BUSINESS RULES FOR DATA ENTRY
SUBJECT: VIOLATIONS OF PROBATION
Purpose and Scope
This rule establishes the procedure for entering violations of probation on the youth’s record in JJIS.
Violations of probation include the following:
New Law Violation: if a youth receives a new law violation that results in the State Attorney filing a
delinquency petition, the JPO will file an Affidavit/Petition for Violation of Probation with the court and create
a referral in JJIS. This type of violation may only be entered in JJIS by the supervising JPO with jurisdiction. This
referral is entered in JJIS at the time the VOP is submitted to court by the JPO, not when they are
arrested/charged with the offense; therefore this is not entered by a JAC/Screening program. All applicable
technical violations co-occurring with the new charge are included in this charge.
Use: NEW-LAW VIOLATION - Violation of Probation (99999.03)
Technical Violation: if a youth is not complying with their court-ordered sanctions the Affidavit/Petition of
Violation of Probation may be filed with the court and a referral is created in JJIS. This includes absconding
from supervision. This type of violation is initiated by the supervising JPO with jurisdiction. The referral and
charge(s) in JJIS may be entered by the supervising JPO, or may also be entered by a JAC/Screening program if
the youth is presented for screening based on this incident.
Use: Court Order - Non-Law Violation of Probation (99999.07)
Law Enforcement Violation: if a youth is not complying with their court-ordered sanctions any law
enforcement officer in the county with jurisdiction may take the child into custody/charge with violating the
conditions of probation. This type of violation is typically entered by a JAC/Screening program.
Use: LEO - Law Enforcement Violation of Probation (99999.11)
This charge is only used when the LEO initiated the violation. This means LEO decided, on their own, to violate
the youth’s probation. This charge is not used due to JPO asking the LEO to pick up the youth based on an
Affidavit/Petition for Violation of Probation. Creating an Affidavit/Petition for Violation of Probation may be
required by the SAO to move forward with this type of violation per local practice, but does not require any
changes to the referral or charge(s) in JJIS.

Part One: Creating the Affidavit/Petition for Violation of Probation
From JJIS Web:

Scroll down and Click on New Web Forms link
Complete a youth search, and select the correct youth
Select the referral with the most serious charge for which the youth is on probation
Go to ‘Probation and Community Corrections Forms’ folder
Go to ‘Case Management’ folder
Go to ‘Probation’ folder
o Click on Affidavit/Petition for Violation of Probation
o Click on New button
Once the form is open:









Date field will default to the current date
In the drop down box for County select the County with jurisdiction
In the Date Placed On Probation field, enter the date the youth was placed on probation (disposition
date)
In the drop down box for JPO Name select the JPO in the county of jurisdiction
In the Division field enter “Juvenile” or complete per local practice
In Address field enter the youth’s home address
In Resides With field enter the name of the parent/guardian the youth resides with
In City/State/Zip fields enter the city, select the state from the drop down, and enter the zip code of
the youth’s home address
In the Referral Number box, put a check in the box of each additional referral for which the child is on
probation
Complete the narrative for the violation per local practice. Check Spelling and Save to complete.
Click on View Report to view and print. You may edit the form by clicking Edit and re-opening the form.
Part Two: Entering the Violation Referral
Violations of probation must always be on their own referral and are not combined with any other charges
or court orders. Only one referral is needed for any one incident. When a ‘New Law’ VOP is entered, there is
not a ‘Non-Law’ or ‘LEO’ VOP entered for the same incident. Even when a child violates their probation in
more than one way, only one VOP count is entered per court docket number. If an affidavit is amended a
new referral is not entered.

Select the youth for whom you are adding the violation charge(s)

Click on Add New Referral and select the correct intake processing, JAC, or On Call Screening program
Click OK to begin the wizard once you view the pop-up message
Step 1:
Admit Date is the date presented for screening on VOP, if applicable, or the date VOP is
submitted to court
Admit Time is the time of the violation
Admit Reason is:
VOP-New Charge- use this reason when the VOP is based on a new law violation
VOP- Technical Violation- use this reason for all technical VOPs
Step 2-5:
Review/Add/Update as needed
Step 6:
Origin of referral is:
DJJ- when DJJ is initiating the violation/new law violation VOPs
LEO- when LEO is initiating the violation
Unit Circuit and Unit Assigned are the Circuit and Unit with jurisdiction
Law Enforcement information is only required for LEO initiated VOPs
Step 7:
Add New Charge, Statute Selection
Select the correct VOP charge based on the scenario:
 99999.03 NEW-LAW VIOLATION - Violation of Probation
 99999.07 Court Order - Non-Law Violation of Probation
 99999.11 LEO - Law Enforcement Violation of Probation
Complete Charge Association- select the charge with the matching ‘Probation’ disposition
(most serious count is selected if there are multiple counts)

If the youth is on probation in multiple cases, a charge and charge association is added
for each docket number, not for each count within each docket number
 All violations occurring on the same date are entered on the same referral
Offense Date is the date violation occurred
Offense Time is the time of the violation
Offense Address is not required, but should be entered if available
Three charge questions are not applicable and No Victim box must be checked
