PURPOSE
The purpose of this policy is to implement procedures in compliance with Section 651.005 of
the Texas Government Code, the Military Selective Service Act and Proclamation 4771,
Registration under the Military Selective Service Act.
POLICY
Texas Woman’s University may not hire a person as an employee if the person is one of the
age and gender that would require a person residing in the United States to register with
the Selective Service System (SSS) under federal law, unless the person presents proof of
the person’s: (1) registration with the SSS as required by the federal law; or (2) exemption
from registration with the SSS.
All men must register with the selective service. The exceptions to this rule include:
nonimmigrant aliens on student, visitor, tourist, or diplomatic visas; men on active duty in
the U.S. Armed Forces; cadets and midshipmen in the service academies and certain other
U.S. military colleges. All other men must register upon reaching age 18 (or before age 26,
if entering and taking up residence in the U.S. when already older than 18)*.
Disabled men, clergymen, and men who are conscientiously opposed to war must register
also. There is no draft in effect, nor is there a program to classify men in these categories at
this time.
SSS registration verification does not apply to a person employed by TWU before September
1, 1999, as long as the person’s employment by TWU is continuous. A break in service
September 1, 1999 or after requires proof of selective service registration or exemption to
be eligible for rehire.
PROCEDURE
Effective September 1, 1999 Texas Woman’s University may not hire a male born on or
after January 1, 1960 unless he presents proof of:
1. Registration with the selective service system (by presenting a selective service
system registration acknowledgement card) or
2. Exemption from registration with the selective service system.
This policy applies to all employees of Texas Woman’s University, including faculty and
student employees, regardless of title, length or percent time of appointment, or source of
funds.
During the TWU job application process or search committee process the Reference and
Selective Service Verification Form must be completed and include supporting
documentation showing proof of registration or exemption. For faculty and staff the form
will be placed in the employee’s personnel file. The Career Center will retain the form for
student employees.
No offers of employment may be made without appropriate proof of SSS registration waiver
or exemption in accordance with this policy. Only the selected candidate will be verified
using the SSS registration. Graduate Assistants may be hired contingent upon proof of SSS
registration requirements. The Department of Career Services will verify proof of SSS
registration, prior to hiring, of any student assistants.
Those who were required to register, but failed to do so before they turn 26, are no longer
allowed to register, and thus may be permanently barred from federal jobs and other
benefits, unless they can show to the Selective Service that their failure was not knowing
and willful. There is a procedure to provide an "information letter" by the SSS for those in
these situations, for example recent citizens who entered the US after their 26th birthday.
However this letter does not constitute a waiver or exemption and does not indicate that
they are then eligible for jobs or benefits.
Employment offers will be withdrawn if registration of Selective Service cannot be
verified. The employee will have five business days to provide proof of registration in order
to maintain employment.
REVIEW
The Vice President for Finance and Administration will review this Policy with
recommendations forwarded through normal administrative channels to the Chancellor and
President.
