B) That as a consequence of A) above, the further submission in support from S Seque (FS447); be rejected. C) That as a consequence of A) above, the further submission in support from T Baker (FS26); be rejected. D) That as a consequence of A) above, the further submission in support from N Skelton (FS541); be rejected. E) That as a consequence of A) above, the further submission in opposition from Hawke’s Bay Regional Council (FS200); be accepted. F) That as a consequence of A) above, the further submission in opposition from Hawke’s Bay Fruit Growers Association (FS205); be accepted. G) That as a consequence of A) above, the further submission in opposition from the Graham Family Trust (FS510); be accepted. WITH THE REASONS BEING 1. That rezoning the land to Rural Residential would be inconsistent with the Hawke’s Bay Regional Policy Statement, and that by doing so would potentially impact on the versatile land of the Heretaunga Plains. 2. That the rezoning request will not ‘give effect to’ the objectives and policies of the Hawke’s Bay Regional Policy Statement, in particular policies UD3 and UD7 which seek to ensure planned growth in areas identified as appropriate for rural residential growth; avoid unnecessary removal of valuable land from agricultural production; and achieve residential intensification within existing residentially zoned areas. 3. That the rezoning request will not achieve the objectives and policies of the Proposed Hastings District Plan, and in particularly objectives RRSO1, RSMO1, PSMO1, RRO1 and policies RRSP1, RSMP1, PSMP1, RRP1 which generally seek to maintain the life supporting capacity of the District’s rural resources and manage rural land close to urban areas. 4|Page Proposed Hastings District Plan Decisions Report Zone Change Request – Raymond Road 4. That there is currently sufficient land identified for future lifestyle development in the District to meet projected demand. 5. That the rezoning request has been evaluated under section 32 of the Resource Management Act and having had regard to the costs and benefits of the proposal, and its efficiency and effectiveness, the rezoning will not achieve the relevant objectives in the Proposed Hastings District Plan, the Hawke’s Bay Regional Policy Statement or meet the purpose of the Resource Management Act. 6. That the rezoning request does not promote the sustainable management of the natural and physical resources of the rural environment and is therefore inconsistent with the purpose of the Resource Management Act. 7. That rezoning the land subject to this request, would be premature and pre-emptive of broader planning processes, including a planned review of HPUDS and a ‘Master Plan’ for the Cape Coast. 5|Page Proposed Hastings District Plan Decisions Report Zone Change Request – Raymond Road Section 32 Evaluations of Changes Made by Decisions In making its decision whether to accept, accept in part or reject the rezoning requested by D & E Ward, E & V Fuhrer, A & J Maurenbrecher and J Snijders, Council considered the reasons given for the submissions and further submissions, presentations from submitters and further submitters at the hearing and statements on behalf of submitters tabled at the hearing. Council also considered the officers section 42A report prepared for the hearing; http://www.hastingsdc.govt.nz/meetings/district-plan-hearings-committee/2015/july/02 With specific regard to section 32AA of the Act Council also gave regard to and accepted the following section 32 evaluation contained within the officers section 42A report: The removal of land from the Plains Production zone to provide for additional land with a Rural Residential zoning is not the most effective or efficient way to achieve the sustainable management purpose of the Act with respect to rural land within the Plains Productive zone for the life of the Proposed Plan. Currently there is a surplus of land zoned for Rural Residential purposes and to rezone it ahead of triggers such as a change in demographic demand, coastal management etc is not warranted. It also would not achieve the core approach of the plan to intensify existing residential areas as the primary means for protecting the versatile land of the Heretaunga Plains. 6|Page
