Background
The Hours of Service (HOS) regulations issued by the Federal Motor Carrier Safety
Administration (FMCSA) are governing the working and driving hours of anyone operating a
commercial motor vehicle in the United States.
HOS mainly affects:
• Truck drivers,
• Both commercial and city bus drivers, and school bus drivers.
Who are operating CMVs for motor carriers (their employers).
These regulations limit the number of daily and weekly hours spent driving and working, and
regulate the minimum amount of time drivers must spend resting between driving shifts.
The driver of a CMV is required to keep a record of working hours using a log book:
• outlining the total number of hours spent driving and resting,
• as well as the time at which the change of duty status occurred.

Purpose & enforcement of HoS regulations
The HOS's main purpose is to prevent accidents caused by
driver fatigue.
This is accomplished by
• limiting the number of driving hours per day, and the
number of driving and working hours per week.
• keeping drivers on a 21- to 24-hour schedule,
maintaining a natural sleep/wake cycle (or circadian
rhythm).
Drivers are required to take a daily minimum period of rest,
and are allowed longer "weekend" rest periods to combat
cumulative fatigue effects.
Drivers found to be in violation of the HOS can be forced to
stop driving for a certain period of time, which may
negatively affect the motor carrier's safety rating.

11-Hour Driving Limit
May drive a maximum of 11 hours after 10 consecutive hours off
duty.
10-Hour Driving Limit
May drive a maximum of 10 hours after 8 consecutive hours off
duty.
14-Hour Limit
May not drive beyond the 14th consecutive hour after coming on
duty, following 10 consecutive hours off duty. Off-duty time does
not extend the 14-hour period.
15-Hour Limit
May not drive after having been on duty for 15 hours, following 8
consecutive hours off duty. Off-duty time is not included in the
15-hour period.
Rest Breaks
May drive only if 8 hours or less have passed since end of
driver’s last off-duty or sleeper berth period of at least 30
minutes. Does not apply to drivers using either of the short-haul
exceptions in 395.1(e). [49 CFR 397.5 mandatory “in attendance”
time may be included in break if no other duties performed]
60/70-Hour Limit
May not drive after 60/70 hours on duty in 7/8 consecutive days.

A driver may restart a 7/8 consecutive day period after taking 34
or more consecutive hours off duty.
Sleeper Berth Provision
Drivers using a sleeper berth must take at least 8 hours in the
sleeper berth, and may split the sleeper berth time into two
periods provided neither is less than 2 hours.

consecutive hours in the sleeper berth, plus a separate 2
consecutive hours either in the sleeper berth, off duty, or any
combination of the two.

Target group
Who must comply to HOS regulations?
Most drivers must follow the HOS regulations if they drive a commercial vehicle that
fits any of these descriptions:
• Vehicle weights 10,001 pounds or more
• Has a gross vehicle weight rating or gross combination of 10,001 pounds or more
• Is designed or used to transport 9 or more passengers (including the driver) for compensation
• Is designed or used to transport 16 or more passengers (including the driver) not for compensation
• Is transporting hazardous materials in quantities requiring placards
= Almost every existing customers and prospects in the transport and
passenger transport sector are affected from the HOS regulations.

Current situation
• Paper worksheets for registering Hours of Service need to be carried along in the vehicle
– Driver needs to fill in his working and driving hours by hand.
– Only the driver has access to Hours of Service information
– Worksheets can get lost. No way for recovery
• Fleet managers do not have any access to Hours of Service information in the vehicle and
cannot monitor the current situation.
• Drivers are calculating their hours themselves to ensure not to infringe the rules.
• High risk of record tampering.
• Solutions for digital Hours of Service registration are available. They are often expensive
and require a second system next to a fleet management solution.
