ARTICLE I
General Regulations
§ 125.1.
Definitions; interpretation. 1
125.1.1.
Words and phrases, when used in this chapter, shall have the meanings
ascribed to them in the Vehicle Code of Pennsylvania, Act of April 29, 1959, P.L. 58, as

amended, hereinafter called the "Vehicle Code," 2 except where the context clearly indicates a
different meaning.
125.1.2.
The term "legal holidays" as used in this chapter shall mean and include
New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and
Christmas.
125.1.3.
For the purposes of this chapter, State Route 19 and the streets running
parallel or generally parallel thereto shall be deemed to run in a north-south direction, and streets
and highways perpendicular or generally perpendicular thereto shall be deemed to run in an eastwest direction.
§ 125.2.
Manner of adopting permanent traffic and parking regulations.
All traffic and parking regulations of a permanent nature shall be enacted as ordinances,
as parts of ordinances or as amendments to ordinances of the township.
§ 125.3.
Temporary and emergency regulations. [Amended 1-7-85 by Ord. No. 1117]
125.3.1.
The Township Manager or his designated representative shall have the
following powers to regulate traffic and parking temporarily and in time of emergency:
125.3.1.1.
In the case of fire, flood, storm or other emergency, to establish
temporary traffic and/or parking regulations.
125.3.1.2.
In the case of emergencies or to facilitate public works, or in the
conduct of parades, processions or public events, to restrict or prohibit traffic and/or parking in
limited areas for periods of not more than seventy-two (72) hours.
125.3.2.
Such temporary and emergency regulations shall be enforced by the
Department of Police Protection in the same manner as permanent regulations. Any person who
shall operate or park a vehicle or tractor in violation of any such regulation, or who shall move,
remove, destroy, injure or deface any sign or marking erected, posted or made to give notice of
any such regulation, shall, upon conviction thereof, be liable to the penalty set forth in this
chapter.
125.3.3.
In anticipation of or during any event, including but not limited to
emergencies, which shall occur in the township and which shall require temporary motor vehicle
parking regulation, the Township Manager or his designated representative of the township is
hereby authorized to designate streets for no parking and to cause no-parking signs to be erected
for such duration as shall be necessary for the efficient and safe movement of traffic, with the
same force and effect as though this chapter specifically designated the no-parking area.

Experimental regulations. [Amended 6-7-76 by Ord. No. 628]
125.4.1.
The Township Manager or his designated representative is hereby
empowered to make a one-year trial period of any traffic regulation, provided that in advance of
its becoming effective the Board of Commissioners shall be notified in writing of such proposed
regulation, with reasons for it, and provided that notice of such regulation by signs shall be given
to the public in advance of its enforcement. After the day the said regulation so becomes
effective it shall govern traffic for a period of one (1) year thereafter, within which time there
shall be introduced to the Board of Commissioners an ordinance embodying such regulation or
such part thereof as it may be desired to have continued in force, and such regulation as is
embodied in such ordinance shall continue in force during such time as said ordinance shall be

125.4.2.
If no ordinance embodying such regulation or any part thereof shall have
been introduced to the Board of Commissioners within said period of one (1) year, or if any such
ordinance shall fail final enactment then such regulation shall be no longer in force.
125.4.3.
The Board of Commissioners may at any time rescind any such trial
regulation by a written resolution. The Township Manager or his designated representative shall
immediately cause such regulation to be withdrawn and the regulation which applied prior to it

§ 125.5.
Authority of police officers. [Amended 1-7-85 by Ord. No. 1117]
The police officers of the township are hereby given the authority to direct traffic and to
enforce traffic laws on the highways of the township and at the intersections thereof.
ARTICLE II
Traffic Regulations
§ 125.6.
Motor vehicles driven on sidewalks.
No person shall operate a motor vehicle or tractor upon any sidewalk in the township; nor
shall any person operate a motor vehicle upon or across any sidewalk except in order to gain
access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is
curbed, shall have been properly cut down for the purpose.
§ 125.7.
Speed limits. [Amended 1-4-82 by Ord. No. 982]
125.7.1.
Speed limits. The speed limit in the township is hereby designated as
twenty-five (25) miles per hour, except as listed in Schedule I (§ 125.41) attached hereto and
incorporated herein, excluding those highways and streets regulated and controlled by the
Department of Transportation, Commonwealth of Pennsylvania.

