f4_chat session 5 June

[05:06:26] werty : Hi, sorry I'm late - there's a "strong-man" competition in
the city and traffic is horrible
[05:06:40] rawasia : :) no worries
[05:06:41] tauseef89 : it alright
[05:06:44] spencerli : hi werty
[05:06:45] shehz : its k
[05:06:49] accastudent110 : no prob
[05:06:50] accountantkenny : {werty} haha i
[05:06:50] shehz : Hello werty
[05:06:59] werty : Let's aim to finish at 12.10 - that'll give you your full hour
[05:07:00] accountantkenny : {werty} hi
[05:07:05] rawasia : {werty} can i start ask sumthing? :)
[05:07:14] werty : {rawasia} that's why I'm here
[05:07:19] shehz : lol
[05:07:31] werty : but can you please change your font colour?
[05:07:49] tauseef89 : Werty what is best to do at moment before exam only
Mock exams Selected topics or revision of what sort ?
[05:07:55] rawasia : {werty} :) ok in OT course notes the Partnership
section...many of the things are missing
[05:08:16] rawasia : {werty} k
[05:08:17] shehz : who among you are for ENG paper?
[05:08:25] rawasia : {Shehz} me
[05:08:27] tauseef89 : I am ENG
[05:08:28] missmalik : me
[05:08:30] mohinee18 : me too
[05:08:36] shehz : ok great
[05:08:38] accastudent110 : m eng
[05:08:41] werty : {tauseef89} I think I'd be prepared at this late stage to be
reading qs, planning answers ( 5 minutes plan to see if you've got 10 things to
say ) and then checking your answer against the rev kit.
[05:08:45] tophigh : m eng
[05:08:56] werty : That should highlight any areas where you are particularly
weak
[05:09:03] accountantkenny : {werty} why some company name end with co
ltd and some end with only co ?
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:09:08] tauseef89 : thanks werty
[05:09:18] werty : {rawasia} yes, I think I've done a podcast on the session
[05:09:38] werty : Post it on the "ask the tutor " page and I'll fill in the three
mnemonics
[05:09:38] rawasia : {werty} any link??? :S
[05:10:01] missmalik : {werty} i have a basic question about exam solution.
both BLue and Black pens allowed???
[05:10:05] rawasia : {werty} i even posted on forum but no response n it has
been like 4 days :s
[05:10:09] tauseef89 : Black !
[05:10:28] rawasia : F4 u can use blue also tauseef
[05:10:28] werty : {accountantkenny} The ones ending in just "co" are not
separate entity companies - they are businesses - sole traders or partnerships.
[05:10:39] missmalik : i am asking for Solution. not to encircle the MCQ,
[05:10:55] accountantkenny : {werty} ok thank
[05:10:58] werty : If it's a co, the word limited ( or its abbreviations ) or plc
( or in full ) should be at the end of the name
[05:11:06] tauseef89 : For doing whole Exam Miss malik u should use Black
ball point
[05:11:27] shehz : {werty} i am having problem for Agent authority
[05:11:35] werty : {missmalik} black only, sorry. the scripts will be scanned to
the markers, and blue doesn't scan well
[05:11:39] missmalik : {tauseef89} i used Blue+black in CAT examz, so?
[05:11:50] tophigh : {werty} do we have to list the case names in the paper?
sometime we just remeber some words of the name not the whole
[05:11:58] werty : {rawasia} post on ask the tutor - it's at the bottom of the
forum page
[05:12:06] missmalik : {werty} iused i used Blue n Black in CAT exams
[05:12:14] rawasia : {werty} will do tht
[05:12:18] tauseef89 : missmalik ACCA changed method of Marking Black is
much more compatible with new PDF marking
[05:12:26] accastudent110 : are there more marks if we remember case
names as opposed to just remembering the gist of the case?
[05:12:30] werty : {rawasia} use black - even if you are correct ( and I don't
think you are ) still use black - it's safer
[05:12:47] werty : {Shehz} ask
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:12:53] shehz : {werty} Thanks.. need to buy some black pens
[05:12:54] rawasia : ya black it is..
[05:13:08] werty : {Tophigh} "In a decided case..." is enough
[05:13:18] missmalik : {tauseef89} i am more comfortable wth headings in
Black and Solution in BLUE... will that works?
[05:13:25] werty : Names are better or even "in the flick knife case ..."
[05:13:38] rawasia : {werty} about some cases wich are on the back of OT
course notes are not even in bpp...wht bout tht?
[05:13:41] tophigh : got it
[05:13:53] shehz : {werty} shall we use '' '' while writing the cases?
[05:14:07] werty : {accastudent110} I believe it's a better answer - but the
examiner and markers know how difficult it is to remember case names
[05:14:24] werty : {missmalik} Just use black!
[05:14:25] tauseef89 : Missmalik, It would be better to use only Black no
other colour to be on safe side
[05:14:37] missmalik : {werty} Okay
[05:14:38] tauseef89 : no need to make heading in F4
[05:14:45] accastudent110 : so its possible to get full marks in a qstn despite
not remembering the exact case names?
[05:14:48] missmalik : {tauseef89} no headings?????????
