Hong Leong Connect – Enjoy 10% Cash Back & Win Prizes when you checkout with PEx+ Terms and Conditions (“T&Cs”) “Hong Leong Connect Digital Banking Services (“Connect”) – Enjoy 10% Cash Back & Win Prizes when you checkout with PEx+” (“Campaign”), commences on 1 July 2016 and ends on 31 July 2016 (both dates inclusive), unless otherwise notified (“Campaign Period”). Definitions and Interpretation The following terms and expressions shall have the meanings assigned to them unless the context otherwise requires:“The Bank” refers to Hong Leong Bank Berhad (“HLB”) and Hong Leong Islamic Bank Berhad (“HLISB”) “iPay88” and “MOLPay” refers to the online payment gateway service and solution provider which facilitates online merchant stores to process online transactions. “PEx+ Payment Transaction” refers to mobile point of sales service which allows the Connect user defined below to perform payment transaction through Connect Mobile and/or Connect Tablet application on a smart phone and/or tablet for any purchase made through iPay88 and MOLPay. Eligibility 1. This Campaign is open to all exisiting and new individual customers of the Bank, including the Bank’s permanent and contractual employees who are the registered users of Connect and have subscribed for Hong Leong Connect Mobile/Tablet application (“Connect users”). For the avoidance of doubt, new individual customers refer to individuals who register for Connect and subscribe to Connect Mobile/Tablet during the Campaign Period. Campaign Mechanics Part A: Enjoy 10% Cash Back when you checkout with PEx+ 2. There is no registration required to participate in this Campaign. 3. Connect users will stand a chance to enjoy 10% Cash Back (“Cash Back”) for a minimum of RM 150 PEx+ Payment Transaction performed in a single transaction at any of the below merchants (“Preferred Online Merchants”) during the Campaign Period: i. 11street (www.11street.my) ii. Groupon (www.groupon.my) iii. Hermo (www.hermo.my) iv. Doublewoot (www.double-woot.com) v. Gemfive (www.gemfive.my) vi. EzBuy (www.ezbuy.my) vii. Sephora (www.sephora.my) viii. Padini (www.padini.com) 4. The PEx+ Payment Transaction Amount will be automatically rounded up or down as illustrated below for the purposes of computing the Cash Back entitlement: PEx+ Payment Transaction Amount RM 150.00 – RM 299.97 RM 299.98 and above Cash Back Amount RM 15.00 RM 30.00 1 5. For the purpose of the Cash Back entitlement, the Connect users agree that:a) Payment transactions performed at the Preferred Online Merchants must be made through PEx+ only; and b) Any PEx+ Payment Transaction which does not fulfill the requirements set-out in Clause 3 above will be disqualified from participating in the Campaign. 6. For the avoidance of doubt, the Cash Back will be allocated on a first come first served basis and shall be subject to a maximum allocation of Ringgit Malaysia Sixty Thousand (RM60,000) only throughout the Campaign Period (“Capped Cash Back”). Notwithstanding anything herein, no further Cash Back will be rewarded once the Capped Cash Back is reached. 7. Connect users can perform multiple PEx+ Payment Transactions at the Preferred Online Merchants throughout the Campaign Period via Connect Mobile/Tablet to earn the Cash Back. However, each Connect user is entitled to Cash Back of up to a maximum of Ringgit Malaysia thirty (RM30) throughout the Campaign Period. 8. The following PEx+ Payment Transactions are NOT eligible for the Cash Back entitlement for the purpose of this Campaign:a) purchases from Preferred Online Merchants which are subsequently cancelled or refunded; or b) purchases from Preferred Online Merchants which are disputed or deemed to be unauthorized or fraudulent. Winners Selection & Notification 9. The Connect users who are eligible for the Cash Back shall be notified by the Bank either in writing, by short message services (“SMS”) or in any other manner which the Bank deems practical (“Cash Back Notification”) on a best effort basis at the address or latest telephone number(s) furnished by the Connect users as shown in, and are duly captured by and reflected in the Bank’s system and/or records (“Eligible Connect users”). 10. The Cash Back will be credited into the Current or Savings account/ Current account-i or Savings account-i (“CASA/CASA-i”) maintained by the Eligible Connect users with the Bank as determined by the Bank, within eight (8) weeks after the end of the Campaign. 11. The Eligible Connect users’ CASA must remain active and valid throughout the Campaign Period and until 30 September 2016, failing which, the Cash Back shall be forfeited at the Bank’s absolute discretion. 12. Connect users who do not receive such Cash Back Notification from the Bank by 30 September 2016 are deemed NOT eligible for the Cash Back. 13. The SMS service for this Campaign is provided and supported by M3 Technologies (Asia) Berhad (“M3Tech”), a SMS vendor officially appointed by the Bank. Part B: Stand a chance to win prizes 14. Connect users who perform PEx+ Payment Transactions of any amount at either : (a) (b) any online merchant through iPay88 or MOLPay; or online merchant through revPAY E-Banking Malaysia (Revenue Harvest Sdn Bhd) will stand a chance to win one (1) pair of return economy class flight tickets to Korea inclusive of accomodation (‘’Grand Prize’’) or one (1) unit of shopping voucher worth RM500 (‘’Consolation Prize’’). 