BACKGROUND:
Since 2012, the City has piloted new parking meter technology, collected citizen feedback, and
procured approximately 200 single-space, sensor-enabled parking meters. Installation of these
meters began in mid-June 2013, primarily around Boise City Hall, on 8th Street (between
Jefferson and Main), and in BODO. In June, the City conducted stakeholder meetings with
downtown businesses to gain feedback on a proposal for extended enforcement hours, as well as
increased parking meter rates. A summary of the stakeholder feedback was presented to Council
during the July 9th Council Work Session.
The City continues to implement industry best practices and has identified objectives to
maximize parking availability downtown, enhance economic development, capitalize city
resources, enhance customer service, and improve data collection to make better management
decisions. To meet these objectives, staff is proposing modifications to the existing city code,
including an adjustment of the parking meter rate structure to recover operating costs associated
with the new meter technology.
A majority of the code changes were general clean-up and specific changes were outlined in a
memo to City Council dated June 27, 2013. Additional amendments have been made to the code
to reflect the direction given at the Council Work Session and to align with existing practices.
The proposed changes are reflected through three separate Council action items on this weeks
City Council Agenda. Staff has also attached the June 27, 2013 memo as a reference to the
initial code changes.

Section 10-17-01
DEFINITIONS
For the purposes of this chapter, the following terms, phrases, words, and derivations
shall have the meaning given herein. When not inconsistent with the context, words used in the
present tense include the future tense, words in the plural number include the singular number,
and words in the singular number include the plural number. The word "shall" is always
mandatory and not merely directory. Words used throughout this chapter, but not defined herein,
shall have their plain, ordinary, and common meaning.
A.
Operator: A person who owns, operates, stops, stands, parks, or leaves a vehicle. The
operator includes the vehicle’s actual owner or an agent, employee, or permittee of the
owner who is in possession or control of the owner’s vehicle.
B.
Park or Parking: Stopping or standing a vehicle, whether occupied or not, other than
temporarily while the operator is present and actively engaged in loading or unloading
goods, merchandise, or persons.
C.
Parking Meter: A mechanical or electrical device installed on or in the curb, sidewalk,
or public right-of-way that is adjacent to a parking meter space, for the purposes of:
1.
Regulating parking in the adjacent parking meter space; and
2.
Measuring the maximum allowable time of continuous parking in the adjacent
parking meter space; and
3.
Accepting the payment required to lawfully park a vehicle in the adjacent parking
meter space; and
4.
Providing notice of the remaining purchased time and of the expiration of
purchased time.
D.
Parking Meter Space: Any parking space adjacent to a parking meter.
E.
Parking Services Office: The Boise City Parking Services Office, or a designated

employee thereof.
F.
Parking Space: The area on or adjacent to a road, street, highway, or public right-of-way
that is designated and marked for the parking of a single vehicle.
G.
Person: Any individual, firm, partnership, association, corporation, company, or any
organization, regardless of its nature or type.
H.
Purchased Time: The amount of time purchased using a parking meter, during which a
vehicle may be lawfully parked in the adjacent parking meter space. Purchased time
includes the initial twenty (20) minutes of parking time available at no cost.
I.
Vehicle: Any device in, upon, or by which any person or property is or may be
transported or drawn upon a highway, except devices moved by human power or used
exclusively upon stationary rails or tracks.
J.
Zero Emission Vehicle (ZEV): A vehicle that produces zero emissions or pollution
when operating or stationary.
Section 10-17-02
DESIGNATION OF PARKING SPACES; PARKING METER
INSTALLATION
A.
The Parking Services Office is hereby directed and authorized to designate and mark
parking meter spaces.
B.
The Parking Services Office is delegated authority to install parking meters within the
rights-of-way of any highway in Boise City, pursuant to Idaho Code §40-1415(8).
C.
The Parking Services Office shall be responsible for the installation, regulation, control,
operation, maintenance, use, and enforcement of all parking meters in Boise City.
Section 10-17-03
PARKING METER RATES AND DURATION
Parking meter rates shall be as follows:
▪ initial 20 minutes....................free (using the “20 minutes free” feature)
▪ first paid hour .........................$1.50 /hour
▪ second paid hour ....................$3.00 /hour