[05:14:50] werty : {rawasia} but you'll find them in Google! I wrote my notes
independently of BPP
[05:14:51] shehz : {missmalik} yes... better black.. avoid problem
[05:14:52] zain009 : will we get marks if we mention briefly the principle of
the case and not mentioning the name of the case ?
[05:14:53] tauseef89 : yes
[05:15:12] accountantkenny : {werty} sir can you give us a name of all case
answer from the course note Thank you
[05:15:16] werty : {Shehz} no don't use " " but do underline the case name
( if you can remember it!
[05:15:30] werty : {accastudent110} yes
[05:15:36] tophigh : {werty} do we have to discribe the case or just conbine
the case and the qs
[05:15:45] tauseef89 : miss malik no heading in F4 answer in small
paragraphs
[05:15:55] missmalik : {tauseef89} Okay thanx
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:15:56] shehz : {werty} ok
[05:16:02] shehz : {werty} ty
[05:16:07] polishgirl : Werty is it possible that in UK and GLO variant we have
a question regarding damages, and the answer in each of them might be
different? I mean in UK use lots of cases in GLO use UN Convention on
Contracts
[05:16:12] rawasia : {werty} google?? er...this time :P
[05:16:22] werty : {missmalik} all the examiners, and markers, like headings.
trouble is, in a 10 mark question, there's not much room for headings! effectively you're going to be usinga heading for every 2 or 3 points!
[05:16:35] werty : {zain009} yes
[05:16:48] zain009 : (werty) thanks
[05:16:50] shehz : {werty} what is the google link?
[05:16:52] accastudent110 : if in a partnership qstn no mention is made of
limited should we just assume that its a traditional partnership?
[05:17:05] werty : {accountantkenny} not sure I understand your question but I think the answer has got to be "No"!
[05:17:14] missmalik : {werty} so should i giv soution with Headings or just
paragraphs like given in Kaplan KIT
[05:17:34] tauseef89 : Miss malik Kaplan kit Approach
[05:17:34] shehz : {missmalik} just like kaplan kit
[05:17:37] werty : your exam is on Tuesday - the course notes and the study
texts and the rev kits have got all the cases you could ever need - and then
some more as well.
[05:17:38] accountantkenny : {werty} ok
[05:17:49] werty : Just read and read and read the suggested solutions
[05:18:06] missmalik : thanks
[05:18:13] zain009 : {werty} can you please briefly tell us how to tackle
scenario questions and in what way it should be answered ?
[05:18:15] shehz : do anyone have the December 2001 past paper?
[05:18:16] rawasia : from wich years of past papers u wd sugest reading>?
[05:18:19] werty : {polishgirl} yes, but which variant are you doing - that will
dictate your answer
[05:18:33] polishgirl : {werty} ok thx, i was curious
[05:18:42] werty : {Shehz} put the case name in google and see what comes
up
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:18:49] werty : {accastudent110} yes
[05:18:53] shehz : {werty} ok thanks
[05:18:57] tauseef89 : Zain 009 Identify key Issues/ Explain Define Rules and
Law, Apply the LAw, Gave Conclusion
[05:19:13] zain009 : thanks tauseef
[05:19:16] tauseef89 : Scenario Solved
[05:19:32] accastudent110 : ok thnx
[05:19:32] werty : {missmalik} I would do just paragraphs - effectively one
sentence per paragraph, no more than 3 lines long, and leave a line between
your paras
[05:19:46] missmalik : {werty} i saw a case study given in student accountant
2010 with name DAMAGES, they told an approach about solving Case study,
should v exactly follow that? with headings?
[05:19:46] spencerli : {werty} A lot of the time the scenario questions
resemble a decided case. Is it okay just to describe that case and give the
conclusion based on that?
[05:19:52] werty : {rawasia} the last 10!
[05:19:55] rawasia : {werty} nice nice...bout paras
[05:19:58] werty : as many as you can
[05:20:05] rawasia : {werty} 10 years???
[05:20:25] shehz : {werty} do you have the Dec 01 past paper?
[05:20:48] werty : {missmalik} yes, I read that too - could you write that out
in 18 minutes? Could you even read it in 18 minutes?
[05:20:51] tophigh : {werty} do we just discribe the case or combine it with
the qs
[05:21:20] missmalik : {werty} no, but i am asking about the approach style
[05:21:31] accastudent110 : i have never understood the case of chapell n co
vs nestle co,can u explain it?the bpp text is very brief on this..it says that choc
wrappers are sufficient as they are identifiable..what actually happened?
[05:21:42] werty : {spencerli} Reference to the case is good - BRIEFLY give
the "facts" of the case, then apply the facts of the scenario to the same case
and reach a conclusion
[05:22:03] werty : {Shehz} no, is it not on ACCA website?
[05:22:27] spencerli : {werty} thanks. it's okay if we come up with a different
conlusion than the model answer?
[05:22:29] rawasia : {Shehz} dec 01? really..dude :)
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:22:30] werty : {Tophigh} Please change font colour - you should link it to
the question
[05:22:56] shehz : {werty} ok.. asking because its on Exams ips Dec 01 Agent authority
[05:23:23] shehz : {rawasia} read the tips on this site
[05:23:27] shehz : need that paper!