15. There is One (1) Grand Prize and a total of five (5) Consolation Prizes to be won throughout the Campaign Period. A total of 2 units of Hermo (“Hermo”) shopping vouchers and 3 units of 11street (“11street”) shopping vouchers worth RM500 each will be given away as Consolation Prizes. (References to Hermo and 11street shall hereafter collectively be referred to as “Selected Merchants”). 16. Five (5) Connect users will be shortlisted based on the computerized random selecton system (‘’the Grand Prize Shortlisted Customers’’) and will be contacted by the fulfilment agent engaged by the Bank, Dynamic Search Sdn. Bhd. (136574-V) (‘’Dynamic Search’’) at the Grand Prize Shortlisted Customers’ latest 2 telephone number(s) in the Bank’s record at the end of the Campaign Period for a Q&A to answer two (2) questions. 17. One (1) of the Grand Prize Shortlisted Customers who answers the two (2) questions correctly within the fastest time during the Q&A will be the winner of the Grand Prize (’’Grand Prize Winner’’). 18. Ten (10) Connect users will be shortlisted based on the computerized random selecton system (‘’the Consolation Prize Shortlisted Customers’’) and will be contacted by Dynamic Search at the Consolation PrizeShortlisted Customers’ latest telephone number(s) in the Bank’s record at the end of the Campaign Period for a Q&A to answer two (2) questions. 19. Five (5) of the Consolation Prize Shortlisted Customers who answer the two (2) questions correctly within the fastest time during the Q&A will be the winner of the Consolation Prize (’’Consolation Prize Winners’’). Winners Selection & Notification 20. A maximum of three (3) attempts will be made by Dynamic Search to contact the Grand Prize Shortlisted Customers and the Consolation Prizes Shortlisted Customers at any time from Monday to Friday between 10:00 a.m. to 6:00 p.m.. The Bank and/or Dynamic Search’s records of attempted calls to the Grand Prize Shortlisted Customers and the Consolation Prizes Shortlisted Customers shall be conclusive on the matter. 21. In the event the Bank and/or Dynamic Search is unable to contact the Grand Prize Shortlisted Customers and/or the Consolation Prize Shortlisted Customers after three (3) attempts, the Grand Prize Shortlisted Customers and/or Consolation Prize Shortlisted Customers shall be disqualified from the Campaign and shall lose the chance to win the Grand Prize and/or Consolation Prizes. 22. In the event that there are more than one (1) (in the case of Grand Prize Shortlisted Customers) or more than five (5) (in the case of Consolation Prize Shortlisted Customers) who successfully answer the two (2) questions correctly within the same time frame, the Grand Prize Shortlisted Customers and Consolation Prizes Shortlisted Customers with the highest total number of PEx+ Payment Transactions performed during the Campaign Period will be the Winner of the Grand Prize and Consolation Prize respectively. 23. The Grand Prize Winner and the Consolation Prize Winner will be notified by the Bank through telephone no later than 30 September 2016 (‘’Prize Notification’’). 24. The Bank will issue a letter by 30 September 2016 to the Grand Prize Winner to redeem the Grand Prize from M. S. Star Travel Agencies Sdn Bhd (155421-A) (“the Travel Agency”). Consolation Prize Winners will be issued with a unique promotion code (“Promotion Code”) by way of SMS from the Bank for the redemption of the Consolation Prize no later than 31 August 2016. General Terms and Conditions for the Grand Prize Grand Prize 25. The Grand Prizes is subject to terms and conditions prescribed by the Travel Agency: (i) Travel period is valid from 1 October 2016 till 31 March 2017 (“Travel Period”). No extension is permitted. (ii) The Travel Period does not include peak seasons such as Christmas, New Year’s Eve and major public holidays in Korea and Malaysia. In the event the Grand Prize Winner’s travel dates fall during the peak season, the additional cost will be borne by the Grand Prize Winner. (iii) The Grand Prize Winner is solely responsible to ensure that the Grand Prize Winner possess valid passport with at least six (6) months’ validity. (iv) If the Grand Prize Winner is unable to travel during the stated Travel Period for any reason whatsoever, any cancellation by the Grand Prize Winner must be made in writing and acknowledged by the Travel Agency. The Travel Agency will not reschedule the Travel Period and the Grand Prize will be forfeited. (v) The Grand Prize Winner agrees to be bound by the terms and conditions imposed by the Travel Agency as may be amended from time to time. Such terms and conditions are beyond the Bank’s control and are determined by the Travel Agency. Any dispute arising under the Travel Agency’s terms and 3 conditions shall be settled directly by the Grand Prize Winner with the Travel Agency without recourse to the Bank. Consolation Prizes 26. The specific terms and conditions of the Consolation Prizes are set out below and are subject to change by the Selected Merchants. The Consolation Prize Winners are required to check with the Selected Merchants directly if there are any queries on the terms and conditions appearing below and if there are any changes to the terms and conditions appearing below: i. The Promotion Code is valid for one (1) time use only. No minimum purchase is required at the Selected Merchants’ respective websites to redeem the Consolation Prize. However, if the Consolation Prize Winner’s total cart price amounts to less than RM500, the difference between the total cart price and the value of the Consolation Prize (“Prize Differential”) shall be forfeited. Neither the Bank nor the Selected Merchants shall be liable to pay or issue any further vouchers for the Prize Differential to the Consolation Prize Winners. ii. Redemption of the Consolation Prize may not be available for such brands or products as determined and specified by the Selected Merchants respectively. iii. Shipping and handling charges apply to such products as specified and determined by the Selected Merchants respectively. Hermo Shopping Voucher iv. Redemption of the Hermo shopping voucher shall only be valid by way of keying in the Promotion Code at checkout when effecting purchases at www.hermo.my only untill 30 September 2016. The Promotion Code entitles the customer to RM500 off the total cart price at checkout. 