125.7.2.
Enforcement procedure. The Township Manager or his designated
representative is authorized to implement enforcement procedures, including the use of
electrical-mechanical devices, i.e., excessive speed preventor (E.S.P.) and VASCAR Plus,
provided that proper notice is given to the driving public that such devices are used. Proper
notice shall be in the form of signs posted at entrances to the township. Such signs will state that
the speed limit is electrically-mechanically enforced and the number of this chapter. [Amended

125.7.3. State-regulated streets and highways. The Township Manager or his designated
representative will cooperate with the Department of Transportation, Commonwealth of
Pennsylvania, in regard to the placement of the aforementioned signs on state streets and
highways and will comply with all applicable Department of Transportation rules and
regulations. [Amended 1-7-85 by Ord. No. 1117]
§ 125.8.
Traffic signals at intersections.
At the intersections listed in Schedule II (§ 125.42) attached hereto and incorporated
herein, official traffic signals shall be erected and traffic at such intersections shall be directed by
such signals.
§ 125.9.
One-way highways.
The highways listed in Schedule III (§ 125.43) attached hereto and incorporated herein
are hereby established as one-way highways.
§ 125.10.
U-turns prohibited.
It shall be unlawful for the operator of a motor vehicle or tractor to make a U-turn on any
of the highways in the township, except as listed in Schedule IV (§ 125.44) attached hereto and
incorporated herein.
§ 125.11.
Left and/or right turns required or prohibited.
It shall be unlawful for the operator of any motor vehicle or tractor traveling upon the
first-named highway at any of the intersections as listed in Schedule V (§ 125.45) attached hereto
and incorporated herein, in the direction or directions indicated in each case, to make the
prohibited or fail to make the required left turn and/or a right turn at the said intersection, as
indicated in Schedule V. [Amended 11-6-90 by Ord. No. 1415]
125-11.1.
Turn on red at signalized intersection prohibited. [Added 6-20-77 by
Ord. No. 704]
It shall be unlawful for the operator of any motor vehicle or tractor traveling upon
the first-named highway at any of the signalized intersections as listed in Schedule VA (§
125-45.1) attached hereto and incorporated herein, in the direction or directions indicated

in each case, to make a left turn and/or a right turn at the said intersection when the traffic
signal is red.
§ 125.12.
Traffic to keep right of certain center structures and barriers.
All vehicular traffic shall keep to the right of the structures or barriers located in the
center of the specified intersections indicated in Schedule VI (§ 125.46) attached hereto and
incorporated herein.
§ 125.13.
Stop intersections.
The intersections listed in Schedule VII (§ 125.47) attached hereto and incorporated
herein are hereby established as stop intersections, and official stop signs shall be erected in such
position as to face traffic approaching the second-named highway upon the first-named highway
in the direction or directions indicated in Schedule VII. All vehicles and tractors approaching
any such intersection upon the first-named highway, in the direction or directions indicated in
Schedule VII in each case, shall come to a full stop, within a reasonable distance, before entering
any such intersection.
§ 125.14.
Yield intersections.
The intersections listed in Schedule VIII (§ 125.48) attached hereto and incorporated
herein are hereby established as yield right-of-way intersections, and official yield signs shall be
erected in such a position as to face traffic approaching the second-named highway from the
first-named highway, in the direction or directions indicated in Schedule VIII. All vehicles and
tractors approaching any such intersection upon the first-named highway, in the direction
indicated in Schedule VIII, shall yield the right-of-way to any vehicle in the intersection or
approaching on the second-named highway so closely as to constitute an immediate hazard
during the time that the operator of such vehicle or tractor is moving across or within such
intersection.
§ 125.15.
Certain classes of vehicles prohibited on certain highways.
It shall be unlawful for any person to operate any vehicle or tractor, except a passenger
vehicle (but not including any passenger vehicle drawing any trailer or towing any other
vehicle), upon any of the portions of the highways in the township listed in Schedule IX (§
125.49) attached hereto and incorporated herein, except for the purpose of making local
deliveries.
§ 125.16.
Vehicle weight limits.
It shall be unlawful for any person to operate any commercial vehicle or other tractor,
trailer or tractor-trailer combination, having a gross weight in excess of that listed in Schedule X
(§ 125.50) attached hereto and incorporated herein, upon any of the highways or portions thereof
listed in Schedule X, except for the purpose of making local deliveries on such highway.

