Proposed Zoning By-law Amendment: Article XX: Definition of "Theaters and Cinemas" To recommend favorably the Warrant Article as amended by the Planning Board, as noted here: Meeting Schedule: none scheduled Meeting Minutes approved by Committee: 7-0-0 (vote taken 11/4/15) Respectfully Submitted: Shari Lynn Ellis 4-5-0 Amended Warrant Article "Movie theaters and cinemas/motion picture theaters shall mean a facility regularly used for the exhibition of motion pictures, live broadcasts, or other similar performances on a regular basis to the general public. Food may be provided for consumption on the premises, whether for immediate consumption or as a component of a meal including the service of alcohol to a ticketed patron. Alcohol sales by a theater or cinema, if permitted by the Board of Selectmen, shall not exceed 25 percent of the motion picture theater's annual gross revenues and shall be limited to ticketed patrons only.” Discussion After a brief explanation from Kristin regarding the applicants reasons for requesting the warrant (applicant needs a definition in order for the BOS to be able to grant an alcohol license), Wendy suggested that the definition be only the first sentence. Some other members concurred that the alcohol use and terms should remain with the BOS and that it should not be in the zoning bylaws.