[05:23:32] werty : {missmalik} "Identify the area of law and the problem,
define anything which needs defining, expand the detail from the question into
the area of law, and arrive at a conclusion / advice"
[05:23:34] sair : {werty}- do the answers have to be as detailed and long as
what is suggested in the exam kits and past papers?
[05:23:37] rawasia : {Shehz} i have it in front of me...yes it is here
[05:23:52] shehz : {rawasia} can u send me plz?
[05:23:58] werty : {accastudent110} put that one into the "Ask the tutor" and
I'll get to it later today
[05:24:09] accastudent110 : ok thnks
[05:24:14] rawasia : {Shehz} wht i meant was the exam tips....sorry :(
[05:24:24] shehz : {rawasia} ok...
[05:24:31] shehz : {rawasia} Np :)
[05:25:07] missmalik : Exam tips every worked before provided by OT..?
anybody knows???????/
[05:25:09] werty : {spencerli} yes, so long as your answer is well argued. It's
more likely that it's not an "either or" situation, so reaching the wrong
conclusion where it is definitely wrong will not score well, but it won't be a total
catastrophe
[05:25:26] zain009 : {werty} how many questions from Kaplan Exam Kit you
think we should definitely revise on each topic ? and is it ok if we read through
answers because sometime you can't remember answer of every question ?
[05:25:33] rawasia : {werty} lifting the veil...can u help me wid tht in group
portion
[05:25:33] werty : {Shehz} then it's in the rev kit
[05:25:50] priteshga : Hello people
[05:26:09] shehz : {werty} Thanks werty... i havent checked that on the
exams kit yet
[05:26:11] werty : {sair} how can you possibly think you could achieve that
length in 18 minutes? ABSOLUTELY NO, NO, NO
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:26:59] priteshga : does anuone know what questions in the BPP revision
kit are similar to facts of Williams v Roffey Bros?
[05:27:01] werty : {zain009} as many as you can - is the simple advice.
[05:27:23] rawasia : {Shehz} i got tht question :)
[05:27:29] shehz : {zain009} need brain to remember all that man!
[05:27:42] missmalik : <b>{Shehz} Exam tips every worked before provided
by OT..? anybody knows???????/</b>
[05:27:45] werty : {rawasia} acknowledge that a group of companies is a
single commercial entity, even though all indiv cos in the group are legally
separate
[05:27:51] accastudent110 : in the bpp rev kit in scenario qstns almost 90%
of the answers explain the thoery(knoledge part) of the qstn,in the end only a
small paragraph actually applies to the facts of the case in th qstn.should we
also do this?
[05:27:53] accountantkenny : {werty}is it important to state the section for
each act for a relevent question . will we be penalise
[05:28:06] zain009 : {Shehz} oh ya I think understanding the concept is
enough and then elaborate it in own words
[05:28:16] werty : {priteshga} none - from memory
[05:28:25] sair : {werty} so as long as the key points, arguments and points of
law/principles are there, it is possible to score 10 marks?
[05:28:26] shehz : {zain009} yeah.. u r right
[05:28:29] rawasia : {werty} ah yes :)...thnx
[05:28:39] tophigh : {werty} is there any strong relationship with the last
exam?
[05:28:40] werty : {missmalik} they're only guesses!
[05:28:47] shehz : {missmalik} i can't understand what you mean
[05:29:01] shehz : {rawasia} which page?
[05:29:13] rawasia : BPP kit...question 49
[05:29:17] missmalik : <b>{Shehz} whats the past record of these guesses
provided by OT</b>
[05:29:30] werty : {accastudent110} ask yourself - "Can I get 10 different
relevant ppoints from this scenario?" If you can, then do it. If you can't, then go
into generalisations
[05:29:33] missmalik : <b>{Shehz} ever worked or Never?</b>
[05:29:42] werty : {accountantkenny} NO, NO, NO
[05:29:56] werty : {zain009} change font colour please
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:29:57] yaasir : <b>can u snd the guesses provided by ot</b>
[05:29:59] accountantkenny : {werty} ok
[05:29:59] shehz : {missmalik} well.. i never checked if it worked
[05:30:04] werty : {sair} yes
[05:30:07] rawasia : {Shehz} question name...TYPE OF AUTHORITY
[05:30:22] werty : {Tophigh} yes, they are both set by the same examiner!
[05:30:28] spencerli : {werty} I'm a little confused with exclusion clauses.
They are valid if they have been signed, even if they have not been read
(L'Estrange). But in another case, i forget the name, but it's to do with liability
of a fire at a car garage - the garage is found to be liable even though signed.
[05:30:30] deathcase : {werty} can you plz explain special notice
[05:30:45] accastudent110 : so if i can get more points frm the scenario i can
count them as part of the ten points
[05:30:58] werty : {yaasir} they're on this website
[05:31:04] yaasir : <b>ok</b>
[05:31:06] yaasir : <b>thnx</b>
[05:31:09] sair : people have suggested that i memorise answers from the
revision kit, this isn't the correct way is it?
