.AN ACT to appropriate certain Sums of Money for the
purposes of Immigration and Public Works.
[31st October, 1876.]
OST GRACIOUS SOVEREIGN,-Whereas by the several Acts
of t.he General Assembly mentioned in the First Schedule to
this Act certain sums of money, amounting in the whole to
the sum of eleven million five hundred thousand pounds, have been
authorized to be raised by loan; and by the said Acts, and by the
-several Acts mentioned in the Second Schedule to this Act, various
sums of the moneys so to be raised have been authorized to be issued
and applied to the several works and services mentioned in the said
Acts and the Schedules thereto; and various sums of money, amounting in the whole to the sum of nine millions four hundred and twentyeight thousand eight hundred and twenty-nine pounds nine shillings
and ninepence, have been so issued and applied as in the third column
of the Third Schedule to this Act set forth: And whereas it is
expedient that the unexpended balance of the moneys so authorized
to be raised, together with other moneys in the Fourth Schedule
mentioned, should be appropriated for carrying on the said works and
-services:
We, your Majesty's most dutiful and loyal subjects, the House of
Representatives of New Zealand, in Parliament assembled, have resolved to grant unto your Majesty, towards making good the Supply

which we have cheerfully granted to your Majesty in this Session of
Parliament, the sums hereinafter mentioned, and do therefore most
humbly beseech your Majesty that it may be enacted, and
BE IT ENACTED by the General Assembly of New Zealand in
Parliament assembled, and by the ;luthority of the same, as follows ; Short Title.
1. This Act shall be called " The Immigration and Public Works
Appropriation Act, 1876," and shall be deemed to have been in operation on and after the first day of July, one thousand eight hundred
and seventy-six.

Colonial Treasurer may issue and apply any sum or sums of money not
exceeding in the whole the sum of two million thirty-two thousand two
hundred and eighty-six pounds six shillings and threepence out of the
several vVays and Means mentioned in the Fourth Schedule to this Act.
Appropriations.
4. All sums so issued shall be applied, as mentioned in the several
votes set forth in the Fifth Schedule to this Act, towards defraying
so much of the expenses incurred or to be incurred in the several
works and services in the said Schedule mentioned as shall come in
the course of payment during the financial year ending the thirtieth
day of June, one thousand eight hundred and seventy-seven, and to no
other purpose whatsoever.

terms as have been or shall hereafter be agreed upon between the
Council of the said borough and the Minister for Public Works.
All wharves and quays affected by the operation of this enactment
shall be and be deemed to be wharves and quays witliin the meaning
and subject to the provisions of" The Marine Act, 1867."
Power to levy what'f·
The powers and authorities to levy wharfage and tonnage rates,
~e~t~~h: fu~e8. or any other rates fees or dues which now are or heretofore were

vested in the said Council, under or by virtue of "The Greymouth
Quays Act, 1869," or any other Act authorizing the levying of such
rates fees or dues, shall be and are hereby vested in Her Majesty the
Queen; and all such powers and authorities may, on behalf of Her
said Majesty, be exercised by the Minister for Public Works for the
time being in accordance with and subject to the terms of any such
agreement as aforesaid.

from the Public Account, during the year ending the thirtieth day of
June, one thousand eight hundred and seventy-six, moneys in excess
of or without the appropriation of Parliament, amounting in the whole
to sixty-three thousand eight hundred and seventy-five pounds eleven
shillings and. eightpence, and has applied the said sum to the several
purposes and services mentioned in the Sixth Schedule hereto
annexed: Be it enacted that the application of the said sum is hereby
sanctioned.
9. Notwithstanding anything contained in "The Public Revenues Advances obtained
Act, 1875"

respect to any repayments so made before the passing of this Act.