Section 10-17-04
PARKING METER OPERATION
Every parking meter shall:
A.
Operate automatically, mechanically, or electronically to:
1.
Accept only proper forms of payment, to include (but not limited to) coins of the
United States, and credit or debit cards; and
2.
Determine and display the proper amount of purchased time equivalent to the
amount of payment received; and
3.
Countdown and display the remaining purchased time; and
4.
Upon expiration of purchased time, display notification that the right of the
operator to park a vehicle in the adjacent parking meter space has ended.
B.
Provide a button or other means by which an operator may receive the first twenty (20)
minutes of purchased time at no charge.
C.
Bear an official decal, or be equipped with an electronic display, indicating:
1.
The maximum allowable time of continuous parking by a single vehicle; and
2.
A schedule of the days and hours when the parking meter is in operation and
enforced; and
3.
A list of accepted forms of payment; and
4.
The cost per hour of parking at the parking meter, and a breakdown showing the
amount of time available for purchase at several common price points.
Section 10-17-05
DAYS AND HOURS OF PARKING METER ENFORCEMENT
A.
A parking meter is in operation and citations are issued for violations relating to that
parking meter or its adjacent parking meter space that occur on the days and during the
hours posted on that parking meter.
B.
Unless a parking meter is posted with extended hours of operation and enforcement, the
days and hours of parking meter operation and enforcement generally are as follows:
Monday through Friday, between the hours of
eight o'clock (8:00) a.m. and six o'clock (6:00) p.m.
C.
An operator is not required to pay for purchased time on the following holidays:
New Year’s Day (January 1)
Martin Luther King, Jr. Day (third Monday of January)
Washington’s Birthday / Presidents’ Day (third Monday of February)
Memorial Day (last Monday in May)
Independence Day (July 4)

Labor Day (first Monday in September)
Veterans Day (November 11)
Thanksgiving Day (fourth Thursday in November)

Section 10-17-06
ZERO EMISSION VEHICLE PERMIT
A.
A vehicle with a valid zero emission vehicle permit affixed to the front windshield in full
and unobstructed view may park in a parking meter space without paying for purchased
time. A zero emission vehicle permit does not exempt an operator or a vehicle from
complying with any other law or rule governing parking.
B.
A zero emission vehicle permit does not authorize any operator or vehicle to park longer
than the maximum allowable parking time posted on the parking meter.
C.
A zero emission vehicle permit shall be vehicle-specific and may not be transferred.
D.
Requirements for obtaining a zero emission vehicle permit:
1.
Permits for zero emission vehicles may be obtained from the Parking Services
Office.
2.
The Parking Services Office may develop an application specifying requirements
to obtain a zero emission vehicle permit. A vehicle inspection may also be
required prior to issuance of a permit.
3.
Every applicant for a zero emission vehicle permit shall pay the fee listed in the
City Clerk’s Licensing Fee Schedule prior to obtaining a permit.
Section 10-17-07
DELIVERY PERMITS, METER USE PERMITS, AND METER
HOODS
A.
Delivery permits, meter use permits, and meter hoods may be obtained from the Parking
Services Office.
B.
Delivery Permits.
1.
Upon application to the Parking Services Office, and upon payment of the fee
listed in the City Clerk’s Licensing Fee Schedule, the Parking Services Office
may issue a vehicle-specific delivery permit.
2.
Only a delivery-type vehicle displaying permanent advertising or lettering at least
two inches (2”) in height shall be issued a delivery permit. The Parking Services
Office is authorized to develop additional vehicle and advertising standards and
requirements.
3.
A delivery permit authorizes the permitted vehicle to park in a parking meter
space for up to one (1) hour while the vehicle’s operator is present and actively
engaged in loading or unloading goods or merchandise.
4.
To qualify for this parking meter space privilege, the delivery permit shall be
displayed and shall be clearly visible from outside the vehicle.
5.
A separate delivery permit application shall be submitted to the Parking Services

