Fisher v. U. of T. -2013
Strict scrutiny
▪Decided that Fisher's only complaint could be
"whether the University's decision to use race as an
admissions factor 'was made in good faith.' ▪ The courts gave deference to the school.
▪ Probably would have ended Affirmative Action had
the courts ruled differently.

Other Issues
In a setting where there is a clear minority, is it right
to assume that the minority represents their entire
races viewpoint/experience?
It is often argued that the language of education is
"white."
Minority students who attend university can sometimes
be criticized by being "too white." Discussion Question for Wednesday:

▪ “So long as the admissions program does not constitute the type of
quota system of “racial balancing” outlawed by Bakke, it may
admit a “critical mass” of minority students in an effort to obtain a
racially diverse student body. Educational institutions re permitted
to use race as a factor (in the words of Bakke, quoted in Grutter as
a “plus”) in minority admission, so land as the decision to admit
the student is “flexible enough to ensure that each applicant is
evaluated as an individual and not in away that makes and
applicant’s race or ethnicity the defining feature of his or her
application.””
Is this possible? Can one truly evaluate an individual as just
that while still considering their race?
How is race defined/viewed in this scenario, then?
