STATE CITATION SUMMARY AL (10/15) § 27-54A-2 Health benefit plans shall offer coverage for the screening, diagnosis, and treatment of autism spectrum disorder for an insured 9 years of age or under in policies and contracts issued or delivered in this state to employers with at least 51 employees for at least 50% of its working days during the preceding calendar year. Coverage for behavioral therapy is subject to a $36,000 maximum benefit per year. AK (10/15) § 21.42.397 Health care insurers that offer, issue for delivery, delivers, or renews a health care insurance plan in this state shall provide coverage for the costs of the diagnosis and treatment of autism spectrum disorders for individuals less than 21 years of age. The mandate does not apply to fraternal benefit societies and insurers providing health care insurance to a small employer in the group market with 20 or fewer employees. Coverage for applied behavior analysis services shall be subject to a maximum benefit of $36,000 per 12-month period per person, but shall not be subject to any limits on the number of visits an individual may make to an autism services provider or that a provider may make to an individual regardless of the locations in which services are provided. Such coverage shall not be more restrictive than coverage provided for other illnesses or disorders. Habilitative services are those which enhance the ability to function of children with congenital birth defects, including autism. FL (10/15) §§ 627.6686; 641.31098 Health insurance plans shall provide well-baby and well-child screening for the purpose of diagnosis, and treatment through speech, occupational, and physical therapy. Coverage shall be limited to $36,000 annually and $200,000 in total lifetime benefits. Maximum benefit is adjusted annually. Applies to an individual under age 18 who has been diagnosed by age 8. Applies to HMOs. GA (10/15) § 33-24-59.10 An insurer that provides benefits for neurological disorders shall not deny providing benefits because of a diagnosis of autism. HI (10/15) §§ 431:10A-133; 432:1-614 Each hospital, medical service plan contract, individual, group accident, health or sickness policy issued or renewed after 1/1/16 shall provide to each member under 14 years coverage for the diagnosis and treatment of autism. ID (10/15) No provision IL (10/15) 215 ILCS 5/356z.14 to 5/356z.15 Group or individual accident and health insurance policies issued or renewed after 12/12/2008 shall provide psychiatric, psychological, habilitative, or therapeutic treatment to individuals under the age of 21 who are diagnosed with autism spectrum disorder. Policies must provide coverage for habilitative services for children under 19 years old so long as certain listed conditions are met. TN (10/15) § 56-7-2367 A contract or policy of an insurer that provides benefits for neurological disorders shall provide benefits and coverage for the treatment of autism spectrum disorders that are at least as comprehensive as those provided for other neurological disorders. These benefits for treatment will be provided to a person under the age of 12. TX (10/15) Ins. Code §§ 1355.001; 1355.015; 28 TX ADC §§ 21.4401 to 21.4404 The health benefit plan must provide coverage under this section to the enrollee for all generally recognized services prescribed in relation to autism spectrum disorder by the enrollee's primary care physician in the treatment plan recommended by that physician. Such treatment may include evaluation and assessment services, applied behavioral analysis, speech therapy, occupational therapy, or physical therapy. Certain types of insurance plans are exempt from the requirements. UT (10/15) § 31A-22-642 A health benefit plan offered in the individual market or the large group market and entered into or renewed on or before 1/1/16 shall provide coverage for the treatment of autism spectrum disorder for a child who is at least 2 years old and younger than 10 years old. Coverage for behavioral health treatment for a person with an autism spectrum disorder shall cover at least 600 hours a year.