Office for each vehicle.
C.
Meter Use Permits.
1.
Upon application to the Parking Services Office, and upon payment of the
corresponding fee listed in the City Clerk’s Licensing Fee Schedule, the Parking
Services Office may issue a meter use permit.
2.
A meter use permit may be issued for any one (1) of the following timeframes:
a.
A year;
b.
A month; or
c.
A week; or
d.
A day.
3.
A single application for a meter use permit can identify up to five (5) vehicles that
may park pursuant to the meter use permit, once it is issued.
4.
Only vehicles identified on the application for a meter use permit are authorized
to park in a parking meter space without paying for purchased time, and to remain
in a parking meter space beyond the maximum allowable time of continuous
parking by a single vehicle.
D.
Meter Hoods.
1.
Upon application for a daily, weekly, or monthly meter use permit, the applicant
may also request a meter hood for a parking meter.
2.
When in use, a meter hood shall be locked onto the parking meter, thereby
entitling the applicant to park one of the (up to five) vehicles identified on the
meter use permit application in the parking meter adjacent to the parking meter on
which the meter hood is locked.
3.
A vehicle parked in a hooded parking meter space shall display a valid meter use
permit that is clearly visible from outside the vehicle.
4.
Only one (1) authorized vehicle at a time shall park in a hooded parking meter
space.
E.
Every application for a meter use permit or delivery permit shall:
1.
Be complete and accurate, to the best of the applicant’s knowledge and
information; and
2.
Identify the particular vehicle(s) that will use the meter use permit or delivery
permit, if issued; and
3.
Include a detailed description of the purpose(s) or use(s) for which the meter use
permit or delivery permit is sought.
F.
The Parking Services Office is authorized to:
1.
Establish additional qualifications for delivery permits, meter use permits, and
meter hoods; and
2.
Establish standards for the uses, purposes, and operations for which a delivery
permit, a meter use permit, or a meter hood will be issued; and
3.
Determine if the type of vehicle, the vehicle’s appearance, and the type of
proposed use, purpose, or operation of the applicant complies with the standards
established by the Parking Services Office; and

4.
Impose reasonable terms, conditions, or restrictions on the issuance and use of a
delivery permit, meter use permit, or meter hood.
G.
Failure to comply with the standards and qualifications established by the Parking
Services Office, pursuant to its authority granted herein, shall be the basis for denial,
revocation, or suspension of a delivery permit, meter use permit, and/or meter hood.
H.
The holder of a meter use permit or delivery permit shall be entitled to park without
paying for purchased time at a parking meter space, but only while the vehicle is actually
being used for the purpose for which the meter use permit or delivery permit was issued,
as specified on the application.
I.
A meter use permit or a delivery permit shall not be used to park in a parking meter space
within two (2) city blocks of the residence or place of business of the person who applied
for and was issued the permit.
J.
Meter use permits and delivery permits shall not be used at parking meter spaces where
the maximum allowable time of continuous parking by a single vehicle is less than one
hour.
K.
Right of Appeal.
1.
Every applicant for a delivery permit or meter use permit whose application is
denied shall have a right of appeal.
2.
Every holder of a meter use permit or delivery permit who has the meter use
permit or delivery permit revoked shall have a right of appeal.
3.
Unless otherwise expressly provided herein, appeal procedures shall follow those
set forth in Title 5, Chapter 2, Boise City Code.
L.
All permits and meter hoods issued pursuant to this chapter shall remain the property of
Boise City, and shall be surrendered to the Licensing Officer within seventy two (72)
hours of the suspension, revocation, or expiration thereof, or immediately upon demand
of the Parking Services Office.
Section 10-17-08
A.
VIOLATIONS
It is a misdemeanor criminal violation for any person to:
1.
Deposit or use, or attempt to deposit or use, any slug, button, token, or card, or
any other device, substance, or object, except coins of the United States or a card
or token authorized by the Parking Services Office, as a means of payment in a
parking meter.
2.
Open or remove any parking meter, unless pursuant to written authorization from
the Parking Services Office.
3.
Remove a parking meter post without first making appropriate arrangements with,
and obtaining written permission from, the Parking Services Office.
4.
Place or install a parking meter on any sidewalk, curb, or in the public right-ofway, or on any other public property, unless authorized in writing by the Parking

