Notice: THIS IS A LEGALLY BINDING AGREEMENT. By signing this Agreement, you are knowingly and intentionally waiving your rights to bring a
court action to recover compensation or obtain any other remedy for any claim whatsoever for expense, loss or injury to person or property, or death of any
person which may allegedly or actually arise out of, or in connection with, or result from your or your child's participation in equestrian activities with Southern
Arizona Eventing Association (hereinafter referred to as “SAzEA”), including, but not limited to, riding, jumping, schooling, showing, ground work and other
associated training, or as a result of or in connection with, trailering and/or travel to or from the trail, show or schooling sites, whether or not caused by the
negligence of SAzEA, the negligence or willfulness of some third party, or by any other cause.
I, ______________________________________________, in consideration for my participation with SAzEA agree to the following:
Acknowledgment and Assumption of Risk
I hereby acknowledge and agree that I chose to participate voluntarily as a rider, handler, volunteer or as a parent or guardian of a minor participant.
I am fully aware that horseback riding and/or being around horses and the associated activities involves dangerous activities and that there are many obvious
and non-obvious inherent risks always present in such activities despite all safety precautions. I am fully aware and acknowledge that horseback riding and/or
being around horses involves inherent dangerous risks of accident, loss, and serious bodily injury including broken bones, head injuries, trauma, pain,
suffering, or death (“Harm”). I acknowledge that “inherent dangerous risks” include, but are not limited to, circumstances over which we have no control; the
propensity of a horse to behave in ways that may result in injury, harm, or death to persons on or around them; the unpredictability of the horse’s reaction to
such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals; certain hazards such as surface and subsurface conditions;
collisions with other horses, animals or objects; and the potential of another participant or third party to act in a negligent manner that may contribute to injury
to the participant or others, such as failing to maintain control over the horse or not acting within his or her ability. I further acknowledge that with my
participation with this event is located in a “rural” area and may have certain latent or patent defects such as uneven paths or ground, rocks, holes, stumps
or other debris or objects under, on, or protruding from the surface of the ground, and may have pests or venomous snakes upon the premises; (ii) that there
are latent dangers present in all types of equipment, tools, vehicles and machinery used in and around equestrian facilities. I understand that such risks may
cause, contribute to, or result in serious injury or death, and I hereby agree to assume all such risks, both enumerated and not enumerated, associated with
this activity.
Waiver/Release/Indemnification and Covenant Not to Sue
As part of the consideration for my participation and use of the premises, equipment, and services of SAzEA, I hereby agree to release from liability,
indemnify and hold SAzEA, including its officers, members, agents, employees, participants, volunteers and/or affiliated entities, harmless and do hereby
waive any right I, my heirs, representatives or assigns may have against SAzEA, its officers, members, agents, employees, participants, volunteers and/or
affiliated entities, to assert any cause of action, claim or demand of any nature whatsoever, including a claim for negligence which I, my heirs or assigns may
have now or in the future, on account of personal injury or death, property damage, injury or accident of any kind, however the injury or damage is caused,
including but not limited to the negligence of any officers, members, agents, employees, participants, volunteers and/or affiliated entitity, of SAzEA or the
conduct of any party connected in any way with SAzEA.
I further understand the requirement of protective equipment in order to participate and I acknowledge that the SAzEA requires that I do so while
WARNING that no protective equipment can guard against all injuries. If I am a parent or guardian of a participant, I consent to the child’s participation and
AGREE to all of the above provisions and AGREE to assume all of the obligations of this Release on the child’s behalf. I AGREE that “SAzEA” as used
above includes all of SAzEA officers, members, agents, employees, participants, volunteers and affiliated entities.
Scope of Agreement
This Agreement shall be construed and governed by Arizona Law in such a manner as will render it fully enforceable. If any provision is found to be
unenforceable, such provision (or so much thereof as is found to be unenforceable), the remainder of this Agreement shall continue in full force and effect.