§ 125
Operation of motor vehicles on closed highways.
It shall be unlawful for any person to operate any vehicle or tractor upon any highway in the
township that is under construction, resurfacing or repair, in disregard of any official sign,
barricade or notice that the same is closed to vehicular traffic.3
§ 125.18.
Play highways.
125.18.1.
The areas upon the highways in the township listed in Schedule XI (§
125.51) attached hereto and incorporated herein are hereby established as play highways
whereon sledding and coasting shall be permitted in accordance with this section.
125.18.2.
When weather conditions are appropriate, the Township Manager or his
designated representative is hereby authorized to designate any or all play highways, whenever
he shall deem such action advisable and for whatever period of time directed by him [not to
exceed five (5) consecutive days], as closed to all motor vehicles. Such play highways shall be
set apart for the purpose of sledding or coasting under the direction of the Township Manager or
his designated representative. [Amended 1-7-85 by Ord. No. 1117]
125.18.3.
No person shall operate any motor vehicle upon any play highway at any
time when such play highway shall be so designated, except in case of emergency, with special
permission of the Township Manager or his designated representative, who shall first clear such
play highway of all persons using such highway for the purpose for which it was set aside.

§ 125.19.
Accident reports. [Amended 1-7-85 by Ord. No. 1117]
The operator of any motor vehicle involved in an accident in the township and required
by law to report such accident to any department or agency of the Commonwealth of
Pennsylvania, or any other person required to make such report, shall, at the time of making such
report to the commonwealth, make a written report to the Department of Police Protection of the
township containing the same information.
ARTICLE III
Parking Regulations
§ 125.20.
Parking without lights authorized.
The boundary limits of the township are hereby established as a zone in which motor
vehicles may remain standing without lights, and all highways within such boundary limits are
hereby designated as highways where motor vehicles may remain standing without lights.

Vehicles to be parked within marked spaces.
Wherever a space shall be marked off on any highway for the parking of an individual
vehicle, every vehicle there parked shall be parked within the lines bounding such space.
§ 125.22.
Angle parking.
125.22.1.
Only angle parking shall be permitted on the portions of the highway
listed in Schedule XII (§ 125.52) attached hereto and incorporated herein.
125.22.2.
On all highways or portions thereof where angle parking is now or shall
hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest
the curb.
§ 125.23.
Stopping prohibited.
In the areas described in Schedule XIII (§ 125.53) attached hereto and incorporated
herein, no stopping shall be permitted at any time except at official traffic signals, provided that
vehicles licensed for public transportation shall be permitted to stop at authorized stations.
§ 125.24.
Parking prohibited.
Parking is hereby prohibited on the highways listed in Schedule XIV (§ 125.54) attached
hereto and incorporated herein at all times on the sides of the highway in the locations indicated
on Schedule XIV.
§ 125.25.
Parking restricted.
125.25.1.
Parking prohibited during certain hours. No person shall park a vehicle
between the hours specified in Schedule XV (Section 125.55) attached hereto and incorporated
herein of any day upon any of the highways or parts of highways listed in Schedule XV attached
hereto and incorporated herein. The Township Manager or his designated representative is
authorized to promulgate procedures for granting exemptions to the prohibition of on-street
parking between posted hours. [Amended 3-6-89 by Ord. No. 1378]
125.25.2.
Time limit parking. No person shall park a vehicle for longer than the time
established in Schedule XVI (§ 125.56) attached hereto and incorporated herein at any time
between the hours indicated of any day (except Sundays and holidays) upon any of the highways
or parts of highways described in Schedule XVI.
125.25.3.
Parking of certain trucks prohibited. It shall be unlawful for any person to
park a dump truck, truck trailer, tandem truck, semitrailer truck, combination tractor-trailer truck,
tow truck or flatbed truck, the length of whose bed exceeds nine (9) feet, on any township street
or private driveway in any residential district as defined in the Township Zoning Ordinance and

