetherpayment,or arealisticofferofpayment,hasbeenreceived.Ifthereisnopaymentorrealisticoffer,the CreditControlDepartmentwillsendthefiletoanexternaldebtcollectionagency 6.5.5 TheCreditControlDepartmentwillreturnresidentsfiletoAccommodationServiceswho willreferthefiletothelandlord’ssolictiors. Feepaymentarrangements 6.6 6.7 6.8 TheCreditControlDepartmenthasauthoritytoacceptoffersofpaymentfromResidents whichamounttolessthanthetotalsumoutstanding,butonlyafterconsultationwiththe HeadofAccommodationServicesandobtainingtheapprovaloftheDirectorofEstatesThe DirectorofEstatesandDeputyViceChancellorhaveauthoritytowrite-offthebalanceofthe debt. WheretheCreditControlDepartmentagreesapaymentinstalmentschedulewithadebtor, theyshallconfirmthescheduleinwritingtotheResidentandeachschedulemustreserve therighttoresumethedebtrecoveryprocedureifthedebtordoesnotmeettheagreed paymentprogramme. Debtsmaybepaidbystandingorder,cheque,creditordebitcard.InternationalResidents maymakeapaymentbybanktransfer.Shouldpaymentbemadebybanktransferthefull amountdueinGBPSterlingmustbereceivedintheUniversityoftheArtsLondonbank account.TheResidentremainsliableforanybankchargesandanyfluctuationsinthe exchangeratewhichaffectthefinalamountinGBPSterlingreachingtheUniversityofthe ArtsLondonbankaccount.TheCreditControlDepartmentshallissueareceiptand(where applicable)astatementshowingthebalanceoutstanding. 7.MovingOut 7. 1 7.2 7.3 Residentsshouldremoveallpersonalpossessionsandreturnkeystoreceptionby10.00am andcomplywiththecheck-outproceduresdistributedpriortocheck-out.Thisincludes makingsurethatdoorsarelockedandwindowsarefirmlyclosedwhenleaving.IfaResident failstoleavetheroomsecure,theLandlordmaychargetheResidentfortheft,lossor damagethatmayoccurbeforetheLandlordhastheopportunitytomaketheroomsecure. Thebedroomshouldbeleftinthesameconditionandstateofrepairastheroomwas received.Tenantsshouldensuretheycleanthebedroomandensuiteincludingremoving rubbishandclearingnoticeboards. Residentsshouldensureallpersonalbelongingsareremovedfromallcommunalareas.The kitchen/loungeshouldbecleanedandleftinanadequateconditionofcleanliness. Tenantsshouldclearallitemsattheendofthetenancy,iftheResidenthasleftanitemby mistake,orifitappearstotheLandlord’scleanerstobeworthmorethan£50,theLandlord willtakereasonablestepstonotifytheResidentusingthecontactdetailsmostrecently providedbytheResident.TheLandlordwillnotbeliableforanydamage,lossortheftof itemsstoredfortheresidentifleftinthepropertyattheendofthetenancy. Ifleftitemsarenotcollectedwithin14daysofnoticebeinggiventotheResident,orifthe LandlordisunabletomakecontactwiththeTenant,theLandlordmaydisposeoftheitems withoutliabilitytotheResident.TheResidentshallbeliabletotheowneriftheyarenotthe ownerthemselves. Eachbedroom/studio/kitchen/loungewillbeinspected.Residentswillbeinvitedto book/attendtheinspection.Inspectionswillbecarriedoutandassessedagainsttheoriginal inventorytheresidentcompletedonarrival.Ifatenanthasnotreturnedtheinventory damagesmaybeliabletotheresident. Ifexcessivecleaningandmaintenanceisrequiredtoreturnthebedroomintoitsoriginal statetenantswouldberesponsibleforthecostsoftherequiredwork.Asstatedinthe contract,TSHCPortfolio1LTDwouldberesponsibleforfairwearandtear;anycoststhat theresidentsareresponsibleforwouldbedeductiblefromthedeposit.Allpossible deductionsareoutlinedinsection2ofthetenancyagreement. Withinclusterflatsallresidentsareequallyresponsibleforthecommunalareas,areasinside theflatdoor,upuntilandincludingthelastdayofthecontract.Anydamage,cleaning changesissuedforthatclusterflatwillbesharedbetweenalltenants.Residentsare responsibleforthecommunalkitchen/loungefortheentirecontractperiodevenifthey leavetheschemeearly. TSHCPortfolio1LTDwillreturnthedepositundertheTDSregulations.Atthetimeofthis documentbeingcreatedthepermittedtimewithininwhichreturnthedepositis28working days. InitiallyanydisputeswillbediscussedbetweentheresidentandtheLandlordorthe LandlordsAgent.IfdisputescannotbeclosedthenTheDisputeServicearetheindependent servicetheresidentshouldcontact.
