Pakisran;
WIIEREAS extraordinary situation and circnmstancescxist which ck:mand
special measures for speedy trial ofcertain offences relating to terrorism. waging
orwar or insunection aguinstJ>aki~tan and prevention ofacts threatc11ing the scctuity
of Pakistan by any terrorist or terrorist group, armed group, wing and militia or
their members using the name ofreligion or a seet;

Ai\D WHEREAS there existS grave and unprecedented threat to the integrity
of Pakistan and objectives set out in the Preamble to the Constitution by the
ti·amers of the Constitution, from the terrorist groups by raising of arms and
insurgency using the name of rel igion or a sect or from the foreign and locally
funded 2J1ti-state clements;
AN DW HEIZEAS it is expedient that the said tcn·orists groups including any
such terrorists fighting wh.i.le using the name of religion or a sect, captured or to be
captured in combat with theAnned Forces or otherwise arc tried by the courts
established under the Acts mentioned hereinafter in seetion 2;
AND W H EREAS the people ofPakist.an have expressed their f1nn resolve
through their chosen representatives in the aU pruiies conferences held in aftennath
ofthc sad and terrible terrorist attack on the Am1y Public School at Peshawar on
16 December 2014 to pemmnently wipe out and eradicate terrorb'ts from Pak.ib'tan,
it is expedient !~> provide constirutional protection to the necessary measures taken
hereunder in the interest ofsecurity and integrity ofPakistan;
It is hereby enacted as follows :-·
l. Short title and commencemcnt.-(1) This Act may be called the
Constitution (Twenty-firstAmcndmcttt) Act, 20 15.
(2)
It shall come into force at once.
(3) The provisions ofthisActshall remain in force for a period oftlvo
years from the date o f its commencement and shall cease to form part of the
Constitution and shall stand repealed on the expiration of the said period.
A mend ment of Artic le 175 of the Constit ution.-In the
Constitution ofthe Islamic Republic ofPakistan, hereinafter called the Constitution,
in i\rticle 175, in clause(3), for the full stop at the end a colon shall besubstinltcd
and thereafter, the following proviso shall be inserted, namely:2.
"Provided that the provisions ofthis A•ticle shall have no application
to the trial of persons under any of the Acts mentioned atscriall\o. 6, 7,
8 and 9 of sub-part lU of' Pan l of the first Schedule, who claims. or is
knovvn, to belong to any terrorist group or organization using the name of
religion or a sect.

Explanation: In this proviso, the expression 'sect' means a sect of

3. Amendment in the First Schedule oft he Constitution. In the
Constitution. in d1c First Schedule, in sub-part 111 ol'Part I, after serial ~o. 5, me