amendments;4 except that this provision shall not prevent the operator of such a vehicle from
temporarily stopping or parking in accordance with other stopping or parking regulations at any
place for the purpose of and while actively engaged in the receiving or discharging of supplies
and materials or the actual provision of a service to a resident in the township. The Township
Manager or his designated representative is hereby empowered to issue a temporary permit for
the parking of the aforementioned vehicles for a period of not more than forty-eight (48) hours if,
in the opinion of the Township Manager or his designated representative, an emergency situation

125.25.4.
The Township Manager is hereby authorized to establish parking
restrictions on all township property, including but not limited to restricting space for the use of
township officials or other restricted uses. Any parking in a restricted space by an unauthorized
person shall be considered a violation of this chapter. [Added 5-5-86 by Ord. No. 1209]
§ 125.26.
Special purpose parking zones.
The zones listed in Schedule XVII (§ 125.57) attached hereto and incorporated herein are
hereby established as special purpose parking zones, and it shall be unlawful for any person to
park any vehicle or tractor, or to allow the same to remain parked, in any such zone, except as
specifically provided for such zone.
§ 125.27.
Parking restricted in parks. [Amended 6-4-84 by Ord. No. 1088]
Parking is hereby prohibited in the parks and parklets of the township in accordance with
§ 93.2.
ARTICLE IV
Obstruction of Thoroughfares5
§ 125.28.
Obstruction of thoroughfares prohibited. [Amended 12-6-76 by Ord. No.
664; 1-7-85 by Ord. No. 1117]
It shall be unlawful for any person, firm or corporation, whether principal or agent, to
obstruct by vehicles or otherwise any driveway, alleyway, roadway or other way of any kind
within the business areas or at educational institutions or at multifamily residential areas where
signs have been placed by order of the Township Manager or his designated representative
giving notice that such driveway, alleyway, roadway or other way of any kind shall not be so
obstructed for fire lane, public safety, general traffic or any other purpose.

The Township Manager or his designated representative is hereby authorized and
empowered to designate such prohibition by proper markings and signs so located along the side
or sides of such driveway, alleyway, roadway or other way of any kind and at such reasonable
intervals along the same as will give proper notice of such prohibition to persons using such
driveway, alleyway, roadway or other way of any kind.
§ 125.30.
Sign damage; cost of repair or replacement included in penalty.
It shall be unlawful to remove, injure, destroy or deface any marking or sign so placed in
accordance with the provisions of this Article. Any person violating the provisions of this section
of this Article shall pay, in addition to the fine imposed for the violation of this Article, the cost
of replacing or repairing any marking or sign removed, injured, destroyed or defaced by such
offender.6
ARTICLE V
Parking Meters
§ 125.31.
Designation of parking spaces. [Amended 8-2-76 by Ord. No. 632; 1-7-85 by
Ord. No. 1117]
The Township Manager or his designated representative is hereby authorized to provide
for the marking off of individual parking spaces in the parking zones designated and described as
provided in this Article, said parking spaces to be designated by lines painted or marked on the
curbing or surface of the highway. At each space so marked off, it shall be unlawful to park any
vehicle in such a way that said vehicle shall not be entirely within the
limits of the space so designated.
§ 125.32.
Operation of meters.
When any vehicle shall be parked in any space adjacent to which a parking meter is
located in accordance with the provisions of this Article, the operator shall, upon entering the
said parking space, immediately deposit or cause to be deposited such coin or coins of the United
States as is required for such parking meter and as is designated by proper instructions on the
parking meter, and failure to deposit such coin or coins shall constitute a breach of this Article
and shall subject each person to the penalty prescribed in § 125.40 hereof. Upon the deposit of
such coin or coins and placing said meter in operation the parking space may be lawfully
occupied by such vehicle during the period of parking time which has been prescribed for the
part of the highway in which said parking space is located, and for which a coin or coins is or are
deposited, as indicated on the parking meter. If said vehicle shall remain parked in any such

