The Kansas Nebraska Act destroyed the current political parties dividing both the Whigs and the Democrats along geographical lines. Because of pressure from Pierce, 60 Democrats from the North voted for the Kansas Nebraska Act, and all but 7 lost their jobs in the next election.

In the Whig Party every northern Whig voted against the Kansas Nebraska Act while almost every southern Whig voted for it. Because of this division, the Whig party had for all purposes been killed off.

The election of 1856 set up a dangerous situation for the Union. There were 3 parties involved in the election. Some Whigs and Democrats joined together to form the Know Nothing party, nominating Millard Fillmore as their candidate.

The Republicans, formed from Whigs and Democrats against slavery combining with the free­soilers, nominated John C. Fremont. The main plank of this party's platform was to stop the spread of slavery.

The Democrats knew they could not nominate anyone related to the Kansas Nebraska Act so neither incumbent Pierce nor Stephen Douglas were nominated because of their involvement. Because of those circumstances James Buchanan was nominated who was Polk's secretary of state.

Many white southerners stated if the Republicans won they would not recognize Fremont as President. If the Republicans had won, the Union would have ended then. However the Democrats did win by carrying almost all of the South and 5 of the Northern states.

Two days after taking office Buchanan faced another dilemma which threatened to rip apart the nation. The Supreme Court issued the Dred Scott Decision. Dred Scot was a slave whose master had died and was now suing his master's wife for his freedom.

The issue under question was if a slave is taken into free territory does he become free. Scott's master, an army surgeon, took him to Illinois on a tour of duty and then returned to Missouri and died. The Supreme Court now had 3 questions to answer.

Chief Justice Roger Taney answered those questions. 1. Is Scott a citizen? Meaning can Scott sue.
Answer ­ Not only is Scott not a citizen but no African American is.
2. Does going to a free state make a slave free?
Answer ­ No! Mainly because Scott had returned to Missouri.
3. Can Congress prohibit slavery?
Answer ­ No! The 5th amendment states the government cannot take property without due process therefore congress could not prohibit slavery anywhere.

The south rejoiced with the Dred Scott decision stating the whole reason for the existence of the Republican party was now illegal.

In the meantime in Illinois a little known politician was rising to prominence in a run to take Stephen Douglas's seat in the US Senate. Abraham Lincoln was in a series of debates with Douglas all across the state.

Lincoln publicly opposed the Dred Scott decision stating that African Americans were citizens entitled to life, liberty, and the pursuit of happiness.

Douglas insisted Lincoln thought of the slave as his brother. Further Douglas focussed of Lincoln's statement that the nation could not remain "half slave and half free". Douglas used Lincoln's statement as if to say, you see the Republicans do want to end slavery. 17

Lincoln tried to punch a hole in Douglas's arguments for popular sovereignty. Lincoln asked if the Dred Scott decision states that congress can not prohibit slavery then why need popular sovereignty. Douglas responded that Congress could not prohibit slavery, but the people had the right to determine their states laws on slavery for themselves. This argument became known as the Freeport Doctrine.

Lincoln lost to Douglas but he did well, and it placed him near the top as one of the leaders of the Republican party.