Services Office.
Willfully damage any parking meter.
Possess:
a.
Any key designed to open a parking meter, unless authorized by the
Parking Services Office; or
b.
Any device designed to open or break into a parking meter, unless
authorized by the Parking Services Office; or
c.
Any drawing, print, or mold of a key or device designed to open or break
into a parking meter, unless authorized by the Parking Services Office.
Forge or alter a meter use permit, delivery permit, or any other parking credential,
or use a forged or altered meter use permit, delivery permit, or other parking
credential normally issued pursuant to this chapter.
It is a parking violation for any person to:
1.
Park in a parking meter space without using the adjacent parking meter to pay for
purchased time. (“Failure to Pay Parking Meter”)
2.
Park in a parking meter space for longer than the purchased time, or fail to vacate
a parking meter space at or before expiration of the purchased time. (“Expired
Parking Meter”)
3.
Park in a parking meter space longer than the maximum allowable time of
continuous parking by a single vehicle. (“Extended Parking”)
4.
Re-feed (or “plug”) a parking meter. For the purposes of this chapter, re-feeding
(or “plugging”) a parking meter means to deposit additional payment in a parking
meter for the purpose of parking longer than the maximum allowable time of
continuous parking by a single vehicle.
5.
Park a vehicle in a parking meter space with the body of the vehicle extending
across the painted lines or markings designating the boundary of a single parking
meter space.
6.
Park more than one (1) vehicle in a single parking meter space.
7.
Park in a parking meter space that is officially marked by the Parking Services
Office or by a law enforcement officer as restricted or reserved, or that is blocked
by an official traffic control device or sign, or when the adjacent parking meter is
covered by a meter hood.
8.
Park a vehicle displaying a zero emission vehicle permit in any metered space for
a period longer than the maximum allowable time of continuous parking posted
on the parking meter.
9.
Use, or allow to be used, a zero emission vehicle permit to park a vehicle other
than the vehicle for which the permit was issued in a parking meter space without
paying for purchased time.
10.
Park an unauthorized vehicle in a parking meter space using a meter use permit or
a delivery permit.
11.
Fail to display a permit required by this chapter while parking in a parking meter
space.
12.
Use a meter use permit or meter hood, or allow a meter use permit or meter hood
to be used, when the vehicle parked in the parking meter space is not a necessary
part of the operations for which the meter use permit or meter hood was issued.

goods or merchandise.
Fail to comply with the terms, conditions, or restrictions placed on the issuance
and use of a permit issued pursuant to this chapter.
Park a vehicle displaying a meter use permit or delivery permit in a parking meter
space within two (2) blocks of the residence or place of business of the person
who applied for and was issued the permit.
Use an expired, suspended, or revoked meter use permit, meter hood, delivery
permit, or zero emission vehicle permit.
Fail to surrender a meter hood or a permit issued pursuant to this chapter to the
Parking Services Office within seventy two (72) hours of notification of the
suspension, revocation, or expiration, or upon the completion of the purpose for
which the meter hood or permit was issued.
Fail to surrender a meter hood or permit issued pursuant to this chapter
immediately upon demand of the Parking Services Office.
Use a meter hood, meter use permit, or delivery permit to park in a parking meter
space with a corresponding parking meter that has a maximum allowable time of
continuous parking by a single vehicle of less than one (1) hour.
Use a delivery permit to park a vehicle without the required advertising or
lettering in a parking meter space.
Park a vehicle using a delivery permit in a parking meter space for longer than
one (1) hour.