parking space beyond the parking time limit so fixed for such parking space, the parking meter
shall, by its violation signal, dial or pointer, indicate such illegal parking, and in that event, such
vehicle shall be considered as parked overtime and beyond the period of legal parking time. The
parking of a vehicle overtime or beyond the period of legal parking time in any such part of a
highway where any such parking meter is located shall be a violation of this Article and
punishable as hereinafter set forth.
§ 125.33.
Manner of parking.
125.33.1.
When a parking space in any parking meter zone is parallel with the
adjacent curb or sidewalk, any vehicle parked in such parking space shall be parked so that the
foremost part of such vehicle shall be nearest to the parking meter; provided, however, that
where double parking meters are installed upon one (1) standard so as to serve two (2) parking
spaces, any vehicle parked in the space just beyond the parking meters shall be parked so that the
rear bumper of such vehicle shall be nearest to the parking meter. When a parking space in any
parking meter zone is diagonal to the curb or sidewalk, any vehicle parked in such parking space
shall be parked with the foremost part of such vehicle nearest to such meter.
125.33.2.
Where lines or markings are painted or placed upon the curb, sidewalk,
highway and/or paved surface adjacent to each parking meter providing for parking at an angle
and not parallel or perpendicular to the curb, it shall be unlawful for the operator of any motor
vehicle to cross the center line of the highway to enter or leave said parking area.
§ 125.34.
Violations.
It shall be unlawful and a violation of the provisions of this Article for any person:
125.34.1.
To cause, allow, permit or suffer any vehicle registered in the name of or
operated by such person to be parked overtime or beyond the period of legal parking time
established for any parking meter zone as herein described or to deposit in any parking meter any
coin for the purpose of parking beyond the maximum legal parking time for the particular
parking meter zone.
125.34.2.
To permit any vehicle to remain or be placed in any parking space
adjacent to any parking meter while said meter is displaying a signal indicating that the vehicle
occupying such parking space has already been parked beyond the period prescribed for such
parking space.
125.34.3.
To park any vehicle across any line or marking of a parking meter space or
in such position that the vehicle shall not be entirely within the area designated by such lines or
markings.
125.34.4.
To deface, injure, tamper with, open or willfully break, destroy or impair
the usefulness of any parking meter installed under the provisions of this Article.

125.34.5.
To deposit or cause to be deposited in any parking meter any slug, device
or metal substance or other substitute for lawful coins.
125.34.6.
To park or permit the parking of any vehicle in any parking meter space
where the meter does not register lawful parking.
§ 125.35.
Report of violations; citations. [Amended 1-7-85 by Ord. No. 1117]
It shall be the duty of police officers of the township and such other persons as may be
designated and authorized by the Township Manager or his designated representative, acting in
accordance with instructions issued by the Township Manager or his designated representative,
to report:
125.35.1.
The number of each parking meter which indicates that the vehicle
occupying the parking space and adjacent to such parking meter is or has been parked in
violation of any of the provisions of this Article.
125.35.2.
The state license number of such vehicle.
125.35.3.
The length of time during which such vehicle is parked in violation of any
of the provisions of this Article at the time of his inspection.
125.35.4.
Any other facts a knowledge of which is necessary to a thorough
understanding of the circumstances attending such violation.
§ 125.36.
Collection of coins from meters. [Amended 1-7-85 by Ord. No. 1117]
It shall be the duty of the Township Manager or his designated representative to designate
some proper person or persons to make regular collections of the moneys deposited in said
meters.
§ 125.37.
General provisions.
125.37.1.
Temporary suspension of provisions. The provisions of this Article may
be temporarily suspended by the Township Manager or his designated representative, and he
may prescribe temporarily such other rules and regulations as traffic conditions may require.

125.37.2.
Suspension of provisions on designated holidays. The use of parking
meters throughout the Township of Upper St. Clair be and the same is hereby dispensed with on
the following holidays: New Year's Day, Memorial Day, July 4, Labor Day, Thanksgiving and
Christmas.