[05:31:43] zain009 : {sair} memorising each word isn't a correct way , just try
to understand the principle
[05:31:50] shehz : {rawasia} Thanks
[05:31:58] shehz : {rawasia} i got it
[05:32:09] rawasia : {Shehz} gud.. :)
[05:32:26] shehz : {sair} yeah... try understand the way to do it
[05:32:27] werty : {spencerli} Hollier v Rambler Motors? Needs to have been a
history of trade ( I don't think the exclusion / contract was signed ) Garage
claimed a history of trade. 3 time sin 5 years was not a "history of trade
[05:32:27] werty : "
[05:32:38] zain009 : {sair} or just highlight main points from the answers and
remember those only
[05:32:49] werty : {deathcase} 28 days notice to the company, 21 days notice
to the members
[05:32:50] rawasia : {werty} in AGM director or auditor cannot be removed
ryt/
[05:32:54] shehz : {sair} Zain009 is correct
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:32:58] chatmasterflex : i think they waffle a lot in the revision kit, like if
the question is for unfair dismisal they will also include the fair reasons and go
on to talk about other types of dismisals
[05:33:07] werty : {sair} you're correct, this is not the way
[05:33:39] werty : {zain009} vhange colour, please
[05:33:41] deathcase : i have been studying really well and have covered
everything from the kit.. memorized then revised, yet sometimes i am not able
to recall the complete answer that i did from the kit... is it normal??
[05:33:59] shehz : {rawasia} they need to be present in the GM to be removed
[05:34:01] spencerli : {werty} Hollier - that's the one. thanks. I must've
gotten a bit confused.
[05:34:03] werty : {rawasia} no, it is possible that they are not reappointed.
[05:34:10] rawasia : {deathcase} yup thts normal :)
[05:34:16] zain009 : {werty} ok
[05:34:26] werty : {deathcase} yes
[05:34:58] accountantkenny : {deathcase} yes me too
[05:35:01] rawasia : {werty} im still confused...if members want to remove a
director/auditor resolution shud be passed but in AGM thy can be removed or
not?
[05:35:16] sair : Looking at those answers have caused me alot of worry and
stress. Do you need to quote exact definitions? example consideration
[05:35:19] deathcase : {werty} so how would you suggest we spend this last
day? bcz there is not enough time to go through everything?
[05:35:47] werty : {rawasia} Directors standing for reelection may find that
they are not reelected - if &lt;50% vote for their reelection. same with auditors
[05:35:53] chatmasterflex : {rawasia} i think they can remove them through
a AGM with a special notice
[05:35:59] rawasia : {deathcase} as werty said ...keep reading the solutions n
revising ur weak areas
[05:36:10] zain009 : {sair} NO you will get it more complicated if u try to
qoute exact definitions , just get them in your words which you think is easy for
U
[05:36:13] werty : {sair} good if you can - not the end of the World if you
can't
[05:36:26] werty : {deathcase} read, read and read again
[05:36:35] rawasia : {werty} now i get it :) thnx
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:37:14] werty : {chatmasterflex} they can remove them, by ordy resln with
spec notice. But equally, the director may find that he / she is simply not
reappointed
[05:37:33] rawasia : {werty} ive done wid reading BPP text...OT course
notes..ddint touched the past papers will do it from today...(i had an issue
regarding starting my study n ol) so from wich years i shud start reading
[05:37:54] werty : {rawasia} try from June 2009 backwards
[05:37:59] sair : so the examiner is looking for knowledge and understanding
rather than the amount you can write?
[05:38:03] chatmasterflex : {werty} its coming to the exam and I know a lot
of principles but can only remember a handful of cases, should i concentrate on
learning more law principles or its time to try and learn cases
[05:38:10] werty : {sair} yes
[05:38:14] accastudent110 : in the hierarchy of courts, where prev was HOL
is nw supreme court ..so where is the euro crt of justice?
[05:38:38] werty : {chatmasterflex} don't start to try learning cases now - too
late
[05:38:53] sair : how would i tackle a question like...exaplain the importance of
the county court?
[05:38:53] werty : {accastudent110} above supct
[05:39:09] chatmasterflex : {werty} i know what happened in case but cant
remember the names, could this earn me a mark
[05:39:22] accastudent110 : it is superior to the sup crt?
[05:39:33] shehz : {chatmasterflex} yes definetely... just write 'in a decided
case....'
[05:39:52] werty : explaining where it fits in the overalll structure, the sort of
cases it can hear, the precedents it is bound by, how my judges sit, .....
[05:40:02] chatmasterflex : {Shehz} thanks
[05:40:15] werty : {chatmasterflex} yes, see shehz post
[05:40:17] shehz : {chatmasterflex} its k
[05:40:47] werty : ~*many*
[05:40:50] rawasia : {werty} ok june 09 backwards...n the rest of the past
pprs question from the kit
[05:40:51] tophigh : {werty} is it helpful to recite the past exam papers
results?
[05:41:11] chatmasterflex : {werty} and what is the best use the 15 mins
reading time?
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:41:11] werty : {rawasia} yes
[05:41:12] accastudent110 : so what is the role of the HOL n euro crt,ive
noticed in rev kit qstns that sup crt has basicaly replaced the two?
[05:41:23] shehz : {werty} Wuestions inthe exams kit can repeat?
[05:41:24] werty : {Tophigh} why would anyone want to do that?
[05:41:27] shehz : Question*
[05:41:31] werty : {chatmasterflex} read?
