CBRE, INC.’S JOINDER IN LIMITED OBJECTION OF CRITZER
PROPERTIES, LLC AND THE DENNIS P. JORDAN PROPERTIES LLC TO MOTION
OF DEBTORS FOR ORDER: (I) AUTHORIZING AND APPROVING EXPEDITED
PROCEDURES FOR THE ASSUMPTION AND ASSIGNMENT OR REJECTION OF
EXECUTORY CONTRACTS AND LEASES, AND FOR THE
ABANDONMENT OF PROPERTY; AND (II) GRANTING RELATED RELIEF
CBRE, Inc., as the Court appointed receiver over the property commonly known as
10101 East Washington Street, Indianapolis, Indiana, and 8921 U.S. Highway 31 South,
Indianapolis, Indiana (“CBRE”), by counsel, submits this Joinder in the Limited Objection of
Critzer Properties, LLC and the Dennis P. Jordan Properties LLC to Motion of Debtors for
Order: (I) Authorizing and Approving Expedited Procedures for the Assumption and Assignment
or Rejection of Executory Contracts and Leases, and for the Abandonment of Property; and (II)
Granting Related Relief (Doc. 491) (the “Limited Objection”).

CBRE currently is the receiver over the property commonly known as 10101 East
Washington Street, Indianapolis, Indiana and 8921 US Highway 31 South, Indianapolis, Indiana
and
(collectively, the “Leased Premises”), pursuant to the Order Appointing Receiver, as
amended, entered by the Marion County Superior Court in Cause No. 49D01-1511-MF-037130
(the “Receivership Order”).
The Debtors in these cases, along with the last four digits of each Debtor’s federal tax identification number, are:
hhgregg, Inc. (0538); Gregg Appliances, Inc. (9508); and HHG Distributing LLC (5875). The location of the
Debtors’ corporate headquarters is 4151 East 96th Street, Indianapolis, Indiana 46240.

Gregg Appliances, Inc., is a tenant of the Leased Premises pursuant to a
Commercial Real Estate Lease dated November 1, 1997, as amended, and a Lease dated
November 12, 2014, as amended (collectively, the “Leases”). 2 True, correct and authentic copies
of the Leases are attached hereto as collective Exhibit A and by reference made a part hereof.

CBRE hereby joins the Limited Objection and adopts as its own the arguments
advanced by Critzer Properties, LLC, and The Dennis P. Jordan Properties LLC, within their
Limited Objection.
WHEREFORE, CBRE asks that (i) any order on the Lease Procedures Motion3 expressly
prohibit the Debtors from retroactively rejecting the leases prior to the entry of an order on the
Lease Procedures Motion; (ii) any order on the Lease Procedures Motion include a provision
within paragraph 4(b) that requires that Debtors to provide written notice to the respective
landlords that they have vacated the space; (iii) any order on the Lease Procedures Motion
include a provision terminating the automatic stay to allow landlords to terminate their leases
upon lease rejection; and (iv) the Court grant all other just and proper relief.
