Notes on Use
K.S.A. 38-2371(a)(1) permits the state to file a motion requesting imposition of a departure
sentence. The reasons and factors relied upon in requesting the departure sentence shall be stated.
The factors provided in K.S.A. 21-6815(c)(2) and K.S.A. 21-6816(a) may be considerations in
specific circumstances. The court may enter a departure sentence on its own volition, if notice
(Form 353) is given to all parties and a reasonable time allowed for response.