11street Shopping Voucher v. Redemption of the 11street shopping voucher shall be effected in the following manner: (a) Redemption of the 11street shopping voucher shall only be valid by keying-in the 16 digit Promotion Code at ‘’Coupon’’ under ‘’My Page’’ at www.11street.my only by 21 September 2016 (‘’Promotion Code Redemption Period’’). Neither the Bank nor 11street shall be liable for the Consolation Prize Winner’s failure to redeem the 11street shopping voucher within the Promotion Code Redemption Period in the manner set out herein and no further Promotion Code shall be issued to the Consolation Prize Winner. (b) The Promotion Code entitles the customer to RM500 off the total cart price at checkout and shall be valid for use within one (1) month from the Promotion Code Redemption Period. General 27. The Bank shall not be responsible for and does not have any control whatsoever on the network or internet traffic congestion, network or internet connection failure and/or interruptions that may be experienced by the respective telecommunications service providers (“Telco”) inclusive of Payment Gateway which may result in the delay of processing the PEx+ Payment Transaction during the Campaign Period. 28. By participating in this Campaign, the Connect users : (a) Agree that they have read and understood the T&Cs herein and agree to be bound by this Campaign’s T&Cs, the terms and conditions of Connect and any other relevant terms and conditions that the Bank may impose from time to time; (b) Agree that the decisions of the Bank on all matters relating to this Campaign including the Grand Prize and Consolation Prizes entitlement shall be final and binding on all Connect users. No further correspondence and/or appeal to dispute such decisions will be entertained; (c) Consent to and authorize the Bank to disclose their personal data (i.e. names, NRIC numbers and contact number to the Bank’s service providers such as Dynamic Search, M3Tech and M. S. Star Travel Agencies Sdn Bhd for the purposes of this Campaign; 4 (d) (e) (f) (g) Agree to access www.hlb.com.my (“HLB’s Website”) and/or www.hlisb.com.my (“HLISB’s Website”) at regular time intervals to view the T&Cs of this Campaign and to ensure to keep-up-to-date with any changes or variations to the said T&Cs. Agree that they shall be personally liable for all taxes, rates, government fees or any other charges that may be levied against them under the applicable laws, if any, in relation to the Campaign and/or the Grand Prize and Consolation Prizes; Agree that the Cash Back, Grand Prize and/or Consolation Prizes are not transferable to any third party and non-exchangeable for up-front cash, credit, cheque or in kind;and Consent to and authorize the Bank to disclose or publish their names, NRIC numbers (in masked form), and/or photographs in media, marketing or advertising materials (whether in print, electronic or other medium) for the purposes of the Campaign. 29. The Bank reserves the right to: (a) Add, delete or amend the T&Cs herein, wholly or in part, or to suspend or terminate this Campaign at its absolute discretion, by way of posting on the HLB’s Website, HLISB’s Website or in any other manner which the Bank deems practical, in order to give twenty-one days (21) prior notice to the Connect users on such addition, deletion or amendment of the said T&Cs or suspension or termination of this Campaign; (b) Forfeit the Grand Prize and/or Consolation Prizes in the event that there is non-compliance with the T&Cs herein; (c) Disqualify any the Connect users from participating in this Campaign and/or from receiving the Cash Back: (i) if the Connect users have committed or are suspected of committing any fraudulent, unlawful and illegal acts (including gambling) in relation to any of the Connect users’ account(s) and/or any other Bank services or facilities including Connect, as defined in HLB’s Website and HLISB’s Website; and (ii) if the Connect users have been declared bankrupt or are subject to any bankruptcy proceedings at any time prior to or during the Campaign Period. (d) Alter, add, cancel or substitute the Grand Prize and Consolation Prizes with other prizes of similar value for any reason whatsoever with prior notice to the Connect users. 30. The T&Cs herein are to be read together with the Terms and Conditions for Connect as an entire agreement. In the event of discrepancy, the T&Cs herein shall prevail to the extent of such discrepancy. 31. In the event of any discrepancies between these T&Cs as compared to the advertising, promotional, publicity and other materials relating to or in connection with this Campaign, the final T&Cs on the HLB’s Website and/or HLISB’s Website shall prevail. 32. The T&Cs herein shall be governed by and construed in accordance with the laws of Malaysia and the Connect users agree to submit to the jurisdiction of the Courts of Malaysia. 5