[05:41:46] spencerli : {accastudent110} house of lords is the old name for the
supreme court
[05:41:56] zain009 : {werty} I will not be going through text books - will just
go through Past papers questions & exam kit and pick important questions for
each topic..is this approach OK for the last 2 days ?
[05:42:09] werty : {chatmasterflex} and jot down on the q paper things which
immediately come into your head. Don't plan any answer until you have read
the whole q paper
[05:42:21] werty : {Shehz} OH YES!!!!!!
[05:42:33] tophigh : {werty} cause we can't manage the answer use
professinal words
[05:42:36] werty : {zain009} sounds good to me
[05:42:39] shehz : {werty} Ty
[05:42:56] chatmasterflex : {werty} thanks
[05:42:58] shehz : {werty} Think i'll just sit and highlight the main points of all
questions and answers
[05:43:16] accountantkenny : {werty} can past year question be repeated?
[05:43:19] werty : {Tophigh} sorry, still don't understand the point you are
making
[05:43:27] shehz : {accountantkenny} yes
[05:43:32] werty : {accountantkenny} YES! YES! YES!
[05:43:38] sair : {werty} i scored 46 in my last exam, what do you suggest i
need to do to get those extra 4 marks?
[05:43:40] rawasia : {zain009}hw wd u knw to pick important questions for
each topic.
[05:43:43] accountantkenny : {werty} {Shehz} ok thank
[05:44:00] shehz : {sair} rework over... be courageous
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:44:07] missmalik : <b>{werty} the artcle in SA 2010 named PLEDGE
recent changes in Russian legislation. what that all about? relevant to which
chapter of Book????</b>
[05:44:09] werty : maybe plan your answers for 5 minutes before you start
writing the answer out. Maybe stricter time allocation?
[05:44:27] zain009 : {rawasia} by analysing past papers with questions most
repeated and those mostly emphasized during lectures
[05:44:34] shehz : {missmalik} i think its for Russia version... which version
are you sitting for?
[05:44:34] accastudent110 : thnks spencerli, what abt euro crt where does tht
cum in?havent seen it in the ans?
[05:44:39] rawasia : {zain009} thnx :)
[05:44:43] missmalik : <b>{Shehz} ENG</b>
[05:44:54] werty : {missmalik} Russian legislation! Sorry, I know nothing
[05:45:09] shehz : {missmalik} its for RUS paper
[05:45:11] zain009 : {rawasia} your welcome ...there is no guarantee but we
don't have much time left now to go through all questions
[05:45:19] spencerli : {accastudent110} you can appeal from the supreme
court to the european court of justice.
[05:45:21] missmalik : <b>{Shehz} are u sure?</b>
[05:45:33] werty : {accastudent110} he's said he'll not ask a detailed q about
EU
[05:45:46] werty : {spencerli} yes
[05:46:06] chatmasterflex : {werty} i find the past exam questions being
very fair and straight forward, where do you think students go wrong because
this paper has got a relatively low passrate?
[05:46:15] shehz : {missmalik} see all the exams papers.. there are different
versions
[05:46:25] missmalik : {Shehz} okkkkk
[05:46:28] shehz : {missmalik} Like ENG, RUS, CHK
[05:46:32] accastudent110 : spencerli there was a qstn on hierarchy in the
2010 rev kit,it was mag,county,crown,hi crt,crt of appeal n sup crt..no mention
of euro crt...do u nkow y?
[05:46:37] missmalik : {Shehz} yeah
[05:46:40] hamza.bhoy : theres no pintt miss
[05:46:45] hamza.bhoy : since ur in pak
[05:46:52] missmalik : {hamza.bhoy} it is
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:46:54] rawasia : {werty} bout doing a question we have to bubble the
question number ryt...so e.g. we are continuing question 3 on the next page on
the top 3 shud be bubbled again ryt?
[05:46:58] accountantkenny : {werty} what do you suggest me to do few day
be4 exam?
[05:46:59] hamza.bhoy : n i suppose here evry1 takes UK
[05:47:08] werty : {chatmasterflex} planning, exam technique, time
allocation, layout of answers, not reading the q, not answering the WHOLE q
( define and explain ...)
[05:47:08] hamza.bhoy : ive given n cleared law
[05:47:11] hamza.bhoy : here in pak
[05:47:20] missmalik : {missmalik} we are in PK but this article is in
RELEVANT articles for F$
[05:47:28] hamza.bhoy : its pointless goin thru all those papers
[05:47:30] spencerli : {accastudent110} european court isn't really in the
hierarchy as it's a european court! does that make sense? you can appeal to it
though as UK is in the EU.
[05:47:34] shehz : {missmalik} {hamza.bhoy} it s of concern
[05:47:42] werty : {rawasia} yes
[05:47:52] rawasia : {werty} ok
[05:47:56] chatmasterflex : {werty} thanks
[05:47:57] werty : {accountantkenny} eat, sleep, chill, read a bit
[05:48:00] missmalik : {hamza.bhoy} so what you suggest now? what to do,,
i have prepared KALPAN book and read the KIT,, now?
[05:48:05] rawasia : {werty} haha gud one
[05:48:12] accastudent110 : then why was it in the hierarchy in the last rev
kit qstns..for 09?