125.37.3.
Erection of signs. The Township Manager or his designated representative
is authorized to erect or cause to be erected appropriate signs notifying the operators of motor
vehicles of the provisions of this section of this Article. [Amended 1-7-85 by Ord. No. 1117]
125.37.4.
Tokens. Where the use of any coin or coins is required under the
provisions of this Article, it shall be permissible to use such token for that use as shall be
designated and approved by the township.
§ 125.38.
Parking meter zones established.
125.38.1.
Parking meter zones are hereby established upon the highway or parts of
highways described in Schedule XIX (§ 125.59) attached hereto and incorporated herein, and
parking or standing a vehicle in any parking meter space in such zones shall be lawful only upon
deposit of the amount required for each specified period of time, and only when not in excess of
the maximum parking time indicated on all days except Sundays and holidays.
125.38.2.
Off-street parking meter areas are hereby established as described in
Schedule XX (§ 125.60) attached hereto and incorporated herein, and parking of a vehicle in
areas described in Schedule XX shall be subject to the same provisions as for on-highway
parking meter zones.
125.38.3.
The Township Manager or his designated representative is hereby
authorized to designate special parking meter spaces within the zones established in Subsections
1 and 2 above which may have parking time limits of fifteen (15) or thirty (30) minutes, and the
parking meters located adjacent to such parking spaces shall be designed so as to be operable for
such time period only. Such special parking meter spaces shall be adequately identified, and said
meters shall bear instructions as to their operation in conformity with this subsection. [Amended

§ 125.39.
Parking meter rates. [Amended 8-2-76 by Ord. No. 632]
The charges for the zones established in Schedules XIX and XX shall be as follows:
125.39.1.
In parking meter spaces with a time limit of fifteen (15) minutes, the
charge shall be five cents ($0.05) for fifteen (15) minutes, in the form of one (1) nickel.
125.39.2.
In parking meter spaces with a time limit of thirty (30) minutes, the charge
shall be five cents ($0.05) for thirty (30) minutes, in the form of one (1) nickel.
125.39.3.
In areas with a parking time limit of one (1), two (2), four (4) or ten (10)
hours, the charge shall be five cents ($0.05) per hour in the form of nickels or dimes; provided,
however, that in areas with parking time limit of ten (10) hours, meters may be activated for the
entire period of ten (10) hours upon the deposit of twenty-five cents ($0.25) in the form of one
(1) quarter.

ARTICLE VI
Penalties
§ 125.40.
Violations and penalties. [Amended 8-2-76 by Ord. No. 632]
The penalties and fines for violations of this chapter, with the exception of §§ 125.28 and
125.29 of Article IV and all sections of Article V, shall be as provided in the Vehicle Code of the
Commonwealth of Pennsylvania. The penalty or fine for violation of the sections cited above
shall be as follows:
125.40.1.
For violations of §§ 125.28 and 125.29 of Article IV, a fine of fifteen
dollars ($15.) shall be imposed for each violation and shall be collected by the issuing authority
by a citation procedure whereby the fine may be paid to the district Magistrate. If the fine is not
paid within ten (10) days, the township police shall further prosecute the violator before a
Magistrate. If such further prosecution is necessary, the violator shall pay the fine of fifteen
dollars ($15.) plus costs imposed by the Magistrate. In default of payment, the violator may be
sentenced to imprisonment in the Allegheny County Jail for not more than five (5) days. If
payment is made at the Township Municipal Building or at a designated Upper St. Clair
Township fine receptacle box within forty-eight (48) hours the fine shall be five dollars ($5.).

125.40.2.
For violations of all sections of Article V, a fine of two dollars ($2,), if
paid within forty-eight (48) hours, shall be imposed for each violation, to be collected by a
ticketing procedure whereby the fine may be paid at the Township Municipal Building or at a
designated Upper St. Clair Township fine receptacle box. If not paid within forty-eight (48)
hours, a summons will be issued by the Department of Police Protection and, upon summary
conviction, the fine will be ten dollars ($10.) plus costs. [Amended 1-7-85 by Ord. No. 1117]