Every misdemeanor violation of the provisions of this chapter shall be punishable by a
fine of up to one thousand dollars ($1000.00), imprisonment in the county jail for up to
six (6) months, or both such fine and imprisonment.
D.
In addition to the parking violation fines and misdemeanor penalties set forth herein, the
Parking Services Office is authorized to suspend or revoke a delivery permit or meter use

permit for a violation of this chapter.
E.
If any vehicle is observed stopped, standing, or parked in violation of any provision of
this chapter and the identity of the operator cannot be determined, the vehicle’s owner, or
the person in whose name the vehicle is registered, or the person who is the named lessee
in a lease or rental agreement, shall be held prima facie responsible for all observed
violations involving the vehicle.
F.
An operator using a delivery permit, meter use permit, or meter hood who violates one
(1) or more provisions of this chapter, in addition to all applicable parking fines, may be
subject to revocation of the delivery permit or meter hood.
G.
If a delivery permit, meter use permit, or meter hood is revoked, the Parking Services
Office shall mail written notice of revocation to the person to whom the meter hood or
permit was issued.
H.
No refund shall be issued in the event a meter hood or permit is denied, suspended, or
revoked pursuant to this chapter.
Section 10-17-10
NOTICE OF PARKING VIOLATION; PROCEDURE
A.
Upon observing a vehicle stopped, standing, or parked in violation of this chapter, the
Parking Services Office is authorized to serve a notice of parking violation by any one (1)
or more of the following means:
1.
By leaving a notice of parking violation upon the vehicle; or
2.
By personally serving the operator or owner of the vehicle with a notice of
parking violation; or
3.
By personally serving a passenger of the vehicle with a notice of parking violation
in the presence of the owner or operator of the vehicle; or
4.
By mailing, via United States Postal Service First Class Mail, a notice of parking
violation to the vehicle’s owner at the address maintained in motor vehicle
registration records.
B.
Every notice of parking violation shall include the following, if applicable to the
observed violation:
1.
The date and time at which the violation was observed; and
2.
The make of the vehicle observed to be in violation; and
3.
The license plate number of the vehicle observed to be in violation; and
4.
The applicable parking meter number or a description of its location; and
5.
The code section violated; and
6.
A brief description of the violation; and
7.
Instructions explaining how the operator of the vehicle in violation may pay the
fine associated with the violation; and
8.
A statement describing the process by which the operator of the vehicle in
violation may challenge or contest the violation(s) indicated on the notice of
parking violation.

C.
A separate notice of parking violation may be served for each violation, including
cumulative violations for each time period exceeded.
D.
To prevent burdening courts and to reduce public inconvenience, each person served with
a notice of parking violation shall, before ten (10) business days from the date on the
notice of parking violation:
1.
Pay the corresponding parking fine amount on the table contained in this chapter
to the Parking Services Office; or
2.
Pay the corresponding parking fine amount (plus any applicable service fee) using
the on-line payment system authorized by the Parking Services Office; or
3.
Appear at the Parking Services Office (located on the first floor of Boise City
Hall) to challenge the violation(s) indicated on the notice of parking violation.
E.
The failure of an operator to pay the parking fine or appear to challenge the notice of
parking violation before ten (10) business days from the date on the notice of parking
violation shall result in an additional fifteen dollars ($15) being assessed for each
violation. This additional amount is intended to defray administrative and personnel
costs and mailing expenses that arise as a result of overdue fines and the failure to timely
pay a parking violation.
F.
The failure of an operator to pay the parking fine plus the additional fifteen dollars ($15)
administrative charge, or appear to challenge the notice of parking violation before forty
five (45) days from the date on the notice of parking violation shall result in the full
amount of the parking fines plus all applicable administrative charges being referred to
collections.
Section 10-17-11
SEVERABILITY
The provisions of this chapter are severable. Should any sentence, section, or other part
be held invalid, such invalidity shall not affect the remaining provisions of this chapter, which
shall remain in full force and effect.
Section 3.
That the summary of this ordinance, attached as Exhibit A, be, and the
same is, approved as to both form and content.
Section 4.
That this ordinance shall be in full force and effect from and after its
passage, approval, and publication.