[05:48:14] accountantkenny : {werty} haha ok
[05:48:23] hamza.bhoy : jst readin wont do
[05:48:32] hamza.bhoy : try n solve a few questions
[05:48:37] hamza.bhoy : time urself and solve
[05:48:47] hamza.bhoy : cuz usualy in xams u run outta tymmm
[05:49:02] hamza.bhoy : {missmalik} brb after lunchh
[05:49:04] missmalik : {hamza.bhoy} just two days left, no time for solving, i
just want to focus on main area
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:49:13] chatmasterflex : the day before the exam i will answer OT tips and
try and mark them
[05:49:17] shehz : {missmalik} focus n the main points only
[05:49:21] zain009 : {missmalik} you are right !
[05:49:28] werty : {hamza.bhoy} I think you're giving different advice than
me - would you mind stopping - maybe start your own chat room :)
[05:49:32] shehz : {missmalik} i am going to do that from now..
[05:49:46] zain009 : {werty} lol gud one
[05:49:55] shehz : {werty} perfect reply
[05:50:14] werty : 20 minutes
[05:50:16] missmalik : {werty} LOL
[05:50:18] spencerli : {accastudent110} if you were to draw it out as a
diagram, the european court of justice would be separate from the main
hierarchy.
[05:50:34] rawasia : {werty} bout TRACKING bpp text says student sitting in
june 10 attempt shud know tht fast track has a limit of pounds 5000 to
25000.....thn whts the limit for multi track?
[05:50:35] accastudent110 : ok thnks spencerli
[05:50:56] shehz : {rawasia} You rae right... i am also confused about that
[05:51:14] vickievix : {werty} I'm sorry if this question has already come up but is it absolutly essential that I learn the names of the cases and specific
legislation to which a question refers, I think I can give general examples to
questions, but I can't remember the case or act names - will this hinder my
chances??
[05:51:26] rawasia : i do think bout sumthing but let the tutor answer it :)
[05:51:32] werty : {rawasia} over 15,000
[05:52:01] missmalik : {Shehz} what are you going to do now in remaining
two days precisely?
[05:52:02] spencerli : {rawasia} i think multi track is over £15000
[05:52:06] rawasia : {werty} multi is 15000??? and fast 25000??? :S
[05:52:18] werty : {vickievix} hi, no it won't hinder your cahnces - can you
check back through tis session - I believethat I've answered it twice.
[05:52:44] vickievix : {werty} will do - sorry for making you repeat... :)
[05:52:50] shehz : {missmalik} well, just analyse all the questions in the bpp
kit and highlight every main point
[05:52:52] werty : I really must do an article about this sort of problem - you
( many of you ) seem to get hung up on case names
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:53:07] werty : It's not a problem - "In a decided case ....: is eough.
[05:53:18] zain009 : {werty} good idea for students
[05:53:22] rawasia : {werty} ....fixed charges? floating charges>???
[05:53:30] werty : I teach case names nd details on my courses, but only
because they bring the topic to life
[05:53:40] chatmasterflex : {werty} i get confused by articles of assossiation
and model articles
[05:53:44] spencerli : {werty} the problem is when we see the model
answers, they tend not to describe the case. they just put the case name in
brackets!
[05:54:14] werty : {rawasia} fast track is 5 - 15
[05:54:29] deathcase : "contents of model article" in the syllaus-- i mean do
we need to learn them?
[05:54:32] werty : {rawasia} yes?
[05:55:06] rawasia : {werty} im sorry ...but BPP says for june 10 attempt its
25000 :s
[05:55:09] missmalik : {Shehz} want to revise legal sys, con law, tort,
emplymnt law and company law once again,,, is it possible now?
[05:55:14] werty : {chatmasterflex} model arts are simply pro-forma - if a
company wishes, it need not prepare its own, it can adopt the model set, in full
or in part - or even not at all
[05:55:24] rawasia : {rawasia} bout those charges...can u explain them ...in
short
[05:55:37] priteshga : Is damages a common law remedy intended to bring
the party that has suffered loss to a position they would have been had the
contract BEEN performed?
[05:55:39] shehz : {missmalik} i think so... because i also have to do the
same as you
[05:55:46] abeke : in a case are we permitted to use the first letters e.g sVm
as in smith V megacorp?
[05:55:54] missmalik : {Shehz} i am afraid of starting
[05:55:56] rawasia : {missmalik} {Shehz} mee too :P
[05:55:59] chatmasterflex : {werty} is it an alternative to articles of
assossiation
[05:56:03] zain009 : {missmalik} do revise fraudulent,wrongful trading and
money laundering as well it tends to come up every time
[05:56:04] shehz : {rawasia} goodluck to us
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:56:12] missmalik : {rawasia} forgot evry thng
[05:56:13] shehz : {rawasia} {missmalik} goodluck to us
[05:56:18] missmalik : {Shehz} thx
[05:56:19] werty : {spencerli} Yes, but I'm talking about where you don't
know the NAME of a case, but you can remember that there was a case, about a
ship, and it was decided that ......
[05:56:21] rawasia : {Shehz} :)
[05:56:25] accastudent110 : in scenario cntract qstns sumtyms they say that
the offeree asks the offerror to keep the offer open until maybe for a few days
but the qstn dusnt specify wether they actually do kip it open ,then the ans
seems to assume that they did n ans the qstn based on this..shud we do this?
[05:56:35] werty : {rawasia} again, post on Ask the tutor
[05:56:44] shehz : {rawasia} {missmalik} wanted to do some group work but
have no one...
[05:56:51] werty : {priteshga} yes
[05:56:52] shehz : group work helps a lot
[05:56:55] rawasia : {missmalik} i knw u do feel tht...but dont worry do u
have th OT course notes...they will help u in revision
[05:57:04] werty : {abeke} not really
[05:57:11] rawasia : {Shehz} same here man...
[05:57:15] werty : {chatmasterflex} yes
[05:57:20] missmalik : {Shehz} now group work??????
[05:57:31] abeke : they cld help where you v read well too
[05:57:40] shehz : {missmalik} download the OT notes and start revision.. its
all in a summary
[05:57:42] missmalik : {rawasia} i never gone through OT notes of F4, are
they good
[05:57:58] missmalik : {Shehz} i hav them but never opened.. :D

boost
[05:58:13] werty : {accastudent110} it's normally pretty clear from the q "However, on saturday, he sold the vase to Eve"
[05:58:16] rawasia : {missmalik} haha ...yes they are
[05:58:19] missmalik : {Shehz} i am ready for group
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[05:58:25] spencerli : {werty} for statutes, is it important to know the dates?
e.g is Company's Act ok?
[05:58:25] abeke : if i were to go into group work now i'll rather discuss what i
will be able to remember
[05:58:29] shehz : {missmalik} lol... i just got it yesterday in a crash course
[05:58:35] rawasia : {missmalik} i read BPP text once...then started OT notes
after long...really helped
[05:58:37] priteshga : Thank you werty, BPP passcard has got damages
definition wrong
[05:58:42] spencerli : {werty} Companies Act
[05:58:45] shehz : {missmalik} {rawasia} well.. we can meet up for an online
group work if u guys wish
[05:58:58] chatmasterflex : {werty} is a tender an offer or an invitation to
treat?
[05:58:58] rawasia : {Shehz} tht wd be nice...
[05:58:59] vickievix : {werty} thanks for all your help! it is much appreciated.
[05:59:01] priteshga : but the expectation interest is correct
[05:59:03] missmalik : {Shehz} i thot u asking about study buddy at OT

[05:59:44] shehz : {Shehz} Thanks
[05:59:48] accastudent110 : werty i dnt understand?
[05:59:51] missmalik : {Tophigh} its OPEN TUTION
[05:59:53] werty : {priteshga} could depend on which type of damages they
are talking about
[05:59:54] rawasia : OPEN TUITION :)
[05:59:55] shehz : {Tophigh} Open Tuition
[06:00:14] rawasia : {Tophigh} few days back even i ddint knew tht :P
[06:00:18] shehz : {missmalik} {rawasia} Shall we start the work?
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[06:00:21] spencerli : {werty} thanks werty
[06:00:23] werty : {chatmasterflex} offer - it's in response to an invitation
[06:00:25] missmalik : {Shehz} YES YES
[06:00:26] rawasia : {Shehz} ok when? how?
[06:00:28] tophigh : got it thks
[06:00:35] missmalik : {Tophigh} lol
[06:00:37] rawasia : {Shehz} u in skans?
[06:00:50] shehz : {rawasia} No, am from Mauritius Island
[06:00:54] priteshga : So does the meaning of damages depend on the
scenario? I am confused
[06:00:58] werty : {accastudent110} i've lost my answer - what didn't you
understand?
[06:01:03] rawasia : {Shehz} :S ok... :)
[06:01:11] tophigh : {rawasia} so what's that?
[06:01:12] shehz : {priteshga} yes, depends on the senario
[06:01:33] shehz : {missmalik} {rawasia} well, lets open our exams kit
[06:01:41] rawasia : {Shehz} i hate the chapter...share capital :s
[06:01:41] accastudent110 : u said its prity clear frm a cntrct qstn wethere
we shud assume they kip the offer open even if they dnt specify in the qstn?
[06:01:46] missmalik : {Shehz} okay opening
[06:01:53] rawasia : {missmalik} in front of me..
[06:01:57] werty : {priteshga} no, but there are diff types of damages liquidated, ordinary, derisory, punitive ....
[06:02:11] shehz : {missmalik} {rawasia} Highlighter in our hands
[06:02:19] missmalik : {Shehz} yup
[06:02:27] rawasia : {missmalik} got it
[06:02:28] shehz : {rawasia} any chapter called share capital yet?? never
heard... lol... joking
[06:02:44] rawasia : {Shehz} i have BPP kit...u? miss malick has KAPLAN for
sure :P
[06:02:51] werty : {accastudent110} ah yes - if the shop-keeper has sold the
item for which he has said he will keep the offer open, then clearly, he hasn't
kept the offer open!
[06:02:53] missmalik : {rawasia} YES
[06:02:58] shehz : {rawasia} Using Bpp
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[06:03:01] spencerli : {werty} can you explain what a unilateral contract is
please? i got no marks for part of a question as i referenced errington v
errington instead of merritt v merritt.
[06:03:05] rawasia : {Shehz} k...
[06:03:11] shehz : {missmalik} u using kaplan?
[06:03:17] missmalik : {Shehz} Yes kaplan
[06:03:28] accastudent110 : yes but had he agreed to?
[06:03:29] shehz : {missmalik} wts the first question?
[06:03:41] accountantkenny : {werty} is it corporate governance an
important topic? because there are less question in the exam kit
[06:03:47] werty : {spencerli} unilateral literally means "one -sided"
[06:04:02] werty : Don't see how either Merritt nor Errington is unilateral
[06:04:14] priteshga : please give me definition & examples of ord, derisory
and punitive damages?
[06:04:19] missmalik : {Shehz} Power of Courts
[06:04:25] spencerli : {werty} errington is a unilateral contract, but i don't see
how
[06:04:26] chatmasterflex : {spencerli} that comes up in 'intention to create
legal relations'
[06:04:27] accastudent110 : what is derisory damages n when wud the veil
be lifted in grup situations?
[06:04:40] rawasia : {missmalik} we have types of law
[06:04:43] werty : {accastudent110} If he has agreed not to sell, and then he
does, he's not kept his offer open. Ann's Art Gallery illustrates the point
[06:05:25] missmalik : {rawasia} instead of kit, wat if we revise Text buk?
[06:05:25] chatmasterflex : {spencerli} unilateral is a speciality contract like
a title dead i think
[06:05:29] werty : {priteshga} ord is what your original q was about restoring injured party to where he should have been
[06:06:16] werty : derisory is where ct ordered that Marilyn Monroe should be
paid 1$ because someone had defamed her charcter by calling her an "emptyheaded blonde bimbo"
[06:06:18] zain009 : {werty} considering I have gone through all questions
and highlighted main points but in Exam Hall you get the question which you
can't answer out of your head, whats your say on that? and your final tips for
the exam day ?
[06:06:28] shehz : {missmalik} ok
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[06:06:29] werty : Puntitie - watch BP case in the US
[06:06:49] werty : {missmalik} you're wasting precious time!
[06:06:49] spencerli : {chatmasterflex} thanks. (i think!)
[06:06:59] rawasia : {werty} agreed
[06:07:05] missmalik : {werty} Why
[06:07:15] werty : {chatmasterflex} or a deed of gift or promissory note
[06:07:16] missmalik : {werty} wats wrong in my opinion kindly tel
[06:07:18] shehz : {missmalik} too late so start with text nuk
[06:07:21] accastudent110 : when wud the veil be lifted in grup situations?
[06:07:47] missmalik : {Shehz} not start, just REVISE
[06:07:57] chatmasterflex : {accastudent110} in preparation of group
accounts
[06:08:03] sair : {werty} how come so many people fail F4? Is it very difficult
to earn marks?
[06:08:30] accastudent110 : to reveal them as two co's instaed of one?
[06:08:34] werty : {zain009} There must be something in your head which
relates to the topic of the q. FORCE yourself to go through the separate bits - if
it's contarct related, think through offer, acceptance, consideration, terms,
breach, damages, equ remedies
[06:08:40] chatmasterflex : {sair} i find the questions straight forward, i
think it could be exam techniques
[06:08:41] shehz : {missmalik} hw do u think we shall revise in that..
[06:08:58] missmalik : {Shehz} just those chaps that i previously mentioned
[06:09:00] shehz : {rawasia} {missmalik} we can use the OT course notes.... i
think that wld help
[06:09:06] missmalik : one hour per chapter
[06:09:08] werty : If it's co related, think through constitution, dirs, auds, veil
of incorp, shares.....
[06:09:12] missmalik : finish in 7 hours
[06:09:25] rawasia : yes tht wd...
[06:09:36] missmalik : {rawasia} ok
[06:09:36] zain009 : {werty} yes i think so too
[06:09:45] sair : its the exam technique which i think i am struggling with
[06:09:50] werty : {missmalik} too late to be looking at text books - should
now be focussing on rev kit
This session was conducted on OpenTuition chatroom (http://www.opentuition.com/chat/)
[06:10:01] missmalik : {werty} okayyyyyyyy
[06:10:01] werty : {chatmasterflex} you could well be right
[06:10:32] tophigh : {werty} where can i get the rev kit
[06:10:42] missmalik : {Tophigh} lol
[06:10:46] werty : {sair} i think I answered that about 10 minutes ago
[06:10:47] missmalik : {Tophigh} u dun hav?
[06:10:52] sair : {missmalik} do you learn better cramming it in like that?
[06:11:14] accastudent110 : werty my qstn :(
[06:11:23] tophigh : {missmalik} actually i don't know what that mean
[06:11:24] chatmasterflex : {werty} if somebody breaches a contract and the
other one continues to perform his part of the contract, e.g the guy in your
tuition who kept on putting advertising for a client even though the client said
stop. Does this not bring about the duty to mitigate loss
[06:11:25] werty : {Tophigh} too late now! Download from ACCA website their
past exam qs and as
[06:11:26] missmalik : {sair} never crammed, just get an overview and idea
of topic, concept
[06:11:38] missmalik : {Tophigh} Revision kit or Exam Kit
[06:11:52] tophigh : {werty} That i got it
